ORDINANCE NO. 17-98
AN ORDINANCE APPROVING THE ANNEXATION
OF CERTAIN TERRITORY TO THE
TOWN OF ESTES PARK, COLORADO,
TO BE KNOWN AND DESIGNATED AS
WILDFIRE RIDGE ADDITION
(formerly submitted as Homestead Ridge Addition)
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK, COLORADO:
Section 1. That a Petition for Annexation, together with four
(4) copies of the plat of said area as required by law, was filed
with the Board of'Trustees on the 14th da-y of July/ 1998 toy the
landowners of one hundred percent (100%) of the area and owning one
hundred percent (100%) of the area, excluding public streets and
alleys of the area hereinafter described. The Board, by Resolution
at its regular meeting on the 14 day of July, 1998, accepted said
Petition and found and determined that the provisions of Section
31-12-107(1), C.R.S., were met; and the Board further determined
that a public hearing should be held on September 8, 1998 at 7:30
p.m. in the Municipal Building for the purposes of determining that
the proposed annexation complies with the applicable provisions of
Sections 31-12-104 and 31-12-105, C.R.S., and is considered
eligible for annexation.
Section 2. That the Notice of said hearing was given and
published as provided in Section 31-12-108(2), C.R.S.
Section 3. That the hearing was held pursuant to the
provisions of Section 31-12-109, C.R.S., on the 8th day of
September, 1998.
Section 4. That following said hearing, the Board of Trustees
adopted a Resolution determining that the proposed annexation met
the requirements of the applicable parts of Sections 31-12-104 and
31-12-105, C.R.S.; that an election was not required under Section
31-12-107(2), C.R.S.; and that no additional terms or conditions
are to be imposed upon said annexation.
Section 5. That the annexation of the following described
area designated as WILDFIRE RIDGE ADDITION to the Town of Estes
Park, Colorado, is hereby approved:
Commencing at the South Quarter corner of Section 20, Township
5 North, Range 72 West of the 6 P.M., Larimer County,
Colorado, thence N88°23'00"W 1083.61 feet to the North ROW of
U.S. Highway No. 34; thence N59°53'00"E 119.55 feet to the

Section 6. The Town of Estes Park, Colorado, hereby consents,
pursuant to Section 37-45-126(3.6) C.R.S., to the inclusion of
lands described above into the Northern Colorado Water Conservancy
District and the Municipal SubDistrict, Northern Colorado Water
Conservancy District.
Section 7. This Ordinance shall take effect and be enforced
thirty (30) days after its adoption and publication.

ANNEXATION AGREEMENT
FOR
WILDFIRE RIDflB ADDITION TO THE TOWN OF B8TB8 PARK
,THIS AGREEMENT is made and entered into this ^° _ day of
_, 1998, by and between THE TOWN OF ESTES PARK,
COLORADO ("the Town"), and PINNACLE HOMES & DESIGN, LLC, a Colorado
limited liability company ("the Owner").
RECITALS
A. The Owner is the owner of the real property described on
Exhibit MA" attached hereto and incorporated herein by reference
("the Property").
B. The Owner has petitioned the Town to annex the Property.
A public hearing to consider the Owner's petition will be held by
the Town Board on September 8, 1998 ("the Annexation Hearing").
C. The owner has requested that the Property be zoned C-0,
Commercial Outlying. A public hearing to consider the zoning of
the Property will be held by the Town Board on September 8, 1998,
immediately following the Annexation Hearing ("the Zoning Hearing).
D. The Owner has submitted to the Town Development Plan
98-02 for development of the Property ("the Development Plan").
The Development Plan was approved by the Town Planning Commission
("the Planning Commission") on August 8, 1998, conditional upon the
annexation and zoning of the Property.
AGREEMENT
FOR AND IN CONSIDERATION OF the mutual promises and covenants
herein contained and other good and valuable consideration, the
legal sufficiency of which is hereby expressly acknowledged, the
Town and the Owner agree as follows:
1. Annexation. The Town shall annex the Property subject to
the terms and conditions of this Agreement if the evidence at the
Annexation Hearing is determined by the Town Board to be sufficient
to support such annexation. The Owner may withdraw its petition
for annexation of the Property at any time prior to adoption of the
Town ordinance annexing the Property. If the annexation of the
Property is successfully challenged by court proceeding or
referendum, this Agreement shall terminate and the parties shall be
released from all obligations hereunder.
2. Zoninci. The Town Board shall zone the Property c-o,
Commercial Outlying, if the evidence at the Zoning Hearing is
determined by the Town Board to be sufficient to support such

zoning. If the Property is not zoned C-0, Commercial Outlying, at
the Zoning Hearing or if the zoning of the Property is successfully
challenged by court proceeding or referendum, this Agreement shall
terminate, the parties shall be released from all obligations
hereunder, and the Owner shall have the right to deannex the
Property from the Town. The Town shall not object to such
deannexation.
3. Development Plan. Conditional upon the annexation of the
Property and the zoning of the Property C-0, Commercial Outlying,
the Property shall be developed pursuant to the Development Plan,
including grading and landscaping plan and the conditions of
approval of the Planning Coaunission. The Development Plan shall
not be amended or modified, except upon approval of the Town Board.
The parties acknowledge and agree that all conditions of approval
of the Development Plan have been met, with the following excep-
tions:
(a) The Owner shall provide storm drainage calculations
and road and utility construction details (as per
Public Works' August 6 and September 8 memos).
(b) The Owner shall apply for inclusion of the Property
within the Northern Colorado Water Conservancy
District.
(c) The Owner shall provide utility and street con-
struction as-builts (as per Public Works'' August 6
and September 8 memos).
(d) The existing kennels shall be fully enclosed and
soundproofed.
4. Vested Property Rights. The Development Plan constitutes
a site-specific development plan under Article 68, Title 24, of the
Colorado Revised Statutes. Upon the annexation and zoning of the
Property, a vested property right shall be deemed established with
respect to the Property based upon the Development Plan. Such
vested property right shall attach to, and run with, the Property
and shall confer upon the Owner the right to undertake and complete
the development and use of the Property under the terms and
conditions of the Development Plan, including any amendments
thereto. The right to develop the Property in accordance with the
Development Plan shall remain vested for a period of three (3)
years after the date of annexation unless the annexation is
challenged by referendum or court proceeding, in which case such
vested right shall be for a period of three (3) years after
affirmation of the annexation by the court and expiration of any

period of appeal or, in the case of a referendum, three (3) years
after the date of the election.
5. Cooperation. This Agreement is the product of the
cooperative effort of the Town and the Owner and shall not be
construed or interpreted against either party solely on the basis
that the Agreement was drafted by one party or the other.
6. Remedies. In the event of default under this Agreement,
the nondefaulting party shall have the right to an action for
specific performance, or damages, or both. In the event a petition
of initiative or referendum is filed which seeks to amend or alter
this Agreement and/or the terms of the ordinances annexing and
zoning the Property, the Owner shall have the right to deannex the
Property, and the Town shall not object to such deannexation.
7. Binding Effect. The rights and obligations created by
this Agreement shall run with the Property and shall be binding
upon and inure to the benefit of the parties hereto and their
successors and assigns.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first above written.
