20-980CORDINANCENO.20-98ORDINANCEAMENDINGCHAPThR5.20ANDTHEADDITIONOFCHAPTER5.35PERTAININGTOBUSINESSLICENSEFORRENTALOFRESIDENTIALPROPERTYBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARIçCOLORADO.WHEREAS,ithasbeendeterminedbytheTownofEstesParkthatnumerouspersonsareengagedinthebusinessofrentingrealpropertyforrentalperiodsoflessthan30daysandhavenotbeenobtainingbusinesslicensesasrequiredunderChapter5.20oftheMunicipalCode;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkwishestoclarifytheprovisionsofChapter5.20oftheMunicipalCodeinordertoclearlystatethatanypersonwhorentsanyrealpropertyissubjecttothetermsandconditionsofChapter5.20oftheMunicipalCode;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkwishestoaddadditionalconditionstotherentalofrealpropertyforperiodsof30daysorlessinordertoensurethatsuchrentalofrealpropertydoesnoteffecttheresidentialcharacterofneighborhoodsinwhichsaidrealpropertyislocatedandtoensurethatthepublichealth,welfare,andsafetyisadequatelyprotected.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1:Section5.20.010(1),(2),(5),&(7)oftheMunicipalCodeareamendedtoreadasfollows:(1)Accommodationmeanstheleasing,rentalorfurnishingofanyroom,mobilehomesite,recreationalvehiclesite,campsiteorotherareainanyhotel,motel,guesthouse,bedandbreakfast,apartment,dormitory,mobilehomepark,recreationalvehicleparkorcampground,anysinglefamilydwelling,duplex,multiplefamilydwelling,oranysuchsimilarplacetoanypersonwho,foraconsideration,uses,possessesorhastherighttouseorpossesssuchdwelling,room,singlefamilydwelling,duplexunit,multiplefamilyunit,site,orotherAccommodationforatotalcontinuousdurationoflessthanthirty(30)days.(2)AccommodationUnitmeanseachindividualroom,setofrooms,site,singlefamilydwelling,duplexunit,multiplefamilyunitordividedarearented,leasedoroccupiedonaunitbasisinanAccommodation. 0C(5)Homebusinessmeansabusiness,professionoroccupationconductedwithinorfromadwellingbyaresidentasanaccessoryusetotheresidentialuseofthedwelling,butitdoesnotincludeabuildingcontractororAccoimnodation.(7)Ownermeansthepersonowninganybusiness,profession,occupation,orAccommodationUnit.IntheeventthattheOwnerisanonresidentorcannotbelocatedbytheTown,theoperator,managerorlesseeofanysuchbusiness,professionoroccupationshallbedeemedanOwnerforallpurposesofthisChapter.Section2:TheMunicipalCodeisamendedbytheadditionofChapter5.35,ShortTermRentals,asfollows:5.35.010Applicability.ThisChaptershallapplytoanyAccommodationexistingintheE,R-S,&R-MZoningDistrictsoftheTownofEstesPark.5.35.020Application.TheapplicationforabusinesslicenseforanyAccommodationshalldesignatealocalresidentorpropertymanageroftheEstesValleywhocanbecontactedbytheTownwithregardtoanyviolationoftheprovisionsofthisChapter.ThepersonsetforthontheapplicationshallbetheagentoftheOwnerforallpurposeswithregardtotheissuanceofthebusinesslicense,theoperationoftheAccommodation,andrevocationofthebusinesslicensepursuantthetermsandconditionsofthisChapter.5.35.030RestrictionsonRentals.EachAccommodationsubjecttothisChapter5.35shallberestrictedintheleasing,rentalorifimishingofanyAccommodationUnitasfollows:(1)Renters.ThenumberofrentersusingeachAccommodationshallbenomorethantwicethenumberofbedroomslocatedwithineachAccommodationplustwopersons.(2)RenterVehicles.RentermotorvehiclesallowedonthepremiseshallbenomorethanonevehiclepereachbedroomoftheAccommodationorthreevehicleswhicheverisless.