ci0ORDiNANCENO.25-98ORDINANCEAMENDINGTITLE17OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,BYPROVIDINGFORAMORATORIUMONCERTAINUSESANDDEVELOPMENTSOFLANDWITHINTHEC-DANDC-OZONINGDISTRICTSPENDINGCONSIDERATIONOFAMENDMENTSTOTITLE17.WHEREAS,in1994,theTownofEstesParkandLarimerCounty,Colorado,beganworkonanewcomprehensiveplanfortheEstesValley;andWHEREAS,followingnumerousneighborhoodmeethigs,publicopenhousesandpublichearings,onDecember18,1996,theEstesValleyComprehensivePlanwasadoptedbytheBoardofTrusteesoftheTownofEstesPark;andWHEREAS,onDecember16,1996,theBoardofCountyCommissioners,LarimerCounty,Colorado,adoptedtheEstesValleyComprehensivePlanforthoseareasofLarimerCountylyingwithintheplan’sboundary;andWHEREAS,onSeptember16,1997,LarimerCounty,ColoradoandtheTownofEstesParkenteredintoanintergovernmentalagreementwhichestablishedtheEstesValleyPlanningCommission,whosepurposeistodraftthenewEstesValleyDevelopmentCodepursuanttoandinaccordancewiththedirectionsoftheEstesValleyComprehensivePlan;andWHEREAS,certaindevelopmentsandusescurrentlyallowedintheC-D,CommercialDowntownandC-O,CommercialOutlyingzoningdistrictsoftheTown,areinconsistentwiththerecommendationsforifiturelandusedevelopmentasmorethilysetforthontheFutureLandUseMapandaccompanyingtextualmaterialsinChapter4oftheEstesValleyComprehensivePlan;andWHEREAS,draftprovisionsofthenewEstesValleyDevelopmentCodecurrentlybeingreviewedbytheEstesValleyPlanningCommission,containprovisionswhichalterpermitteduseswithintheTown’scurrentC-OandC-Dzoningdistrict;andWHEREAS,portionsoftheTown’sC-DandC-OzoningdistrictsareproposedtoberezonedintootherzoningdistrictsthatmoreaccuratelyreflectthecurrentusesinthoseareasandtheFutureLandUsePlanoftheEstesValleyComprehensivePlan;andWHEREAS,theTownBoardanticipatesthatthenewEstesValleyDevelopmentCodewillbeenactedwithinsixmonthsoftheeffectivedateofthisordinance;and**NOTAPPROVED****NOTAPPROVED** 00WHEREAS,theEstesValleyComprehensivePlanandthenewEstesValleyDevelopmentCodeaddressesandwilladdressthechangingneedsandconditionsoftheEstesValley;andWHEREAS,theBoardofTrusteesfindsthattheacceptanceandprocessingofapplicationsandbuildingpermitsforcertainusesanddevelopmentswithintheTown’sC0andC-DzoningdistrictspriortotheadoptionofthenewEstesValleyDevelopmentCodewillpreventcoordinatedandinnovativeplanningandleadtonumerousnonconforminguseswithinthosezoningdistricts;andWHEREAS,theBoardofTrusteesfindsthatadelayintheacceptanceandprocessingofsuchapplicationsforaperiodnottoexceedsixmonthsisnecessaryandinthebestinterestoftheTowninordertocompletethenewEstesValleyDevelopmentCodeinaccordancewiththeprovisionsoftheEstesValleyComprehensivePlan;andtheallowanceofcertaindevelopmentsanduseswhicharesubjecttothismoratoriumpriortotheadoptionandimplementationoftheEstesValleyDevelopmentCodewoulddefeattheeffortsoftheTownandLarimerCountytopromotecomprehensiveplanning,protectexistingneighborhoodintegrity,andleadtotheproliferationofnon-conforminguseswithintheTownofEstesPark.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1:TheBoardofTrusteesoftheTownofEstesParkherebydeclaresandimposesamoratoriumonthefollowinglistedusesandtheacceptanceandprocessingofapplicationsforbuildingpermits,administrativereviews,developmentplans,andconceptplansforthefollowingusesandareaswithintheTown.(A)C-D,DowntownCommercial:socialandfraternalclubs,daycarecenters,religiousassemblies,animalsalesandservices,buildingmaterialssales,commerciallaundries,cateringservicesandftneralhomes.(B)C-O,CommercialOutlying:allresidentialusesincludingmulti-familydwellings,maintenanceandservicefacilities,accommodations,animalboarding,commerciallaundries,constructionstorageyards,self-serviceministorage,industrialuses,warehousingandstorage,andwholesalesalesanddistribution.(C)AllcommercialusesonanypropertycurrentlyzonedC-0,butdesignatedtobezonedAAccommodations/HighwayCorridorintheEstesValleyComprehensivePlan-FutureLandUsePlan.Anyaccommodationuseonpropertysubjecttothissubparagraph(C)willnotbesubjecttothismoratorium.