00ORDINANCENO.8-95ANORDINANCEAPPROVINGTHEANNEXATIONOFCERTAINTERRITORYTOTHETOWNOFESTESPARK,COLORADO.TOBEKNOWNANDDESIGNATEDASGREYFOXFOURTHADDITIONBEITORDAINEDBYTHEBOARDOFTRUSTEESOFESTESPARK,COLORADO:Section1.ThataPetitionforAnnexation,togetherwithfour(4)copiesoftheplatofsaidareaasrequiredbylaw,wasfiledwiththeBoardofTrusteesonthe28thdayFebruary,1995bythelandownersofonehundredpercent(100%)oftheareaandowningonehundredpercent(100%)ofthearea,excludingpublicstreetsandalleys,oftheareahereinafterdescribed.TheBoard,byResolutionatitsregularmeetingonthe28thdayofFebruan’.1995,acceptedsaidPetitionandfoundanddeterminedthattheprovisionsofSection31-12-107(1)(g),C.R.S.,weremet;andtheBoardfurtherdeterminedthatapublichearingshouldbeheldonApril11,1995,at7:30P.M.,intheMunicipalBuildingforthepurposesofdeterminingthattheproposedannexationcomplieswiththeapplicableprovisionsofSection31-12-104and31-12-105,,C.RS.,andisconsideredeligibleforannexation.Section2.ThattheNoticeofsaidhearingwasgivenandpublishedasprovidedinSection31-12-108(2),C.R.S.,Section3.ThatthehearingwhichwasscheduleforApril11,1995wascontinueduntilMay9,1995.Section4.ThatthehearingwasheldpursuanttotheprovisionsofSection31-12-109,C.R.S.,onthe9thdayofMay,1995.Section5.Thatfollowingsaidhearing,theBoardofTrusteesadoptedaResolutiondeterminingthattheproposedannexationmettherequirementsoftheapplicablepartsofSection31-12-104and31-12-105,C.R.S.;thatanelectionwasnotrequiredunderSection31-12-107(2),C.R.S.;andthatnoadditionaltermsorconditionsaretobeimposeduponsaidannexation.Section6.ThattheannexationofthefollowingdescribedareadesignatedasGREYFOXFOURTHADDITIONtotheTownofEstesPark,isherebyapproved:PropertylocatedinSection1,T4N,R73Wofthe6thP.M.,LarimerCounty.Colorado,moreparticularlydescribedasbeginningattheSWcornerofsaidSection1.thenceN00c50’lS”Eadistanceof1809.26feet;thenceN.76°04’06Eadistanceof626.61feet;thenceN89c5I‘03”Eadistanceof703.01feet;thenceS00°27’42Wadistanceof1972.01feet;thenceN.89°31’25’Wadistanceof1321.86feettothepointofbeginning.Containing58.31acres,moreofless. 00 00Section7.TheTownofEstesPark,Colorado,herebyconsents,pursuanttoSection37-45-126(3.6)C.R.S.,totheinclusionoflandsdescribedaboveintotheNorthernColoradoWaterConservancyDistrictandtheMunicipalSubdistrict,NorthernColoradoWaterConservancyDistrict.Section8.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.TOWNOFESTESPARKMayorATTEST:TownClerkIherebycertifythattheaboyeordinancewasintroducedandreadataregularmeetingoftheBoardofTrusteesonthe9-dayoft2u&-,1995andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Cok(radoonthe,2L11ayof‘71Lc?y,1995,allasrequiredbythestatutesoftheStateofColorado.1 00S.
