HomeMy WebLinkAboutORDINANCE 22-96csORDINANCENO.22-96ANORDINANCEVACATINGAPUBLICRIGHTOFWAYKNOWNASSUNRISELANEWHEREAS,ParkEntranceEstatesSubdivisionrecentlyformedaSpecialImprovementDistrictforthepurposeofroadwayandwaterlineimprovements;andWHEREAS,duringtheprocessofdesignandconstructionoftheimprovements,itwasdeterminedthatSunriseLanewouldnotbeimprovedduetoitslocation;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisinthebestinterestsoftheTowntopermanentlyabandonandvacateSunriseLane,reservingpublicutilityeasementsandprivateaccesseasementstopropertyadjacenttoSunriseLane.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:TheBoardofTrusteesoftheTownofEstesPark,ColoradoherebyvacatesSunriseLanefromitsintersectionwithMeadowCircletoitsnorthernterminus.PursuanttoSection43-2-302(1)(d),titletothevacatedportionofSunriseLaneshallbeasfollows:DescriptionofthatportionofsaidSunriseLanetobevacatedtoLot26,ParkEntranceEstates:ThatportionofSunriseLanelyingnorthofthesouthlineofLot26extendedeasterlytotheeastboundaryofParkEntranceEstates.DescriptionofthatportionofsaidSunriseLanetobevacatedtoLot16,ParkEntranceEstates:TheeasterlyonehalfofSunriseLanebeginningattheintersectionofSunriseLaneandMeadowCircleandextendingnortherlytoapointoppositeofthenorthcornerofLot16perpendiculartotheeastboundaryofParkEntranceEstates.DescriptionofthatportionofsaidSunriselanetobevacatedtoLot21,ParkEntranceEstates:AllofSunriseLanelyingsouthofthenorthboundaryofLot21toapointoppositethenorthcornerofLot16perpendiculartotheeastboundaryofParkEntranceEstates;togetherwiththewesterlyonehalfofSunriseLanebeginningattheintersectionofMeadowCircleandextendingnortherlytoapoint 00 q)oppositethenorthcornerofLot16perpendiculartotheeastboundaryofParkEntranceEstates.Section2:TheTownherebyreservesoverthevacatedportionofSunriseLaneapermanentutilityanddrainageeasement.Section3:TheTownfurtherreservesoverthevacatedportionofSunriseLanefromthesouthernboundaryofLot26ofParkEntranceEstatestotheintersectionofMeadowCircleaprivateaccesseasementforthebenefitofLots21,26,and16,ParkEntranceEstatesSubdivision.Section4:TheTownherebysurrendersanyandallright,titleandinteresttoSunriseLanesubjecttothereservationsetforthinSections2and3.Section5:ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDYTHEBOARDFTRUSTESOFTHETOWNOFESTESPARK,COLORADO,THIS/O—DAYOF_______________,1996.TOWNOFESTESPARKBy:_________MayorProTemATTEST:TownClerkIherebycertifythattheaboveordinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe/o‘dayof_____________1996,andpublishedinanewspaperofgeneralonintheTownofEstesPark,Colorado,onthe/3gdayofCüeaJTownClerk (2’C