**NQTAPPROVED**2**NOTAPPROVED** 00(D)AlldevelopmentwithintheFallRiverSpecialStudyAreaoftheEstesValleyComprehensivePlan-FutureLandUsePlan.(E)AllpropertylocatedwithintheStanleyHistoricDistrictoftheTownofEstesParkshallnotbesubjecttothetermsofthismoratorium.(F)AnyexistinguseofpropertyintheC-DandC-OzoningdistrictsoftheTownshallnotbechangedtoanyoftheuseslistedinsubparagraphs(A)and(B)ofthisSection1.Anysuchchangeofuseshallbeillegalandshallnothaveanynon-conformingstatusundertheapplicableprovisionsunderTitle17oftheMunicipalCode.Section2:TheTownofEstesParkshallnotacceptorreviewanyrezoningrequestsforanypropertywithintheC-OandC-DzoningdistrictsoftheTownofEstesParkduringthismoratorium.Section3.TheTownBoardshallhavethepowertograntaspecialexceptiontothemoratoriuminSection1ofthisordinanceandorderachangeofuse,buildingpermit,administrativeapprovalorreviewofadevelopmentorconceptplanwherethefollowingconditionsaremet:A.Awrittenapplicationforthespecialexceptionmustbesubmitted,indicatingthepurposeofthechangeofuse,buildingpermit,administrativeapproval,ordevelopmentorconceptplanreviewsoughttobeobtained,andstatingtheparticularityofthehardshipwhichtheapplicantwillsufferifthespecialexceptionisnotgranted.B.Within30days,theBoardofTrusteesoftheTownofEstesParkshallholdapublichearingontheapplication.Theapplicantshallbenotifiedbymail.NoticeofsuchhearingshallbepublishedinanewspaperwithgeneralcirculationwithintheTownofEstesParkatleastfifteendayspriortothepublichearing.C.TheBoardofTrusteesoftheTownofEstesParkmaygrantthespecialexceptionifitfindsallofthefollowing:i.Thegrantingoftheapplicationisnecessarytopreventunduehardshipfortheapplicant;andii.Thatthegrantingoftheapplicationwillnotadverselyaffectthepublicinterestorthepurposesofthismoratorium;and**NQTAPPROVED**3**NQTAPPROVED** 00iii.Thattherequestedpermit,changeofuse,administrativeapproval,ordevelopmentorconceptplanreviewwillbeproperandinaccordancewithalloftheordinancesandregulationsoftheTownofEstesParkifthismoratoriumwasnotineffect;andiv.IntheeventthatthespecialexceptionrequestisforadevelopmentorconceptplanreviewandtheplanhasnotbeenacteduponbytheEstesParkPlanningCommission,themattershallbereferredtotheEstesParkPlanningCommissionforrecommendationunderthecriterionotherwiseutilizedwithrespecttothereferredplan.Section4.Nothinginthisordinanceshallbeconstruedaseffectinganylawfullyvestedrightstocompleteconstructionworkorcommenceconstructionpursuanttoabuildingpermitdulyissuedpriortotheeffectivedateofthisordinance;anydevelopmentplanorconceptplanwhichhasreceivedapprovalbytheEstesParkPlanningCommissionand/ortheBoardofTrusteesoftheTownofEstesPark;anydevelopmentplan,conceptplan,orbuildingpermitapplication,whichwasfiledwiththeTownpriortotheeffectivedateofthisordinance;andanychangeofusecompletedpriortotheeffectivedateofthisordinance.Section5.TheprovisionsofthisordinancearetemporaryinnatureandareintendedtobereplacedbysubsequentmodificationstothezoningordinancebaseduponrecommendationsmadeintheEstesValleyComprehensivePlan.Section6.Ifanyarticle,section,paragraph,sentence,clauseorphraseofthisordinanceisheldtobeunconstitutionalorinvalidforanyreason,suchdecisionshallnotaffectthevalidityorconstitutionalityoftheremainingportionsofthisordinance.TheBoardofTrusteesoftheTownofEstesParkherebydeclaresthatitwouldhavepassedthisordinanceandeachpartorpartshereofirrespectiveofthefactthatanyoronepartorpartsbedeclaredunconstitutionalorinvalid.Section7.ThisordinanceshallbeinforceandeffectimmediatelyandshallrunthroughJune10,1999oruntiltheeffectivedateoftheproposedEstesValleyDevelopmentCodewhichevershallfirstoccur.Section8.Allotherordinancesorportionsthereofinconsistentorconflictingwiththisordinanceoranyportionhereofareherebyrepealedtotheextentofsuchinconsistencyorconflict.Section9.TheadoptionofthisordinanceisherebydeterminedtobedeclaredanemergencyduetothefactthatitisnecessarytoimmediatelyimposethismoratoriumwithregardtodevelopmentsanduseswithintheC-OandC-Dzoningdistricts;andWHEREAS,intheopinionoftheBoardofTrustees,anemergencyexists,thisordinance**NQTAPPROVED**4**NOTAPPROVED**
