HomeMy WebLinkAboutORDINANCE 09-91C, ORDINANCE NO:9-91 AN ORDINANCE ADOPTING STANDARDS FOR THE ISSUANCE OF OPTIONAL PREMISES LICENSES AND FOR OPTIONAL PREMISES FOR A HOTEL AND RESTAURANT LICENSE PURSUANT TO THE PROVISIONS OF SECTION 12—47—135.5 C.R.S. WHEREAS,Section 12—47-135.5 C.R.S.permits a municipalitytoadoptstandardsfortheissuanceofoptionalpremiseslicenses or for optional premises for a hotel or restaurant license for outdoor sports or recreational facilities as defined in Section 12—47—103 (13.5)C.R.S.;and WHEREAS,the Town of Estes Park wishes to adopt such standards. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO. Section 1.The Municipal Code of the Town of Estes Park is hereby amended by the addition of a new Chapter 5.30 as follows: 5.30 OPTIONAL PREMISES LIQUOR LICENSES 5.30.010 Standards.The following standards for the issuance of optional premises licenses or for optional premises for a hotel and restaurant license are hereby adopted pursuant to the provisions of Section 12—47—135.5 C.R.S.These standards adopted herein shall be considered in addition to all other standards applicable to the issuance of licenses under the Colorado Liquor Code for an optional premises license or for an optional premises for a hotel and restaurant license.These two types of licenses for optional premises will collectively be referred to as “optional premises”in these standards unless otherwise provided. 5.30.020 Eligible Facilities.An optional premises may only be approved when that premises is located on or adjacent to an outdoor sports and recreational facility as defined in Section 12—47—103 (13.5)(c)C.R.S.The types of outdoor sports and recreational facilities which may be considered for an optional premises license are limited to the following: 1.Golf Courses. 2.Swimming Pools. .0 0 There are no restrictions on the minimum size of the outdoor sports and recreational facilities which may be eligible for the approval of an optional premises license.However,the Board of Trustees may consider the size of the particular outdoor sports or recreational facility in relationship to the number ofoptionalpremisesrequestedforthefacility. 5.30.030 Number of Optional Premises.There are norestrictionsonthenumberofoptionalpremiseswhichanyone licensee may have on his outdoor sports or recreational facility. However,any applicant requesting approval of more than one optional premises shall demonstrate the need for each optional premise in relationship to the outdoor sports or recreationalfacilityanditsguests. 5.30.040 Application Requirements.When submitting an application for the approval of an optional premises,an applicant shall also submit the following information. 1.A map or other drawing illustrating the outdoor sports or recreational facility boundaries and the approximatelocationofeachoptionalpremisesrequested. 2.A description of the method which shall be used toidentifytheboundariesoftheoptionalpremiseswhenitisin use and how the licensee will ensure alcoholic beverages are not removed from such premises. 3.Proof of the applicant’s right to possession of the optional premises. 4.A description of the provisions which have been made for storing malt,vinous and spiritous liquors in a secured area on or off the optional premises for use on the optional premises. 5.30.050 Advance Notification.Pursuant to Section 12—47—135(6)and (7),C.R.S.,no alcoholic beverages may be served on the optional premises until the licensee has provided written notice to the State and Local Licensing Authorities forty-eight (48)hours prior to serving alcholic beverages on the optional premises.Such notice must contain the specific days and hours on which the optional premises are to be used.In this regard,there is no limitation on the number of days which a licensee may specify in each notice. Section 2.The adoption of this Ordinance is hereby declared an emergency due to the fact that it is necessary to immediately impose the above Ordinance adopting standards for the issuance of optional premises licenses and for optional premises for a hotel and restaurant license;and WHEREAS,it is the opinion of the Board of Trustees that an emergency exists and this Ordinance shall take effect and be enforced immediately after its passage,adoption and signature of the Mayor. —2— C)0 PASSED AND ADOPTED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO THIS /3/S-DAY OF MAY,1991.
