CC?ORDINANCENO.13-97ANORDINANCEAMENDINGTHEMODELTRAFFICCODERELATINGTOSPEEDINGVIOLATIONSINHIGHWAYCONSTRUCTIONZONESWHEREAS,theBoardofTrusteesoftheTownofEstesPark,ColoradohasdeterminedthatitisinthebestinterestoftheTowntoamendSection613oftheModelTrafficCodeforColoradoMunicipalities1995Edition,hereinafterreferredtoasTheModelTrafficCode,whichhasbeenadoptedbytheTownasmorefullysetforthinSection10.04.010oftheMunicipalCode.NOW,THEREFORE.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK.COLORADO:Section1.ThatSection613oftheModelTrafficCodeforColoradoMunicipalities,1995Editionisherebyamendedtoreadasfollows:613.Designationofhighwaymaintenance,repair,orconstructionzones-signs-increaseinpenaltiesforspeedingviolations.1)Ifmaintenance,repair,orconstructionactivitiesareoccurringorwillbeoccurringwithinfourhoursonastatehighwayormunicipalstreet,thedepartmentoftransportationormunicipalauthorities,withintheirrespectivejurisdictions,maydesignatesuchportionofthehighwayasahighwaymaintenance,repair,orconstructionzone.Anypersonwhocommitsaspeedingviolationinamaintenance,repair,orconstructionzonethatisdesignatedpursuanttotheprovisionsofthissectionissubjecttoincreasedpenaltiesandsurcharges.2)Thedepartmentoftransportationormunicipalauthorities,withintheirrespectivejurisdictions,shalldesignatebyappropriatesignsamaintenance,repair,orconstructionactivityistakingplaceorwillbetakingplacewithinfourhours.Suchsignshallnotifythepublicthatincreasedpenaltiesforspeedingviolationsareineffectinsuchzone.TheDepartmentofTransportationorlocalauthoritiesshallerectorplaceasecondsignaftersuchzoneindicatingthattheincreasedpenaltiesforspeedingviolationsarenolongerineffect.Amaintenance,repair,orconstructionzonebeginsatthelocationofthesignindicatingthatincreasedpenaltiesareineffectandendsatthelocationofthesignindicatingthattheincreasedpenaltiesarenolongerineffect.
