Home My WebLink AboutORDINANCE 18-93o10ORDINANCENO.18-93ANORDINANCEAMENDINGCHAPTER5.20OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARKWITHREGARDTOBUSINESSLICENSESWHEREAS,theBoardofTrusteeshasdeterminedthatitisinthebestinterestoftheTowntoamendChapter5.20withregardtoBusinessLicenses.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Section5.20.010(3)Definitionsisamendedbytheadditionofthefollowingtwoclassifications:AsphaltContractorandFireSystemInstallationContractor.Section2.Section5.20.020Businesslicense——Feeisamendedtoreadasfollows:Thereisimposedabusinesslicensefeeontheprivilegeofcarryingonorengaginginanybusiness,professionoroccupationwithintheTown,whichbusiness,professionoroccupationconsistsofthesellingofgoods,wares,merchandiseorservice;theperformingorrenderingofservice,forcharge;theleasing,rentingorfurnishingofaccommodationunits;andthecarryingonorengaginginanynonresidentbusinessorcommunityspecialevent.Eachbusiness,professionoroccupationconductedataseparatephysicallocation,regardlessofownership,shallpayabusinesslicensefee.Section3.Section5.20.030AmountofLicenseFeeisamendedtoreadasfollows:Thebusinesslicensefeeissetforthasfollows:A.Accommodations:Fiveunitsorless,onehundredfiftydollarsperyear;sixtotwentyunits,twohundredsixtydollarsperyear;twenty—oneunitsormore,threehundredseventy—fivedollarsperyear. C0 0cB.BuildingContractors:Onehundreddollarsperyear.C.Allotherbusinessesincluding,butnotlimitedtonon—residentbusinessandcommunityspecialevents;twohundreddollarsperyear.Section4.Section5.20.050Formofthelicense——Nontrans—ferabilityshallbeamendedtoreadasfollows:Eachbusinesslicenseshallbenumberedandshallshowthenameandplaceofthebusinessofthelicenseeandshallbepostedinaconspicuousplaceonthebusinesspremisesforwhichitisissued.Thislicensemaybetransferabletoanynewownerofthebusinesssolongasthebusinessremainsatthesamepremises.Section5.Section5.20.060Paymentoflicensefeeshallbeamendedtoreadasfollows:Theownerofeachbusiness,professionoroccupationsubjecttotheprovisionsofthischaptershallpaythebusinesslicensefeeforeachcalendaryearinwhichtheyengageinanybusiness,professionoroccupationwithintheTownasfollows:A.One—halfofthebusinesslicensefeemaybepaidatanytime,providedthatfullpaymentisrequiredonorbeforeJune30thofeachcalendaryear.B.Anynewbusiness,professionoroccupationwhichbeginsitsbusinessduringtheyearpriortoOctober31stofthatyearshallpaythebusinesslicensefeeforsaidyear.Anynewbusiness,professionoroccupationwhichbeginsitsbusinessafterDctober31stofthatyearshallpayabusinesslicensefeewhichshallbecreditedtothenextyear’sbusinesslicensetee.SaidfeeshallbedueandpayableuponsubmittalofanapplicationtotheTownClerk’soffice.Section6.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTEBOARDQFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHISDAYOF/LtZ(.&k%LL),1993.By:ATTEST:TownClerkTOWNOFESTESPARK—2— 0 V.CCIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe9dayof_____________1993andpublishedinanewspaperofgeneralciizsulationintheTownofEstesPark,Coloradoonthe/7—dayof/tz;IiJ1993./1i-e%a-ó2’TownClerk—3— 00
