Minutes of the regular meeting held January 25,1971 were read and
approved as read.
Trustee Gerald H.Brownfield introduced and the Ton Clerk read in full,
the following entitled ordinance and Trustee Brownfield moved it be passed
on first reading:
AN ORDINANCE REGULATING BUILDING IN ThE TOWN OF
ESTES PARK,COlORADO.ADOPTING BY REFERENCE THE
UNIFORM BUILDING CODE,VOLUME I,1970 EDITION,
AND CORRECTIONS THERETO SECOND PRINTING.AMENDING
SECTION 11.1 OF THE MuNICIPAL CODE OF THE TOWN OF
ESTES PARK,COlORADO.
Trustee I’larvin L.Steele seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Gerald H.
Brownfield,Henry D.Dannels,N.T.Petrocine,Glenn Prosser,Marvin L.
Steele,Harry B.Tregent.Those voting “No”none.Whereupon Mayor Pro
Tem Harry B.Tregent declared said ordinance duly passed on first reading.
The 1970 Edition of the Uniform Building Code was read aloud by the
following:
Robert W.Daniels -Pages 1 through 100
Norma M.Green -Pages 101 through 200
Robert E.Porter -Pages 201 through 300
Estelle K.Sunderland -Pages 301 through 400
George L.Mowery -Pages 401 to the end.
Mayor Pro Tern Harry B.Tregent announced that a public hearing on the
adoption of the 1970 Edition of the Uniform Building Code will be held
by the Board of Trustees on March 8,1971.Following this hearing the
council will proceed with the second and final reading of the adopting
ordinance.
Trustee Henry D.Dannels moved the following bills be allowed and paid
and the Clerk be authorized to draw warrants for same.(A certified copy
of the bills read and allowed are on file in the office of the Town Clerk
under this date and made a part of the record of these proceedings by
reference thereto.)Trustee Glenn Prosser seconded the motion.Upon
roll call the motion passed by the following votes.Those voting “Yes”
Trustees Gerald H.Brownfield,Henry D.Dannels,N.T.Petrocine,Glenn
Prosser,Marvin L.Steele,Harry B.Tregent.Those voting “No”none.
Mr.Joe Jenkins appeared before the Board of Trustees on behalf of the
Estes Park Trail.Mr.Jenkins spoke at length regarding the legal
publications and specifically requested that the Town of Estes Park
comply with its contract with the Estes Park Trail.After considerable
discussion Trustee Gerald H.Brownfield moved that the Town of Estes
Park place its legal publications and notices in both the Mountain
Gazette and the Estes Park Trail until further notice.Trustee Henry
D.Dannels seconded the motion.Upon roll call the motion passed by

Trustee Henry 13.flannels introduced the following resolution and moved
it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
WHEREAS,by Ordinance No.24-70,the 23rd day of February,
1971,is fixed as the time for the election determining that before
this sales tax ordinance shall become effective it shall receive the
approval of a majority of the qualified electors of the Town of Estes
Park;
AND WHEREAS,it is the duty of the Board of Trustees to provide
for holding such election and appointing the Judges to conduct it;
NOW,THEREFORE,BE IT RESOLVED,that an election for t1
purpose of determining whether or not the Town of Estes Park shall iu
pose a 2°!.sales tax shall be held on Tuesday,February 23,1971;
BE IT FURTHER RESOLVED,that the polling place shall be in the
Town Hall in the Town of Estes Park,that the polls shall be open from
7:00 A.N.to 7:00 P.M.on said election day,that Mrs.Mabel Clark,
Mrs.Legora May,Miss Dorothy Stewart,and Mrs.Pat Eagan be,and they
are hereby appointed as Judges of said election,and Mrs.Frances Becker,
Mrs.Lora Keck,and Miss Ruth Byerly be,and they are hereby appointed
alternate Judges;and the Judges shall receive for their services the
sum of twenty dollars each;
BE IT FURTHER RESOLVED,that theTown Clerk be authorized to
give notice of the election by publication as provided by law;
BE IT FURTHER RESOLVED,that the Town Clerk shall at the expense
of the Town arrange for such materials and supplies for such election as
may be necessary.
Trustee Glenn Prosser seconded the motion.Upon roll call the motion

Trustee Gerald H.Brownfield introduced the following ordinance and moved
it be passed and adopted on first and final reading:
AN ORDINANCE AMENDING CHAPTER 12 OF THE MUNICIPAL
CODE OF THE TOWN OF ESTES PARK,COLORADO,RElATING
TO ZONING,HEIGHT LIMITATIONS,MINIMUM FLOOR SPACE,
MINIMUM lOT AREA,AND FlASHING SIGNS.

