CcccORDINANCENO.2-88ANORDINANCEAMENDINCTIThE17OFTHEMUNICIPALCODEOFTHE‘INOFESflSPARK,COLORADO,THESAMEPEAnJING‘10VESTEDP1JPERflRIQITS.BEITORDAINEDBYTHEBCIRDOFTRUSTEESOFTHETCTh7NOFESTFSPARK,COLORADO:SECPIW1.ThatTitle17oftheMunicipalCodeoftheThwnofEstesPark,ColoradoisanEndedbyaddinganewchapter17.40,asfollows:17.40VestedPropertyRights.17.40.010Purpose.ThepurposeofthischapteristoprovidetheproceduresnecessarytoinplementtheprovisionsofArticle68ofTitle24,C.R.S.,asamended,whichArticleestablishesavestedpropertyrighttoundertakeandcaiçletedevelopintanduseofrealpropertyunderthetermsandconditionsofasitespecificdevelopmentplait17.40.020NoticeandHearing.Nositespecificdevelopmentplanshallbeapproveduntilafterapublichearing,precededbywrittennoticeofsuchhearing.SuchnoticeshallbepublihedatthetineandinthemannerrequiredbySection31—23—304C.R.S.,asamended,forzoningregulations,andmaybeccmbinedwithsuchnoticeorwithanyotherrequirednotice.17.40.030Approved—EffectiveDate.A.AsitespecificdevelopntplanshallbedeemedapprovedupontheeffectivedateoftheBoardofTrusteesorPlanningCatndssionapprovalactionrelatingtheretoasfollows:1.Developtentplan—PlanningCatnxdssion. CCcC2.Conceptplan-BoardofTrustees.3.Specialreview-BoardofTrustees.4.Finalsubdivisionplat-BoardofTrustees.IntheeventtherehasbeenanapprovalofaconceptplanbytheBoardofTrustees,butadevelorzntplanisrequiredbytheMunicipalCode,approvalofsaiddevelopnentplanbythePlanningCatinissionshailbedeemedfinalapproval.ApprovalbytheBoardofTrusteesofaconceptplanshallonlybedesdfinalapprovalifnodevelopmentplanisrequiredtobeapprovedrelatingtothesameproperty.B.Intheeventamendmentstoasitespecificdevelopmentplanareapproved,theeffectivedateofsuchanendnents,forpurposesofthedurationofavestedpropertyright,shallbethedateoftheapprovaloftheoriginalsitespecificdevelopnentplan,unlesstheBoardofTrusteesorthePlanningCatznissionspecificallyfindsotherwiseandincorporatessuchfindinginitsapprovaloftheanendient.17.40.040NoticeofApproval.Eachmap,plat,conceptplan,ordevelopientplanconstitutingasitespecificdevelopnentplanshallcontainthefollowinglanguage:“ApprovalofthisplancreatesavestedpropertyrightpursuanttoArticle68ofTitle24,C.R..S.,asamended.”Inaddition,anoticedescribinggenerallythetypeandintensityoftheuseapproved,thespecificparcelorparcelsofproperty—2— 00affected,andastatementthatavestedpropertyrighthasbeencreatedshallbepthlishedonce,notmorethanfourteendaysafterfinalapprovalofthesitespecificdevelopmentplan,inanewspaperofgeneralcirculationwithintheabwnofEstesPark.17.40.050OtherProvisionsUnaffated.Approvalofasitespecificdeveloprntplanshallnotconstituteanexemptionfranorwaiverofanyotherprovisionsofthiscodepertainingtothedevelopntand/oruseoftheproperty.17.40.060Imitations.NothinginthisChapterisintendedtocreateanyvestedpropertyright,butonlytoimplementtheprovisionsofArticle68ofTitle24,C.R.S.,asamended.IntheeventoftherepealofsaidArticleorajudicialdeterminationthatsaidArticleisinvalidortmconstitutional,thisChaptershallbedeemedtoberepealed,andtheprovisionherfnolonreffective.17.40.070UrbanRenewalAutitrityReview.ReviewbytheUrbanRenewalAuthorityundertheprovisionsofSection17.36.020ofthisCodeshallnotconstitutesitespecificdevelopnentplanrevieworapproval.SECTION2.ThatSection17.08.030oftheNunicipalCodeoftheTownofEstesPark,Coloradoshallbeanendedbytheadditionofthefoilowingsub-paragraphs:17.08.030(97)“SiteSpecificDevelopmentPlan”meansaplandescribingwithreasonablecertaintythetypeandintensityofuseproFosedforaspecificparcelorparcelsofpropertyincluding,butnotlimitedto,aspecialreviewplat,conceptplan,developnentplanand/orafinal—3— CccCsubdivisionplat.Forausepermittedbyrightinanyzoningdistrict,theannexationmaporfinalsubdivisionplatdepictingthefinalbiilthnglotsizeshallconstitutethesitespecificdevelopmentplan.Forusespermittedbydevelorntplanreview,thedeveloprentplanshallconstitutethesitespecificdevelopmentplan.Forusespermittedbyspecialreview,theconceptand/ordeveloprentplanshallconstitutethesitespecificdevelopmentplan.17.08.030(98)“VestedPropertyRight”meanstherighttoundertakeandcatpletethedevelopEentanduseofpropertyunderthetermsandconditionsofthesitespecificdeveloptentplan.scriw3.ThatSection17.36.010(H)(9)oftheMunicipalCodeoftheTownofEstesPark,Coloradoshallbeamendedtoreadasfollows:Ifthedevelopmentassetforthinthedevelopmentplanhasnotbeencarpletedwithinthreeyearsoffinalapprovalorwithinthetinespecifiedonthedeveloptentplan,planapprovalshallbeautcnaticallywithdrawnandnofurtherconstructiononand/oruseofthepropertyassetforthinthedeveloptentplanshailbeallowed.SFZYrICt14.ThatSection17.36.040(B)(4)oftheMunicipalCodeoftheTownofEstesPark,Coloradoshallbeamendedtoreadasfollows:4.Ifinvolvingmorethanfiftythousandsquarefeetgrossfloorarea,asimplestudymodelofthebuildingsandsite.SECPIW5.ThatSection17.36.040(B)(5)oftheMunicipalCodeoftheTownofEstesPark,Coloradoshallbeamendedbyaddingthefollowing:5.Ifthedevelopmentassetforthintheconceptplanhasnotbeencatpletedwithinthreeyearsoffinalapprovalorwithinthetimespecifiedontheconceptplan,planapprovalshallbeautcmaticallywithdrawnandnofurtherconstructiononand/oruseoftheproperty—4— Ccccassetforthintheconceptplanshallallowed.SEUTICN6.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandsubsequentpublication.atOFESTESPARKAPEST:Ma9orcTownClerkIherthycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofThusteesonthedayof______________,19er,andpiblishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthea?9adayof_____________,194,faeTownClerk—5—