(3)RecreationalVehicles,TravelTrailersandTents.Norecreationalvehicleortraveltrailer,asthesameisdefinedinSection17.08.030oftheMunicipalCode,tent,temporaryshelter,canopy,orteepeeshallbeusedbyanyrenterontheAccommodationpremisesforlivingorsleepingpurposes.2 CC5.35.040Violation.ItshallbeaviolationofthisChapterforanyowner,agentand/oroccupanttobeconvicted,includingapleaofnocontest,ofaviolationofSection9.08.010(DisturbingthePeace)oftheMunicipalCode;tofailtopayallrequiredsalestaxtotheStateofColoradodueandowingfortheleasing,rentalorthrnishingofanAccommodationUnit;toviolateanyprovisionsofthisChapter;and/ortofailtoacquireandpayforabusinesslicense.ForthepurposesofthisSection,onlyviolationsofSection9.08.010oftheMunicipalCodewhichoccuronthepremiseoftheAccommodationandwhileanAccommodationUnitisbeingoccupiedasanAccommodationUnitshallbeaviolationofthisSection.5.35.050RevocationofLicense.TheTownmayrevokethebusinesslicenseofanyAccommodationforviolationofanyoftheprovisionsofthisChapterasfollows:1.TheTownClerkuponthereceiptandverificationofanyviolationofthisChaptershallgivewrittennoticetotheOwneroragentthataviolationoftheChapterhasoccurred.2.UponthereceiptandverificationofanysubsequentviolationofthetermsandconditionsofthisChapter,withintwoyearsofthedateofthewrittenwarningsetforthinparagraphIabove,theTownClerkshallrevokethebusinesslicensebygivingwrittennoticetotheOwneroragentoftherevocationofthelicense.Saidrevocationshallbeforoneyearfromthedateofthenotice.3.UponthereceiptandverificationofanysubsequentviolationofthetermsandconditionsofthisChapterwithintwoyearsafterreinstatement,theTownClerkshallrevokethebusinesslicensebygivingwrittennoticetotheOwneroragentoftherevocationofthebusinesslicense.Saidrevocationshallbefor2yearsfromthedateofthenotice.Uponrevocationofthebusinesslicense,theOwner’srighttooperateanAccommodationonthepropertyshallterminate.5.35.060Appeal.AnyOwneroragentwhowishestocontestthewrittenwarningortherevocationofabusinesslicenseshallbeentitledtorequestahearingbeforetheTownClerkbywrittennoticedeliveredinpersonorbycertifiedmail,returnreceiptrequested,totheTownClerkwithin15daysofthedateofthewarningorrevocation.TheTownClerkshallholdahearingontheappealanddeterminewhetherornotaviolationoftheprovisionsofthisChapterhasoccurred.TheOwnershallbeentitledtopresentanyevidenceofcompliancewiththetermsandconditionsofthisChapteratsaidhearing.ThedecisionoftheTownClerkastowhetherornottheviolationoccurredshallbefinalandnotsubjecttofurtherappeal.3 005.35.070ChapterExceptions.1.TheprovisionsofthisChaptershallnotapplytoanyCommercialAccommodationintheR-Mzoningdistrictwhichhasreceivedspecialreviewapproval.2.TheTownClerkmayapproveabusinesslicenseallowingmorerentersandlorrentermotorvehiclesthanaresetforthinSection5.35.020uponreceiptandreviewofanapplicationbyanyOwneroragentrequestingsuchexceptionforanAccommodationwhichislocatedonalotof5acresorgreater.ExceptionmaybegrantedbytheTownClerkupondeterminationthatthelocationoftheAccommodationUnitonthelotandprovisionforadequateparkingallowstherestrictionsastothenumberofguestsand/orguestvehiclestobeenlargedwithoutviolatingthepublichealth,safetyandwelfare.Section3.Section5.20.030oftheMunicipalCodeisamendedbytheadditionofsubsection(5)asfollows:(5)AnAccommodationsubjecttoChapter5.35oftheMunicipalCode:$50.00peryear.Section4.ThisOrdinancewilltakeforceandeffectonJanuary1,1999.ATtEST:TownClerkIherebycerti&thattheaboyeOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe527‘°dayof&Z4.t),1998,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthe//dayof’77-tt,7bt},1998.TownClerkPASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS-flDAYOF&Ltt,1998.4
