AN ORDINANCE AMENDING TITLE 17 OF THE
MUNICIPAL (DDE OF THE TOWN OF ESTES
PARK,COlORADO,flTh SAME PERTAINING TO
ZONING FOR THE TOWN OF ESTES PARK
WHEREAS,the Federal Emergency Management Agency has prmulgated changes ft
the National Flood Insurance Program Flood Plain Management Criteria;and
WHEREAS,the Tbwn of Estes Park is subject to such changes.
BE IT ORDAINED BY THE TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO:
SECTION 1.That each and every place within Section 17 of the Municipal
Code of the Town of Estes Park,wherein the tern “Federal Flood Insurance
A&uinistrauon”appears shall be amended to read “Federal Emergency Management
Agency”.
SEUPICN 2.That each and every place within Section 17 of the Municipal
Code of the Thwn of Estes Park,wherein the tern “lowest floor,habitable”or
“lowest habitable floor”appears shall be amended to read “lowest floor”.
SECrICN 3.Section 17.08.030(62)of the Municipal Code of the Thwn of
Estes Park,Colorado,shall be amended to replace the present definition of
“lowest floor”with the following.
lowest Floor:The lowest floor of the lowest enclosed area (including
basement).An unfinished or flood—resistant enclosure,useable solely for
parking of vehicles,building access or storage in an area other than a basement
area,is not considered a building’s lowest floor,provided that such an
enclosure is not built so as ft render the structure in violation of the

apçlicabie non—elevation design requirements of this ordinance.Note:Each and
every place within this ordinance that the term “habitable floor”or “habitable
floor area”appears shall be replaced with the term “lowest floor”.
SECTION 4.That Section 17.08.030(64)of the Municipal Code of the Thwn of
Estes Park,Colorado,be amended to include the following at the end at the
definition therein stated for “nobile home”:
For purposes of Section 17.28.010 et seq.of this Municipal Code,the
definition therein contained for “nanufactired home”shall govern over any
definition contained in this section.
SECTION 5.That Section 17.08.030 (66)of the Municipal Code of the Tbwn of
Estes Park,Colorado,be amended to include the foilowing at the end of the
definition therein stated for “mDbile home park”:
For purposes of Section 17.28.010 et seq.of this Municipal Code,the
definition therein contained for “nanufactured henie park or subdivision”shall
govern over any definition contaird in this section.

SECIION 6.That each and every place within Chapter 17.28,et ,of the
Municipal Code of the Thwn of Estes Park,wherein the term “mobile homa”,
“mobile hone lot”,“mobile bane park”or “mobile hone stand”appears shall be
arended to read “manufactured hone”,“manufactured hone lot”,“manufactured hone
park or manufactured hone subdivision”,“manufactured hone stand”,respectively.
sEcrIa 7.Section 17.08.030 of the Municipal Code of the Thwn of Estes
Park,Colorado,shall be airended to include the following:
Start of Construction.(for other than new construction or substantial
improvanents under the Coastal Barrier Resources Act Pub.L.97—348),includes
substantial improvement,and means the date the building permit was issued,
provided the actual start of construction,repair,reconstruction,placement,or
other inprovenent was within 180 days of the permit date.The actual start
means either the first placement of permanent constriction of a structure on a
site,such as the pouring of slab or footings,the installation of piles,the
constriction of columns,or any work beyond the stage of excavation;or the
placenent of a manufactured hone on a foundation.Permanent construction does
rot include land preparation,such as clearing,grading and filling;nor does it
include the installation of streets and/or walkways;nor does it include
excavation for a basenent,footings,piers,or foundations or the erection of
tenporaxy forms;nor does it include the installation on the property of
accessory buildings,such as garages or sheds not occupied as dwelling units or
not part of the main structure.
sEaiW 8.That section 17.28.015 shall be made an addition to the
Municipal Code of the Thwn of Estes Park,Colorado and shall read as follows:
17.28.015 Definitions.For purposes of this Chapter 17.28 only,certain
terms and words are defined as set forth herein:
1.Manufactured Hone:A structure,transportable in one or more
sections,which is built on a permanent chassis and is designed for use with or
without a permanent foundation when connected to the required utilities.For
flood plain managanent purposes,the term “manufactured hone”also includes
parked trailers,travel trailers,and other similar vehicles placed on a site
for greater than 180 consecutive days.For insurance purposes,the tern
“manufactured hone”does not include parked trailers,travel trailers,and other
similar vehicles.
2.Manufactured Hanepark or Subdivision:A parcel or contignous
parcels of land divided in two or more manutactured hone lots for rent or sale.
SECflW 9.That section 17.28.040 of the Municipal Code of the ¶tbwn of
Estes Park,Colorado shall be amended to include the following:

