Home My WebLink AboutORDINANCE 01-93C’C’ORDINANCENO.1-93AMENDINGCHAPTER14.20OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,THESAMEPERTAININGTOADOPTIONOFTHENATIONALELECTRICALCODE,1993EDITIONANDALSOPERTAININGTOELECTRICREPAIRANDINSTALLATIONWITHINTHETOWNOFESTESPARK,COLORADOWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendChapter14.20oftheMunicipalCode.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Chapter14.20isherebyamendedtoreadasfollows;Section14.20.010NationalElectricalCode,1993Edition.TheNationalElectricalCode,1993Edition,issuedbytheNationalFireProtectionAssociation,Inc.,BatterymarchPark,Quincy,MA02269isenactedandadoptedbyreferenceasaprimarycodeandincorporatedinthisChapter.Section14.20.015NationalElectricalCode,1993——Violation.A.ItisunlawfulforanypersontoviolateanyoftheprovisionsstatedoradoptedintheNationalElectricalCode,1993Edition.B.EverypersonconvictedofaviolationofanyprovisionstatedoradoptedintheNationalElectricalCode,1993Edition,shallbepunishedassetforthinSection1.20.020oftheMunicipalCode.Section14.20.017Damages.NeithertheTown’sBuildingInspector,TownEngineer,LightandPowerDirector,noranyotheremployeeoragentoftheTownofEstesPark,noranyvolunteeractingonbehalfoftheTownofEstesParkshallbeliableforanydamagesforanyactand/oromissionbysaidperson,pursuanttothedutiesandenforcementoftheprovisionsoftheNationalElectricalCode,1993Edition. aC C)USection14.20.020LicenseRequired.Itisunlawfulforanypersontoengageinthebusinessofinstallation,alteringorrepairingelectricalwiringintheTownwithoutfirsthavingprocuredalicensethereforfromtheState.Therequirementforalicenseshallnotapplytotheownerofanypropertydoingworkinorabouthisownresidence,provided,thathefirstobtainthenecessarypermittherefor.TherequirementforalicenseshallnotapplytoajourneymanelectricianorhelperwhoisworkingunderthecontrolandsupervisionofanelectricianlicensedbytheState.Section14.20.040Permit—-Application—-Issuance.Noelectricalwiringshallbeinstalled,alteredorrepaired,inconnectionwithanybuildingintheTown,withoutfirstobtainingapermitfromtheColoradoStateElectricalBoard.ApplicationforpermitshallbemadetotheColoradoStateElectricalBoard.Suchpermitshallbepostedonthesiteoftheworkandkeptthereuntiltheworkiscompleted.Section14.20.060Certificateofapprovalrequired.ItisunlawfulforanypersontomakeanyelectricalconnectiontoanybuildinguntiltheStateElectricalInspectorhasissuedacertificateapprovingtheelectricalwiring.Section14.20.070Permit--Temporafl.Where,fromgoodandsufficientcause,itisnecessarytohaveelectricityonanyinstallationbeforefinalcertificatecanbeissued,theStateElectricalInspectormayissueatemporarypermit;provided,thatallpartstowhichcurrentisappliedareinasafeandsatisfactorycondition.Section14.20.080Electricalconstructionrepirements.Allnewstructuresandexistingstructuresthatarealtered,addedtoorrepairedinexcessoffiftypercent,andwhichcontain,inwholeorinpart,commercialuses,shallbeentirelywiredinrigidorsteeltubeconduitsorapprovedmetalraceways.UnlessitisotherwiserequiredbyapplicableprovisionsoftheNationalElectricalCode,1993Edition,therequirementsofthissectiondonotapplytoafree—standingcommercialstructureservedbyoneelectricmeterlocatedintheTown’scommercialoutlying(CO)zone.—2— C0 00Section2.Thisordinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDFYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,THIS94DAYOF___________,1993.TOWNQE2STESPARKATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheboardofTrusteesonthef’dayof______________1993,andpublishedinanewspaperofgeneralcirculathnintheTownofEstesPark,Coloradoonthe/‘dayof1993.Tz&kCc?tL()TownClerk—3— C