CODE OF TEE TOWN OF ESmS PARK,COLORADO,RElATING
TO SIDEWALKS AND SIGNS,SYMBOLS,OR OBflCTS THEREON.
Trustee Marvin L.Steele seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Gerald H.
Brownfield,Henry 0.flannels,N.T.Petrocine,Glenn Prosser,Marvin L.
Steele,Harry B.Tregent.Those voting “No”none.Whereupon Mayor Pro
Tern Harry B.Tregent declared said ordinance duly passed and adopted and
ordered it numbered 3-71 and published according to law.
Trustee Henry D.flannels,Chairman of the Water Committee,reported on
a Water Committee meeting as itemized in the minutes of February 1,1971,
and moved that the minutes be accepted.Trustee Glenn Prosser seconded
the motion.Upon roll call the motion unanimously carried.
Trustee Henry 0.flannels introduced the following resolution and moved
that it be passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
That the Mayor Pro Tem is authorized and is hereby directed
to sign the application for the renewal of the Temporary Use Perrnit for
191 acre feet of water with the Northern Colorado Water Conservancy
District.
Trustee Glenn Prosser seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees Gerald H.
Brownfield,Henry D.flannels,N.T.Petrocine,Glenn Prosser,Marvin
L.Steele,Harry B.Tregent.Those voting “No”none.
The Town Administrator presented an offer by Mr.Otis Miller of Greeley
to sell to the Town 150 units of Colorado-Big Thompson water at a price
of $275.00 per unit.Trustee Henry D.flannels moved the Town of Estes
Park proceed with the purchase of this water at the above mentioned
price.Trustee Glenn Prosser seconded the motion.Upon roll call the
motion unanimously carried.

Trustee Marvin L.Steele,Chairman of the Public Works Conunittee,re
ported on a Public Works Committee meeting as itemized in the minutes
of February 4,1971,and moved that the minutes be accepted,and that
the new street between South Saint Vram Avenue and Fish Creek be
named Sanborn Avenue.Trustee N.T.Petrocine seconded the motion.
Upon roll call the motion unanimously carried.
Trustee Glenn Prosser,Chairman of the Advertising and Public Relations
Committee,reported to the Board on the progress of his committee’s
program to publicize the sales tax issue.Trustee Prosser reported the
sales tax presentation has been presented to eight individual organiza
tions and there are now plans for five more.Trustee Prosser informed
the Board that radio KEEP will conduct a program regarding the sales tax
on February 15,1971,at 9:45 A.M.and Channel 3,CATV,will present a
sales tax program at 6:00 P.M.on February 22,1971.
Trustee Glenn Prosser explained to the Board of Trustees the concern of
Weld County and Larimer County regarding the Regional Transportation
District and more particularly,House Bill No.1055 which would remove
Weld County from the presently established Regional Transportation
District.Trustee Prosser moved the Town Administrator be authorized
to write Representative Showalter in support of House Bill No.1055.
Trustee Gerald H.Brownfield seconded the motion.Upon roll call the
motion unanimously carried.
Trustee Glenn Prosser and Mayor Pro Tem Tregent informed the Board of
Trustees about Mr.Frank McGraw,a member of the Iarimer County Planning
Commission,who will attend the Estes Park Planning Commission meetings
in order to further inform the Town of Estes Park as to both Iarimer
County and Iarimer-Weld Regional Planning Coimnission activities.Mr.
McGraw has made arrangements to furnish the Town with minutes of both
organizationswhich will be,in turn,forwarded to each individual
member of the Board of Trustees.
There being no further business,it was regularly moved,seconded and
carried that the meeting adjourn.
