HomeMy WebLinkAboutORDINANCE 01-94CORDINANCENO.1-94ANORDINANCEAMENDINGCHAPTERS13.32AND13.38OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,WITHREGARDTOWATERRATESANDCHARGESWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendChapters13.32and13.38oftheMunicipalCodeoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Section13.32.010(B)shallbeamendedasfollows:13.32.010DefinitionsB.“BedandBreakfast”meansadwellinginwhichtheownerortenantletsroomsand/orprovidestableboard.BedandBreakfastaccommodationsshallbetreatedforthepurposeofSection13.32.012asamulti—familydwellingwitheachindividualroomavailableforrentasanindividualdwellingunit.ForpurposesofSection13.32.110,BedandBreakfastshallbeconsideredacommercialuse.Section2.Section13.32.010shallbeamendedbytheadditionofthefollowingsubsections.H.“ResidentialConsumer”meansawaterconsumerwhosemajorityofwateruseisforpersonal,domesticandhouseholduse.I.“Commercial__Consumer”meansawaterconsumerwhosemajorityotwateruseisforacommercialuseincluding,butnotlimitedtothefollowing:1.CommercialAccommodations.2.RetailSales.3.BedandBreakfast.4.Restaurants.5.CampGrounds.6.schoolandChurches.7.GovernmentalandUtilityAgencies.8.ServiceBusinesces.ForpurposesoftheWaterRateSchedule,acommercialaccommodationshallincludeanydwellingoraccommodationunitorunitswhicharerentedforaperiodoflessthan30daysduringanyportionofacalendaryear. flc (1J.“PumpFlowConsumer”meansaconsumerthatcannotbeservedbygravityfromtheTown’swatersystemandrequiresaTownmaintainedpumpstationforservice.K.“BulkWaterConsumer”meansaconsumerasdefinedinSection13.38.010ofthiscode.L.“RuralService”meansallwaterserviceforconsumerslocatedoutsidethecorporatelimitsoftheTownofEstesPark.N.“UrbanService”meansallwaterserviceforconsumerslocatedwithinthecorporatelimitsoftheTownofEstesPark.Section3.Section13.32.110shallbeamendedasfollows:Section13.32.110WaterRateSchedule.A.applicability.ThewaterratescheduleisapplicabletowaterserviceforallconsumersreceivingwaterservicefromtheTown’swatersystem.B.Rates.TheratesforwaterservicetoallconsumersontheTown’swatersystemisasmorefullysetforthontheTown’sWaterRateScheduleonfileintheofficeoftheDirectorofPublicWorks.C.Payment.Allhillsshallbedueandpayablewithin15daysofthedateofthebill.Billwillbecomedelinquent30daysfromthedateofthebill.D.ContractPeriodandConditions.Serviceshallbeforaminimumperiodof12monthsand,thereafter,untilterminated.Noticeofrequesttoterminatewaterservicemustbegivenwith10dayswrittennoticepriortoendofeachannualterm.Waterserviceissubjecttothiscode,ordinancesoftheTown,andrulesandregulationsoftheWaterDepartment.E.MinimumRate.Aminimumrateshallbechargedforeachmeterforwhichaconnectionfeehasbeenpaid,fromthedateofthepaymentoftheconnectionfeetothedateonwhichthemeterisconnectedtotheTown’swatersystem,andthereafterattheratesetforthintheWaterRateSchedule.TheconsumershallnotifytheTownofthedateoffirstuseofthewaterfromtheTown’sWaterSystem.Intheeventthatserviceisterninated,theminimumrateshallnotapply,andatsuchtimeastheterminatedserviceisrestored,theconnectionchargesassetforthinthisChaptershallbepaid.—2— 0(N CSection4.Section13.32.130shallbedeleted.Section5.Section13.38.040shallbeamendedtoreadasfollows:13.38.040Rates.TheratesforbulkwaterusersshallbeasmorefullysetforthontheTown’sWaterRateScheduleonfile.Ifabulkwateruserconsumerisalsoapumpflowconsumer,saidconsumershallbechargedthepumpflowrate.Section6.ThewaterrateschedulereferredtoinSection3shallbethesameassetforthonExhibit“A”attachedheretoandincorporatedhereinbythisreference.Section7.ThesewaterratechangesshallbeinforceandeffectasofthebillingperiodbeginningMarch,1994.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS//DAYOFJANUARY,1994.TOWNOFESTESPARKBy:___________________________ATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroUucedandreadatameetingoftheBoardofTrusteesonthe7!dayof___________1994,andpublishedinanewspaperofgeneralcircuiatgonintheTownofEstesPark,Coloradoonthe/‘9dayof______________,1994.3:TownClerk—3— C) TABLE 4—3 COMPARISON OF EXISTING AND PROPOSED RATES FOR 1994 THROUGH 1999 Volimi.Chaig.—pa 1,000 g.Iala Mhin.jn O,arg.Mninzsn O,erge $2.91 $1.Z $3.17 Mhirnsm Oerg.Mninzsm Gtarge $1.84 12.94 12.01 titan tkb.n Hint titan Hi..)titan Mnlnnn Olsi9e £2.24 1.3-18 Mn’rnsm Qsaa $2 70 Mninism Oiare £2.51 13.60 H cial RaiJ.nbel Fiat Z503g.Iicie Over 2.500 9&IQ,s Comma cal First 2.50]gallail Over 2.500 g&Iat Pi.q.d Floew Fiat 2,50]g&lrs.s Over 2.500 &Iais Bulk Waist (j.)
