CGRESOLUTIONNO.19-91WHEREAS,theTownofEstesParkoperatesamunicipalwatersystemthatsupplieswatertoconsumerswithinandwithoutthecorporatelimits;andWHEREAS,certainwateruserswithintheEstesParkareaaresuppliedbywaterthroughvariousprivatewatersystemsanddistricts;andWHEREAS,theTownhasbeenapproachedbyvariousprivatesupplierstoreceivewaterfromtheTown;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatinordertoadequatelyrespondtotheseinquiries,itisnecessarytoadoptapolicyforbothwatermainextensionstoprivatewatersystemsandpurchasesofprivatewatersystems.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.TheTownpolicyforwatermainextensionstoprivatewatersystemsandtheTownpolicyforpurchasesofprivatewatersystems,asismorefullysetforthonExhibit“A”attachedheretoandincorporatedhereinbythisreference,isherebyadopted.2.ThepoliciessetforthonExhibit“A”aremerelypoliciesoftheTownofEstesParkandareinnowayacontracturalobligationoftheTown.3.ThepoliciessetforthonExhibit“A”maybeterminated,amended,orinanyothermannerchanged,atanytimebyactionoftheBoardofTrustees.INTRODUCED,READANDPASSEDTHIS<Q%LtDAYOF‘-:12,;Xç&1991.TOWNOFESTESPARKBy:________________ATTEST:1TL0TownClerk 00TOWNOFESTESPARKPRIVATEWATERSYSTEMSMAINEXTENSIONANDPURCHASEPOLICYTOWNPOLICYFORWATERMAINEXTENSIONSTOPRIVATEWATERSYSTEMS1.TheTownwillconsiderfinancingandconstructingawatermainextensiontoprivateWaterSystemsexistingasofJanuary1,1991underthefollowingconditions:A.Atthedateofthewaterlineextensionrequest,theTowndoesnotcurrentlyservetheWaterSystem.B.Apreliminarycostestimateandfeasibilitystudy,preparedbytheTown,indicatesthatthewaterlineextensioniseconomicallyfeasibleconsideringexistingandfutureTownbudgets,methodsoffinancing,numbersofpossiblecustomersandprobableusage.ThePublicWorksCommitteeshallreviewthecostestimateandfeasibilitystudyandiftheCommitteeauthorizesfurtherconsiderationofsaidextension,thefollowingconditionsareapplicable.1.TheWaterSystemwillagreetopayforaWaterLineMasterPlanfortheinternalwaterdistributionsystem.SaidMasterPlanshallbepreparedbyanengineeringfirm,pursuanttoacontractwiththeTown.2.TheWaterSystemagreestoexecuteanagreementwiththeTowninsuringthattheTownwillbe100%reimbursedforalladministrative,engineeringandconstructioncostsassociatedwiththeextension.Thereimbursementperiodwillbeamaximumoftenyearsandthereimbursementwillinclude0%interest.ThereimbursementplanshallbepreparedbytheWaterSystem,subjecttoTownapproval.3.Allpropertytobeserved,includingfutureserviceareasshallsignanapplicationforawatertapoutsidetheTownlimitswhichshallincludeanagreementtoannex,unlesssaidprovisioniswaivedbytheTown. CaIOWNPOLICYFORPURCHASESOFPRIVATEWATERSYSTEMS1.TheTownwillconsiderthepurchaseoftheassetsofprivateWaterSystemsunderthefollowingconditions:A.Awatermain,adequatelysizedtoservetheexistingdemandplustheproposedsystem’sfuturedemand,islocatedwithinareasonableandfeasiblewaterlineextensiontotheWaterSysteminquestion.B.ThewatersystemhasbeenbuilttoTownstandardsand/orisinaconditionacceptabletotheTown.C.TheTownwilldeterminetheassets,liabilitiesandotherpertinentfactorsconcerningtheWaterSystem.SaidreviewoftheWaterSystemwillformthebasisforthebeginningofnegotiationsbetweentheWaterSystemandtheTownforpurchaseoftheassetsoftheWaterSystem.—2—
