HomeMy WebLinkAboutORDINANCE 20-9500ORJJINANCENO.20-95ANORDINANCEAPPROVINGTHEANNEXATIONOFCERTAINTERRITORYTOTHETOWNOFESTESPARK,COLORADO,TOBEKNOWNANDDESIGNATEDASFISHCREEKADDITIONBEITORDAINEDBYTHEBOARDOFTRUSTEESOFESTESPARK,COLORADO:Section1.ThataPetitionforAnnexation,togetherwithfour(4)copiesoftheplatofsaidareaasrequiredbylaw,wasfiledwiththeBoardofTrusteesonthe11thdayJuly,1995bythelandownersofonehundredpercent(100%)oftheareaandowningonehundredpercent(100%)ofthearea,excludingpublicstreetsandalleys,oftheareahereinafterdescribed.TheBoard,byResolutionatitsregularmeetingonthe11thdayofJuly,1995,acceptedsaidPetitionandfoundanddeterminedthattheprovisionsofSection31-12-107(1)(g),C.R.S.,weremet;andtheBoardfurtherdeterminedthatapublichearingshouldbeheldonSept.26,1995at7:30P.M.,intheMunicipalBuildingforthepurposesofdeterminingthattheproposedannexationcomplieswiththeapplicableprovisionsofSection31-12-104and31-12-105,,C.R.S.,andisconsideredeligibleforannexation.Section2.ThattheNoticeofsaidhearingwasgivenandpublishedasprovidedinSection31-12-108(2),C.R.S.Section3.ThatthehearingwasheldpursuanttotheprovisionsofSection31-12-109,C.R.S..onthe22thdayofAugust.1995.Section4.Thatfollowingsaidhearing,theBoardofTrusteesadoptedaResolutiondeterminingthattheproposedannexationmettherequirementsoftheapplicablepartsofSection31-12-104and31-12-105,C.R.S.;thatanelectionwasnotrequiredunderSection31-12-107(2).C.R.S.;andthatnoadditionaltermsorconditionsaretobeimposeduponsaidannexation.Section5.ThattheannexationofthefollowingdescribedareadesignatedasFishCreekAdditiontotheTownofEstesPark,isherebyapproved:AportionoftheE1/2oftheSE1/4ofSection31,T5N,R72Wofthe6thP.M.,LarimerCounty.ColoradodescribedascommencingattheSEcorneroftheNE1/4oftheSE1/4ofsaidSection31;thenceN.42°20’XVadistanceof691feet;thenceS84°33’Eadistanceof171.3feet;thenceN.79c09’Eadistanceof100feet;thenceS08°39’XVadistanceof289.5feet;thenceS58°26’XVadistanceof200feet;thenceN70°19’Wadistanceof154feet;thenceN53°55’XVadistanceof200feettotheTRUEPOINTOFBEGINNING; 00 0cThenceS00’30’XVadistanceof400feet;ThenceS80°47’XVadistanceof337feet;ThenceN00°58’XVadistanceof400feet;ThenceN80°47’Eadistanceof320feettotheTRUEPOINTOFBEGINNING.Section6.TheTownofEstesPark,Colorado,herebyconsents,pursuanttoSection37-45-126(3.6)C.R.S.,totheinclusionofthelandsdescribedaboveintotheNorthernColoradoWaterConservancyDistrictandtheMunicipalSubdistrict,NorthernColoradoWaterConservancyDistrict.Section7.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafieritsadoptionandpublication.TOWNOFESTESPARKaChairnATTEST:TownClerkIherebycertifythattheaboveordinancewasintroducedandreadataregularmeetingoftheBoardofTrusteesonthedayof1995andpublishedinnewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthec,2.9‘4ayof1it24p..4.1995.1ttLLTownClerk 00
