Home My WebLink AboutORDINANCE 15-95CCORDINANCENO.15-95ANORDINANCEAMENDINGCHAPTER14OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARE,COLORADO,THESANEPERTAININGTOBUILDINGSANDCONSTRUCTION,INCLUDINGTHEADOPTIONOFTHEUNIFORMBUILDINGCODE,1994EDITIONWHEREAS,onthe12thdayofSeptember,1995,theBoardofTrusteesoftheTownofEstesParkheldaPublicHearingontheadoptionofthe1994editionoftheUniformBuildingCode;andWHEREAS,noticeofsaidhearingwaspublishedasprovidedinSection31—16—203,C.R.S.;andWHEREAS,priortotheadoptionoftheUniformBuildingCode,1994edition,byreference,copiesofsaidCodeandallsecondarycodeswerepresentedtotheBoardofTrusteesoftheTownofEstesPark.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.ThatChapter14.12oftheMunicipalCodeoftheTownofEstesPark,Colorado,shallbeamendedtoreadasfollows:14.12.010UniformBuildingCode,1994——Adopted.TheUniformBuildingCode,Volumes1,2,and3,1994edition,theUniformBuildingCodeAppendix,1994edition,issuedbytheInternationalConferenceofBuildingOfficials,5360SouthWorkmanMillRoad,Whittier,California90601,exceptthesectionsorpartsofsectionsthereofwhichareamendedbythischapter,referredtointhistitleasthe“UniformBuildingCode”isenacted,adoptedbythisreference,andincorporatedinthischapterasifsetoutatlength.14.12.020ExceptionstoAppendix.TheUniformBuildingCodeAppendix,1994edition,isamendedbythedeletionofChapter3,Division3,andChapters13,30,and34.14.12.030GradingPermits.Section3306ofChapter33oftheUniformBuildingCodeAppendix,1994edition,shallbeamendedbytheadditionofSection3306.3toreadasfollows:NogradingorexcavationforprojectswhichrequiredevelopmentorconceptplanapprovalundertheprovisionsofSection17.36.040oftheMunicipalCodeshallbedonewithoutagradingpermit.Agradingpermitmaybeissuedfollowingfinalapprovalofadevelopmentorconceptplaniftheapplicantdesirestogradeorexcavateaprojectpriortotheissuanceofabuildingpermit.—1— 00 0014.12.040section109.1amended——Useoroccupancy.Section109.1oftheUniformBuildingCodeisamendedtoreadasfollows:NobuildingorstructureofgroupA,B,E,F,H,I,N,RorSoccupancy,shallbeusedoroccupied,andnochangeintheexistingoccupancyclassificationofabuildingorstructureorportionthereofshallbemadeuntiltheBuildingOfficialhasissuedaCertificateofOccupancythereforeasprovidedherein.14.12.050Violation.A.ItisunlawfulforanypersontoviolateanyoftheprovisionsstatedoradoptedintheUniformBuildingCode.B.EverypersonconvictedofaviolationofanyprovisionstatedoradoptedintheUniformBuildingCodeshallbepunishedassetforthinSection1.20.020ofthiscode.C.TheTownshallhavetheoptionofinstitutinganappropriateactioninanycourthavingjurisdictiontoprevent,enjoin,abateorremoveaviolationofanyportionoftheUniformBuildingCodeandtopreventtheoccupancyofanybuildingandstructureortopreventanyillegalactoruseinoronsuchpremisesastheresultofanyviolationoftheprovisionoftheUniformBuildingCode.14.12.060Damages.NeithertheTown’sBuildingOfficial,TownEngineer,noranyotheremployeeoragentoftheTownofEstesPark,noranyvolunteeractingonbehalfoftheTownofEstesParkshallbeliableindamagesforanyactand/oromissionbysaidpersonpursuanttothedutiesandtheenforcementoftheprovisionsoftheUniformBuildingCode.14.08.040certificateofOccupancy——PaymentofBusinessLicenses.PriortotheissuanceofanyCertificateofOccupancyorFinalInspection,pursuanttotheprovisionsofthisTitle14,theownerorgeneralcontractorshallprovidetheTownwithanaffidavitlistingallpersonsorentitieswhichhaveprovidedlaborand/ormaterialstobeusedintheconstruction,repair,and/orremodelingwhichisperformedpursuanttoabuildingpermitissuedbytheTown.NoCertificateofOccupancyorFinalInspectionshallbeissuedandnobuildingorstructureshallbeoccupieduntilsuchtimeasallpersonsand/orentitiesthataresetforthontheaffidavitwhoarerequiredtohaveabusinesslicensepursuanttotheapplicableprovisionsofChapter5.20oftheMunicipalcodehaveobtainedsaidlicense.Section2.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandsubsequentpublication.—2— 00 00PASSEDANDADOPTEDBYTHEBOARDOFTRUTEESOFTHETOWNOFESTESPARK,COLORADO,THIS/cRaDAYOF______________,1995.TOWNOFESTESPARK,COLORADOBy:_____MayorATTEST:ciLTownClerkIherebycertifythattheaboveordinancewasintroducedandreadaameetigoftheBoardofTrusteesonthe7?dayof____1995,andpublishedinanewspaperofgeneralPulicatinintheTownofEstesPark,Colorado,onthe_________dayof__________________,1995.TownClerk—3— 00
