Meeting called to order by Mayor Present:Mayor Trustees:ifl Also Present: Absent: Section 7.Notice of the election shall be published in the Estes Park Trail Gazette,a semi-weekly newspaper having general circulation in the Town,in the edition of said newspaper dated Friday,October 6, 1972,and a copy of such Notice shall be posted at the polling place at least ten (10)days before said election.The Town Clerk is hereby charged with the duty of giving such notice.Said Notice shall be in substantially the following form: PUBLIC NOTICE OF SPECIAL MUNICIPAL ELECTION TOWN OF ESTES PARK,COLORADO TUESDAY,OCTOBER 17,1972 PUBLIC NOTICE IS HEREBY GIVEN,That at a special municipal election to be held in the Town of Estes Park,on Tuesday,the 17th day of October, 1972,between 7:00 o’clock A.ij.and 7:00 o’clock P.M.,of said day,there will be submitted to the registered qualified electors of the Town the following question: “Shall the Town of Estes Park,Mrimer County, Colorado,issue its General Obligation Bonds in the principal amount not exceeding $600,000 for the purpose of improving and furnishing an existing building,and constructing and furnish ing a new building,both to be used for municipal purposes,such bonds to bear interest at a maximum net effective interest rate not exceeding 67,per annum,and to mature serially within ten years from their date?” There shall be one municipal election precinct,for this election, the boundary thereof to be the same as the boundary of the Town.The polling place shall be at the Town Hall in Estes Park. Any person who is at least eighteen (18)years of age,a citizen of the United States,and who has resided in the State of Colorado and in the municipal election precinct for thirty—two days immediately pre ceding this election,and who has complied with the registration laws, shall be entitled to vote on the question referred to above.The registration list for the municipal election precinct shall contain the names and addresses of all electors residing within the municipal election precinct whose names appeared on the County registration records at the close of business on the thirty second day preceding the municipal election (i.e.Friday,September 15,1972.) Those electors who are otherwise fully qualified to vote on said question at such election,but who are or will be unable to appear at the polling place on the day of election,may apply in writing at the office of the Town Clerk,at the Town Hall for an absentee ballot,at any time during business hours,on or before Friday,October 13,1972. IN WITNESS WhEREOF,the Board of Trustees has caused this Notice to be given as required by law,as of the 28th day of August,1972. 273 (SEAL) Publish in: Publish on: Estes Park Trail Gazette Friday,October 6,1972 /s/Dale G.Hill Town Clerk Section 8.When any registered qualified elector on the day of the special municipal election,shall be absent from the Town,or by reason of his work or the nature of his employment is likely to be absent and fears that he will be absent from the Town on said day,or because of serious illness or physical disability or for reasons based upon the doctrines of established religions shall be unable to attend the polls,he or she may vote by absentee ballot,in accordance with the provisions of the Colorado Municipal Election Code of 1965,as amended. Application for an absentee ballot shall be filed with the Town Clerk not later than the close of business on the Friday immediately preceding the election.The application may be in the form of a letter, stating the applicant’s residence address and the reason or reasons for which such an absentee ballot is requested. Section 9.That if any one or more sections or parts of this Resolution shall be adjudged unenforceable or invalid,such judgment shall not affect,impair or invalidate the remaining provisions hereof, it being the intention that the various provisions hereof are severable. Meeting called to order by Mayor Present:Mayor Trustees: Also Present:- Absent: Those voting NAY:None A majority of the Trustees present having voted in favor of the passage and adoption of the Resolution,the presiding officer thereupon declared the Resolution was duly passed and adopted. It was then ordered that the Resolution,after its approval by the Mayor and attestation by the Town Clerk,be recorded by the Town Clerk according to law. Thereupon,after consideration of other business to come before the Board,the meeting was adjourned. S E A L) U As required by law,the Town Administrator submitted a financial report of the Firemen’s Pension Fund for the year ending July 31,1972.Trustee Glenn Prosser moved the above mentioned report be accepted.Trustee Rollen Sutter seconded the motion.Upon roll call the motion unanimously carried. The Town Administrator read the minutes of the Estes Park Planning Commission meeting held August 15,1972. Trustee Glenn Prosser moved that the request to divide a,portion of Tht 9,Mount View Park,by Mrs.Evelyn Pales,be denied.Trustee Robert E.Wagner seconded the motion.Upon roll call the motion unanimously carried. Trustee Robert E.Wagner moved the request by Mr.&Mrs.Paul B.Hayes .j to divide Lots 2 and 3,Block 5,Hyde Park Addition,be approved. Trustee Prosser seconded the motion.Upon roll call the motion unani mously carried. Mr.Torn Brown submitted the final plat of PeVille Subdivision to the Board of Trustees.Mr.Brown indicated the plat complied with the Municipal Code.Town Engineer Van Horn reported to the Board of Trustees that his examination shows the plat complies with all Town requirements. The following people spoke in opposition to the subdivision:Mr.Henry D.McKim,Mr.John P.Mueller,Mr.Jerry Lefebvre,Mrs.Enid Lefebvre, and Mr.Jim Knox.Mr.Joel Bacon spoke in favor of the subdivision. The Town Administrator read correspondence received regarding the sub division plat. Meeting called to order by Mayor jja Present:Mayor Trustees: Also Present: Absent: BE IT RESOLVED BY THE BOARD OF TRUSTEES OF ThE TOWN OF ESTES PARK, COlORADO: That the final plat of DeVille Subdivision is approved and that the Mayor and Clerk are authorized and hereby directed to sign this plat. Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E. Burgess,H.Bernerd Dannels,N.T.Fetrocine,Glenn Prosser,Rollen Sutter,Robert E.Wagner.Those voting “No”none. Trustee Glenn Prosser moved that the Town conduct a public hearing on September 25,1972,regarding a proposal to prohibit one and two family dwellings within C-i,C-2 and I-i zones.Trustee Robert E.Burgess seconded the motion.Upon rolL call the motion unanimously carried. The Town Administrator submitted the results of the recent bid for paper products to the Board of Trustees.Trustee N.T.Petrocine moved that the Town Administrator be authorized to purchase any or all of the items on the paper products bid from those dealers that,in his judgment,sub mitted the most advantageous proposal.Trustee Robert E.Burgess seconded the motion.Upon roll call the motion unanimously carried. Trustee Glenn Prosser introduced and the Town Clerk read in full,the following entitled ordinance and Trustee Prosser moved it be passed on first and final reading: AN ORDINANCE AMENDING SECTION 17.15 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COlORADO,RELATING TO OBSCENE PUBLICATIONS. Trustee Rollen Sutter seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Trustees Robert E. Burgess,U.Bernerd flannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert B.Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered 34—72 and published according to law. Trustee Robert E.Wagner,Chairman of the Advertisng and Public Relations Conunittee,reported on a meeting as itemized in the minutes of August 18, 1972,and moved that the minutes be approved and adopted.Trustee H. Bernerd flannels seconded the motion.Upon roll call the motion unanimously carried. Trustee H.Bernerd7flannels,Chairman of the Public Works Committee,re ported on a meeting as itemized in the minutes of August 21,1972,and moved that minutes be approved and adopted.Trustee Glenn Prosser seconded tAe motion.Upon roil call the motion unanimously carried. Trustee Robert E.Burgess,Chairman of the Public Safety Committee, reported on a meeting as itemized in the minutes of August 24,1972, and moved that the minutes be approved and adopted.Trustee N.T.