F.No new manufactured homes or manufactured home parks or
manufactured hone subdivisions shall be permitted.Replacement of existing
manufactured homes or manufactured home parks or subdivisions shall be in accord
with Section 17.28.110(D).
J.No use is permitted which results in any increase in the base flood
elevation.
K.No use shall be permitted unless all electrical,heating,
ventilation,plimibing and air conditioning equipimt and other service
facilities are desigmd and/or located so as to prevent water from entering or
accumulating within the caiponents during conditions of flooding.
SECPICU 10.That Section 17.28.060 of the Municipal Code of the Town of
Estes Park,Colorado shall be to include the foilowing;
I.No use shall be permitted unless all electrical,heating,
ventilation,plumbing and aft conditioning equiprient and other service
facilities shall be designed and/or located so as to prevent water from entering
or accumulating within the conponents during conditions of flooding.
saic 11.That Section 17.28.060(G)of the Municipal Code of the Thwn of
Estes Park,Colorado shall be deleted.
SEx’rIw 12..That Section 17.28.070 (B)of the Municipal Code of the Thwn
of Estes Park,Colorado shall be amended as follows:
B.Location and dimensions of all proposed structures and elevations
of the lowest floor (including basement)of new and substantially inproved
structures shall be included.
SEOPIW 13.Section 17.28.070 (1))of the Municipal Code of the Town of
Estes Park,Colorado shall be amended to read as follows:
D.A description and specifications of all floodproofing measures;
where a non—residential structure is intended to be made water tight below the
base flood level,(1)a registered professional engineer or architect shall
develop and/or review structural design,specifications and plans tor the
constriction,and shall certify that the design and methods of construction are
in accordance with accepted standards of practice for meeting the applicable
provisions of Sections 17.28.130 and 17.28.150 of this Code.
SFUPICtI 14.That Section 17.28.080 of the Municipal Code of the Thwn of
Estes Park,Colorado shall be amended by the inclusion of the following:
G.The review and reasonable utilization of any base flood elevation
and floodway data available from a federal,state or other source,as criteria
for requiring that new construction,substantial improvenents or other

developuent in zoning meet the requirements of 17.28.060 and 17.28.110 for
residential structures and 17.28.040 and 17.28.100 for nonresidential
structures.
SECTIW 15.That Section 17.28.100 (B)of the Municipal Code of the Ttwn of
Estes Park,Colorado shall be amended by the inclusion of the following:
5.All utility services,including electrical,heating,ventilation,
plumbing and aft conditioning equiprent and other service facilities shall be
designed and/or located so as to prevent water from entering or accumulating
within the conponents during conditions of flooding.
sruria 16.That Section 17.28.100 (B)(1)of the Municipal Code of the Thwn
of Estes Park,Colorado shall be amended to read as follows:
Structures shall not be designed for human residential occupancy.
There a non-residential structure is intended to be made water tight below the
base flood level,(1)a registered professional engineer or architect shall
develop and/or review structural design,specifications and plans tor the
construction,and shall certify that the design and methods of construction are
in accordance with accepted standards of practice for meeting the applicable
provisions of Sections 17.28.130 and 17.28.150 of this Code.
SECTION 17.That Section 17.28.100(D)of the Municipal Code of the Thwn of
Estes Park,Colorado shall be deleted.
SECHW 18.That Section 17.28.110 (C)of the Municipal Code of the Thwn of
Estes Park,Colorado shall be amended to read as follows:

