C0ORDINANCE17—96ANORDINANCEAMENDINGSECTION7.08.070OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARKCONCERNINGKEEPINGOFHORSESWHEREAS,theBoardofTrusteesoftheTownofEstesPark,Colorado,hasdeterminedthatitisinthebestinterestoftheTowntoamendSection7.08.070oftheMunicipalCodeoftheTownofEstesPark.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Section7.08.070shallbeamendedtoreadasfollows:Section7.08.070Cattleandhorses--Conditionsrequiredforjermit.TheTownBuildingInspectorshallauthorizeissuanceofapermittokeepandmaintainhorsesoncertaindescribedpremiseswithintheTownuponhisdeterminationthatthefollowingconditionsorrequirementsarecompliedwith:1.PermitsmaybeissuedtoresidentownersorresidentlesseesofrealpropertylocatedwithintheR-SortheR-Mresidentialdistrictsfortheirpersonalhorses.Amaximumoftwohorsesmaybekeptormaintainedonthefirstacreoflanddescribedineachpermitandanadditionalhorsemaybekeptormaintainedforeachadditionalacreoflanddescribedineachpermit.Anyrealpropertyincludedinapermitissuedhereundershallnotbeincludedinanotherpermit.2.PermitsmaybeissuedtoresidentownersorresidentlesseesofrealpropertylocatedwithintheEEstateresidentialdistrictfortheirpersonalhorsesprovidedtheminimumlotsizeisfiveacresormoreandthenumberofhorsesshallnotexceedfour.Anyrealpropertyincludedinapermitissuedhereundershallnotbeincludedinanyotherpermit.3.PermitsmaybeissuedtoownersandlesseesofpropertylocatedwithinC-IDorC-Cdistricts,providedtheminimumlotsizeis15acresormoreandthenumberofhorsesshallnotexceedfour.4.Anyshed,shelter,orcorralinwhichhorsesarekeptormaintainedshallnotbecloserthantwenty-fivefeettoanybuildingoccupiedasaresidenceorusedforhumanhabitationoruseandfiftyfeetfromanystreetorpropertyline.AllpropertywherehorsesaretobekeptormaintainedshallbefencedbyalawfulfenceasdefinedbythestatutesoftheStateofColorado,whichfenceshallbeconstructedatleastfiftyfeetfromtheoutsideboundarylineofthepropertydescribedintheapplicationforapermithereunder. 00 005.Theconstructionoffeedingfacilities,andtheconstruction,drainage,flooring,ventilation,wasteremovalandflyscreeningofallsheds,orothersheltersshallbegovernedbyanyregulationsadoptedbytheTownBoardofTrustees.Section2.TheadoptionofthisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS/p’DAYOF_________1996.TOWNOFESTESPARKBY:ATTEST:ciTownClerkIherebycertifythattheaboveOrdinancewasintroducedandrpadatameetingoftheBoardofTrusteesonthedayof______1996,andpublishedinanewspaperofgeneralcircjilationiiitheTownofEstesPark,Coloradoonthe‘dayof1996.TownClerk 00
