C0ORDINANCENO.4-93ANORDINANCEAMENDINGCHAPTER9.18OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,THESANERELATINGTOSKATEBOARDS,ROLLERBLADES,MIDBICYCLESWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendChapter9.18oftheMunicipalCodeoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.chapter9.18isherebyamendedasfollows:9.18.010Definitions.A.Bicycle.Meansadevicepropelledbyhumanpoweruponwhichanyoneormorepersonsmayrideandwhichiscomposedofoneormorewheels.Bicycleincludesunicycles,tricycles,andtandembicycles.B.Rollerblades.Meansapairofshoesorbootswhichhaveattachedwheelsandallowsthepersonwearingthebootstopropelthemselvesalongasurface.Rollerbladesincluderollerskates.C.Skateboard.Meansadevicepropelledbyhumanpoweruponwhichanypersonmayride,whichiscomposedofoneormorewheels,noneofwhichexceedsfourinches(4”)indiameteranduponwhichismountedaflatboardorsurfacedesignedtocarryoneormorepersons.D.DesignatedBikePath.Meansthosepublicpathsandrights—of-waydesignatedasbikepathslocatedandasdefinedinaseparatesetofdescriptionsonfileintheofficeoftheTownPlannerandChiefofPolice.9.18.020RestrictiononSkateboards.Itisunlawfulforanypersontooperateaskateboarduponapublicsidewalk,downtownpublicparkinglots,Street,alley,park,includingRiversidePlaza,riverwalk,ordesignatedbikepathwithintheTown.9.18.030RestrictiononRollerbiades.Itisunlawfulforanypersontooperaterollerbladesuponanypublicsidewalk,downtownpublicparkinglots,street,alley,park,includingRiversidePlaza,orriverwalkwithintheTown.Rollerbladesmaybeoperatedondesignatedbikepaths. 00 009.18.040RestrictiononBicycles.Itisunlawfulforanypersontooperateabicycleuponanydowntownpublicparkinglots,park,includingRiversidePlaza,orriverwalkwithintheTown.Abicyclemaybeoperatedonanypublicstreet,alley,ordesignatedbikepath.Section2.TheadoptionofthisOrdinanceisherebydeclaredanemergencyinordertoimmediatelycontroltheuseofskateboards,rollerbiades,andbicyclesonpublicproperty;andWHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHISdeDAYOF___________,1993.aTOWNOFESTESPARKBY:_____________________________________MayorATTEST:CTownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe24dayof_____1993,andpublishedinanewspaperofnera1circulationintheTownofEstesPark,Coloradoonthef-—dayof__________,1993.C-(‘I-,LLt)TownClerk 00
