0CORDINANCENO.15-96ANORDINANCEAMENDINGCHAPTER10.16.010(D)THESAMERELATINGTOUSEOFTEMPORARYSHELTERSFORCOMMERCIALANDRESIDENTIALPURPOSESOFTHETOWNOFESTESPARKWHEREAS,theBoardofTrusteesoftheTownofEstesPark,ColoradohasdeterminedthatitisinthebestinterestoftheTowntoamendChapter10.16.010(D).NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:10.16.0109(D).NoTent,TemporaryShelter,CanopyorTepee,includingalloranypartofthesupportingframework,shallbeusedforlivingorsleepingpurposesorasastore,officeorplaceforcarryingonabusiness,tradeorprofessionwithintheTownexceptasfollows:1.Asanaccessoryusetoaresidentialdwellingsolongastheuseistemporaryanddoesnotexceedaperiodofseven(7)consecutivedays.2.Asanaccessoryusetoacommercialusesolongasitisnotusedforlivingorsleepingpurposes,theuseistemporary,andthetemporaryusedoesnotexceedthirty(30)daysinanycalendaryear.3.TheusedoesnotoccurwithintheC-DDowntownCommercialDistrict.4.Asanaccessoryusetoanymunicipallysponsoredorapprovedevent.5.Asanaccessoryuseonanymunicipallyownedoroccupiedproperty.Section2.TheadoptionofthisOrdinanceisherebydeclaredanemergencyinordertoimmediatelyamendChapter10.16.010(D),andWHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexists,thisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDAOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHISc/DAYOF199fl.2“TOW%FESTESPARK7ATTEST:TownClerkIherebycertifythattheaboveOrdi,nancewasintroducedandreadatameetingoftheBoardofTrusteesonthe9dayof>uL41996andpublishedinanewspaperofgeneralcirculationintheTown,9ofSstesPark,Coloradoonthe/2dayof4cLcj1996.vc:;:LC)TownClerk 00
