Home My WebLink AboutORDINANCE 11-96C0ORDINANCENO__11-96ANORDINANCEADOPTINGCHAPTER8.12OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARKCONCERNINGTHEREGULATIONOFTHEOBTAINING,USEANDPOSSESSIONOFTOBACCOPRODUCTSBYMINORSWHEREAS,theuseoftobaccoproductsisdangeroustohumanhealth;andWHEREAS,Coloradolawcurrentlyprohibitsthesaleoftobaccoproductstominors;andWHEREAS,Section25-14-105,C.R.S.,specificallyauthorizeslocalregulationofsmokingandauthorizeslocalentitiestoadoptordinancesregardingsmoking;andWHEREAS,Section18-13-121(3),C.R.S.,authorizeslocalauthoritiestoimposerequirementsregardingthepurchaseoftobaccoproductsbyminors;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatthisordinancepertainstoandisinthefurtheranceofthehealth,welfareandsafetyofthecitizensoftheTownofEstesPark,particularlythoseresidentsundertheageof18.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Title8oftheMunicipalCodeoftheTownofEstesParkisamendedbyaddingtheretoanewChapter8.12toreadasfollows:Chapter8.12:POSSESSIONANDUSEOFTOBACCOPRODUCTSBYMINORS.8.12.010Intent:ItistheintentofthisChaptertoprotectthepublichealth,safetyandwelfarebyprohibitingthepossessionanduseoftobaccoproductsbyminorsandbyprohibitingthedisseminationandfurnishingoftobaccoproductstominors.8.12.020Definitions:AsusedinthisChapter,thefollowingwordsorphrasesaredefinedasfollows:A.“Minor”meansanypersonundertheageof18.B.“Smoking”meanstheholdingorcarryingofalightedpipe,lightedcigar,orlightedcigaretteofanykindandincludesthelightingofapipe,cigar,orcigaretteofanykind. 00 aCC.“TobaccoProduct”meansanysubstancecontainingtobaccoleaf,including,butnotlimitedto,cigarettes,cigars,pipetobacco,snuff,chewingtobaccoordippingtobacco.8.12.030UnlawfulPossessionorUseofTobaccoProductsbyMinors:A.Itshallbeunlawfulforanyminortopossessanytobaccoproduct.B.Itshallbeunlawfulforanyminortoconsumeoruse,eitherbysmoking,ingesting,absorbing,orchewing,anytobaccoproduct.C.Itshallbeunlawfulforanyminortopurchase,obtainorattempttopurchaseorobtainanytobaccoproductbymisrepresentationofageorbyanyothermethod.0.Itshallberebuttablypresumedthatthesubstancewithinapackageorcontainerisatobaccoproductifthepackageorcontainerhasaffixedtoitalabelwhichidentitiesthepackageorcontainerascontainingatobaccoproduct.8.12.040UnlawfulFurnishingofTobaccoProductstoMinors:A.Itshallbeunlawfulforanypersontoknowinglyfurnishtoanyminor,bygift,sale,oranyothermeans,anytobaccoproduct.B.Itshallbeanaffirmativedefensetoaprosecutionunderthissectionthatthepersonfurnishingthetobaccoproductwaspresentedwithandreasonablyrelieduponadocumentwhichidentifiedtheminorreceivingthetobaccoproductasbeingeighteenyearsofageorolder.8.12.050VendingMachines:A.Itshallbeunlawfulforanypersontoselloroffertosellcigarettesortobaccoproductsbyuseofavendingmachineorothercoin-operatedmachine;exceptthatcigarettesmaybesoldatretailthroughvendingmachinesonlyin:(I)Factories,businesses,officesorotherplacesnotopentothegeneralpublic;(II)Placestowhichminorsarenotpermittedaccess;or(III)(A)Placeswherethevendingmachineisunderthedirectorsupervisionoftheowneroftheestablishmentoranadultemployeeoftheowner,includingbutnotlimitedto,establishmentsholdingavalidliquorlicenseissuedpursuanttoArticle47ofTitle12,C.R.S. 00 00(B).Asusedinthissection,“underdirectsupervision”meansthevendingmachineshallbeinplainvisionoftheemployeeorownerduringregularbusinesshours.ItshallbeanaffirmativedefensetoaprosecutionunderParagraph(A)thatthepersonsellingorofferingtosellthetobaccoproductwaspresentedwithandreasonablyrelieduponadocumentwhichidentifiedthepersonpurchasingthetobaccoproductasbeingeighteenyearsofageorolder.Section8.12.060SaleofTobaccoProducts:A.Itshallbeunlawfulforanybusinessproprietor,manager,orotherpersoninchargeorcontrolofabusinessofanykindtoengage,employorpermitanyminortoselltobaccoproductsfromsuchbusiness.B.Itshallbeunlawfulforanybusinessproprietor,manager,orotherpersoninchargeorcontrolofabusinessofanykindtostockordisplayatobaccoproductinanywaywhichallowsacustomertoaccesssuchtobaccoproductwithoutfirstsecuringthephysicalassistanceofanadultbusinessemployeeforeachtransaction.TheforegoingsentenceshallnotbeeffectiveuntilDecember31,1996.TheprovisionsofthisSubsectionBshallnotapplytostorespossessingavalidretailliquorstorelicense,asdefinedbytheColoradoLiquorCode,andtovendingmachinesmeetingtherequirementsofSection8.12.050ofthiscode.Section2.TheadoptionofthisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDMIDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS//DAYOF,1996.TOWNOFESTESPARKBY:ATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedand-çeadatameetingoftheBoardofTrusteesonthedayof______1996,andpublishedinanewspaperofgeneralciçulation)intheTownofEstesPark,Coloradoonthe/jdayofL4n,g1996.9qjTownClerk 00‘,.\a——-.