within the conponents during conditions of flooding.
SECTICE 19.That Section 17.28.110 (D)of the Municipal Code of the Thwn of
Estes Park,Colorado shall be amended to read as follows:
1.All manufactured homes to be placed or substantially inproved shall
be elevated on a permanent foundation such that the lowest floor at the
nmiufactured hane is at or above the base flood elevation and be securely
anchored to an adequately anchored foundation system in accordance with the

anchoring provisions of this ordinance.
2.All manufactured homes situated within such parks or subdivisions,
and manufactured homes placed in existing manufactured home parks and and
existing manufactured hane subdivisions shall be anchored to resist flotation,
collapse and lateral novanent by providing over-the-top ties and frame ties to

ground anchors.AU conponents of the anchoring system shall be capable of
carrying a force of 4,800 pounds per square inch.AU additions to any
manufactured hcne shall also be anchored.This requirement is in addition to
applicable state and local anchoring requirements for resisting wind forces.
The following is the minimum anchoring system required:
a.There shall be provided over-the-top ties at each of the four
corners of the manufactured hane,with two additional ties on each long side at
intermediate locations,except that manufactured homes less than 50 feet long
shall be provided with one such additional tie.
b.There shall be provided frame ties at each of the four corners
of the manufactured hone,with five additional ties per long side at
inteimediate points,except that manufactured buries less than 50 feet long shall
have four additional ties per long side.
3.The Federal Energency Management Ageiry Manual (FU1A #85)
“Manufactared Home Installation for Flood Hazard Areas”should also be consulted
for guidance on suggested elevated and anchoring techniques.
SEOP1ON 20.That Section 17.28.120 of the Municipal Code of the Thwn of
Estes Park,Colorado shall be deleted.
scria 21.That Section 17.28.130 of the Municipal Code of the Town of
Estes Park,Colorado shall be amended to include the following:
L.Where a non—residential structure is intended to be made water
tight below the base flood level,(1)a registered professional engineer or
architect shall develop and/or review structural design,specifications and
plans for the construction,and shall certify that the design and methods of
construction are in accordance with accepted standards of practice for meeting
the applicable provisions of this Section and Section 17.28.150.
SEUPICR 22.That Section 17.28.150 of the Municipal Code of the Town of
Estes Park,Colorado shall be amended to read as follows:
Adninistration.This chapter shall be administered by the building
inspector.It shaU be the duty of the building inspector to obtain and
maintain records of lowest floor elevations and fboodproofing levels for all new
or substantially inproved structures,and whether or not such structures contain
basements.Such records shall be placed on repository for public inspection
during normal business hours at 170 MacGregor Avenue,Estes Park,Colorado.It
shall also be the duty of the building inspector to notify adjacent connunities
and the appropriate state offices prior to the alteration or relocation of a

river or water course.Copies of all such notifications shall he sulrdtted to
the Federal Eiergency nagenn Agency.Thn building inspector shall use all
available f1o1plaLn information and data services to aid in the administration
of this chapter.
sEcrIc?J 23.The official Flood Plain Maps of the Thwn of Estes Park are
hereby amended by adopting the revisions shown on the Flood Insurance Rate Map
(FIPN)Work Maps dated April,1985,prepared by Sinons,Li and Associates.
SEaION 24.That Section 17.08.030(38)shall be amended to read as
follows:
“Flood Insurance Study”means the official report provided by the
Federal Errrgency Management Agency that includes flood profiles,the flood
boundary—floodway map,and the water surface evaluation of the base flood and
any subsequent revisions and/or awencbicnts thereto.
SECTION 25.The Board of Trustees of the Town of Estes Park,Colorado,
herewith finds,determines and designates that this Ordinance is necessary for
the immediate preservation of the public peace,health and safety,in order to
comply with the requirements of the Federal Emergency Management Agency by May
4,1981.This Ordinance shall take effect and be force 30 days from final
passage,adoption and signature of the Mayor.
