C&ORDINAJCNO.7-89ANORDINANCEAI4ENDINCCHAPTER14OFTHEMUNICIPALCODEOFTHETCWNOFESTESPARK,COWWDO,THESAMEPERPAINING70BUIlDINGSANDCWSTRUCI’IONINCLUDINGTHEADJPflONOF‘filEUNIFORMBUILDINGCODE,1988IflONWHEREAS,onthe/54&dayof______________,1989,theBoardof(2TrusteesoftheThwnofEstesParkheldapublicHearingontheadoptionofthe1988editionoftheUniformBuildingCode;andWHEREAS,noticeofsaidHearingwaspublishedasprovidedinSection31—16—203,C.R.S.1973;andWHEREAS,priorfttheadoptionoftheUniformBuildingCode,1988edition,byreference,copiesofsaidCodeandallsecondarycodesIserepresentedfttheBoardofThusteesoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHE7OVQNOFFSTFSPARK,COlORADO:Section1.ThatChapter14.12oftheMunicipalCodeoftheTownofEstesPark,Colorado,shallbeanadedtoreadasfollows:14.12.010UniformBuildingCode,1988——Adopted.TheUniformBuildingCode,1988edition,theUniformBuildingCodeAppendix,1988edition,andtheUniformBuildingCodeStandards,1988edition,issdbytheInternationalConferenceofBuildingOfficials,5360SouthWorknanMillRoad,Whittier,California90601,exceptthesectionsorpartsofsectionsthereofwhichareamendedbythischapter,referredtointhistitleasthe“UniformBuildingCode”,isenacted,adoptedbythisreference,andincorporatedinthischapterasifsetaitatlength.14.12.020ExceptionstoAppendix.TheUniformBuildingCodeAppendix,1988edition,isamendedbythedeletionofchapters1,12andDivisions1,51,and53.14.12.030section304(a)and(b)anexñed———Buiidingpermitfees.Thefirstparagraphofsubsection(a)ofsection304andsubsection(b)ofsection304oftheUniformBuildingCodeareamendedtoreadasfollows: 0ClSection304(a)-BuildingPermitFees.ThefeeforeachpermitshallbeassetforthinTableNo.3-aexceptforM-1,R-1andR-3occupancieswhichshallbetencents(1OC)pergrosssquarefootfortherkdescribedincludingbasementslocatedtherein.Section304(b).PlanReviewFees.WhenaplanorotherdataisrequiredtobesubmittedbySthction(b)ofSection302,aplanreviewfeeshallbepaidatthetineofsubnittingplansandspecificationsforreview.Saidplanreviewfeeshallbefivecents(5c)pergrosssquarefoot.AllotherbuildingpermitfeesandfeesforinspectionshallbeassetforthinTable3-a.14.12.040Section307(a)attended——UseorOccupancy.Section307(a)oftheUniformBuildingCcdeisamendedtoreadasfollows:NobuildingorstruvftreofgroupA,E,I,H,BorRoccupancy,shallbeusedoroccupied,andnochangeintheexistingoocupancyclassificationofabuildingorstrirtereorportionthereofshallbemadeuntilthebuildingofficialhasissuedaCertificateofOctupancythereforeasprovidedherein.”14.12.050GradingPermits.Section7003ofChapter70oftheUniformBuildingCodeAppendix,1988edition,shallbeanendedtoreadasfollows:AgradingpermitshallonlyberequiredforprojectsrequiringdevelognentorconceptplanapprovalundertheprovisionsofSection17.36.040oftheMunicipalCodewherefinalapprovalofsaidplanhasbeenreceivedbutabuildingpermithasnotbeenissuedandthealicantdesirestogradeorexcavateaprojectpriortotheissuanceofabuildingpermit.14.12.060Violation.A.ItisunlawfulforanypersontoviolateanyoftheprovisionsstatedoradoptedintheUniformBuildingCode.B.EverypersonconvictedofaviolationofanyprovisionstatedoradoptedintheUniformBuildingCodeshallbepunishedassetforthinSection1.20.020ofthisccxe.14.12.070Dartages.NeithertheTown’sBuildingInspector,ThwnEngineernoranyotherenployeeofthe7bwnofEstesParknoranypersonappointedorhiredbytheTownofFstesParkst-nilbeliableindamagesforanyactand/oromissionbysaidpersonpursuanttothedutiesandenforcementoftheprovisionsoftheUniformBuildingCcde.—2— 0Section2.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandsubsequentpublication.PASSEDANDADOPTEDBYTHEBOARDOFThUSEFSOF20WNOFESTESPARK,COLORADO,THIS____1kYOF__________,1989.TOWNOFESTFSPARKBy:_______________________________MayorATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofThusteesonthe/3dayof)Cc’)zjL,1989,andpublishedina(-InewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthe4-dayof________,1989.TownClerkep3/ordinance2—3—
