CCORDINANCENO.7-94ANORDINANCEAMENDINGSECTION17.36.020,THESAMEPERTAININGTOTHEESTESPARKURBANRENEWALAUTHORITYREVIEWPROCESSWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendSection17.36.020oftheMunicipalCodeoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.Section1.Section17.36.020oftheMunicipalCodeisherebyamendedtoreadasfollows:11.36.020EstesParkDowntownRedevelopmentProgramReviewProcess.A.Purpose:ThepurposeofthisSectionisasfollows:1.ToestablishtheprocedureandcriteriaforreviewofcertaindevelopmentslocatedwithintheEstesParkUrbanRenewalAreaassaidareaissetforthintheEstesParkDowntownRedevelopmentProgramadoptedMay24,1983.2.TosetforthadequatereviewproceduresandcriteriatodeterminethatdevelopmentinsaidareaisinaccordancewiththeprovisionsoftheEstesParkDowntownRedevelopmentProgramwithrespecttothelandarea,landuse,design,buildingrequirements,timingandprocedureasthesameismorefullysetforthinsaidplan.3.ToencouragetheplanningofcertaindevelopmentsconsistentwiththegoalsandobligationsoftheEstesParkDowntownRedevelopmentProgram.4.Tofurtherthepublichealth,safetyandgeneralwelfareasthesamespecificallyrelatestothetownandthepropertywithintheEstesParkDowntownRedevelopmentProgram. 0C) aCB.Applicability.Theprovisionsofthissectionshallapplytoalldevelopmentofpropertythatmeetsthefollowingcriteria:1.SaidpropertyislocatedwithinthegeographicalareaoftheEstesParkUrbanRenewalAreaasthesameissettorthintheEstesParkDowntownRedevelopmentProgramadoptedMay24,1983,andallamendmentsthereto;and2.Thedevelopmentofthepropertyissubjecttoconceptplanreview,developmentplanreviewand/orspecialreviewpursuanttotheprovisionsofTitle17oftheMunicipalCode;and3.Thepropertyordevelopmentofsaidpropertymeetsthefollowingcriteria:A.Thepropertyisdesignatedintheacquisitionplan(Figure6)and/orintheredevelopmentprojects(Figure8)intendedforlandagreements,acquisition,redevelopment(Projects1—7),orpublic/privatedevelopment(ProjectsA—G)assetforthintheUrbanRenewalPlan.B.Allpropertyinwhichtheexistingstructureisrenovated,rehabilitatedorenlargedatacostthatisequaltoorgreaterthanfiftypercentoftheactualvalueofthepropertyasdeterminedbytheassessedvaluation.C.Alldevelopmentoftenthousandsquarefeetormoreoffloorareaananyimprovement.D.Allvacantparcelsorlots.TheEstesParkPlanningCommissionifapplicable,shallconductthereviewpursuanttotheprovisionsofthedevelopmentplan,conceptplanand/orspecialreviewasmorefullysetforthinTitle17oftheMunicipalCode.Forpurposeofthissection,saidreviewshallbelimitedtowhetherornottheproposed—2— 00 00developmentconformstotheapplicableprovisionsoftheEstesParkDowntownRedevelopmentProgramadoptedMay24,1983andallamendmentsthereto.C.PreviousApprovals.AnypropertywhichreceivedapprovaltardevelopmentbytheEstesParkUrbanRenewalAuthorityshallremainsubjecttothetermsandconditionsofsaidapproval.ArequesttoamendormodifysaidapprovalshallbemadebyapplicationtothePlanningCommission.ThePlanningCommissionshallreviewtheapplicationtodeterminewhethertherequestedactionconformstotheapplicableprovisionsoftheEstesParkDowntownRedevelopmentProgramandtheoriginalapprovalofthedevelopment.ThePlanningCommissionmaydenytheapplicationorgranttheapplicationwithorwithoutconditions.TheapplicantmayappealanydenialorapprovalwithconditionstotheBoardofTrustees.Uponappeal,theBoardofTrusteesshallreviewthePlanningCommission’sdecisionandmayupholdthesameorreversethedecisionwithorwithoutconditions.Section2.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHISDAYOF,1994.TOWNOFESTESPARKMayorATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe/dayof,OJfl4a*efr,1994andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Colorado,onthe/SdayofMarfj,1994.TownClerk—3— 00
