HomeMy WebLinkAboutRESOLUTION 11-93Cl0RESOLUTION11-93BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:ThatthefilingdateoftheapplicationforaNewBeerandWineLicense,filedbyR.MonteSmithandBarbaraStewartSmith,dbaRENDEZVOUSCAFE,509BigThompsonAvenue,EstesPark,Colorado,isMarch31,1993.ItisherebyorderedthatapublichearingonsaidapplicationshallbeheldintheBoardRoomoftheMunicipalBuilding,170MacGregorAvenue,onTuesday,May11,1993,at7:30p.m.,andthattheneighborhoodboundariesforthepurposeofsaidapplicationandhearingshallbetheareaincludedwithinaradiusof3.11miles,asmeasuredfromthecenteroftheapplicant’sproperty.ADOPTED:44/34%L)/L/993 CSRESOLUTIONNO.11-93WHEREAS,inaccordancewithSection17.36.020oftheMunicipalCodeoftheTownofEsteePark,theproposeddevelopmentknownasOutdoorAmusement,Lots5A&9,ProspectVillageSubdivision,wassubmittedtotheEstesParkUrbanRenewalAuthority,(EPUPA)fordeterminationofwhetherornotthedevelopmentcompliedwiththeEstesParkDowntownRedevelopmentProgram(“theplan”);andWHEREAS,pursuanttoResolutionNo.147,datedMarch29,1990,EPURAdeterminedthattheproposedOutdoorAmusementwasnotincompliancewiththeplan;andWHEREAS,thedeveloperrequestedreviewbytheBoardofTrusteesoftheTownofEstesPark,pursuanttoSection17.36.020(G)oftheMunicipalCodeoftheTownofEstesPark;andWHEREAS,theDistrictCourt,LarimerCounty,ColoradohasorderedthattheBoardofTrusteesoftheTownofEstesParkholdaPublicHearingonthedevelopmentrequestforreviewofEPURA’sdetermination;andWHEREAS,anoticeofpublichearingwaspublishedasrecuiredbytheMunicipalCode;andWHEREAS,apublichearingwasheldonMarch15,1993,beforetheBoardofTrusteesoftheTownofEstesPark;andWHEREAS,atsaidpublichearing,evidenceandtestimonywaspresentedtotheBoardofTrustees;andWHEREAS,theBoardofTrusteeshasconsideredalloftheevidenceandtestimonypresentedatthepublichearingconcerningwhetherornottheproposedOutdoorAmusementconformswiththeapplicableprovisionsoftheplan.NOWTHEREFOREBEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK:Baseduponthetestimonyandevidencepresentedatthepublichearing,theBoardofTrusteesoftheTownofEstesParkherebymakesthefollowingfindingsoffact:A.TheplanprovidesthatthesubjectareasaredesignatedforaCommunity—CommercialCenteruse.TheproposedoutdooramusementisaCommunity—CommercialCenteruse.B.Theplanrequirespreservationandimprovementoftherivercorridoranditsrelatednaturalenvironments.TheproposedoutdooramusementprovidesfordedicationofsubstantialpropertytotheTownforriveraccess.Theproposedoutdooramusementcontainslandscapingthatfitswiththenaturalenvironmentofthearea.Thisdedicationofriveraccessandlandscapingpreservesandimprovestherivercorridor. 00C.Theplanprovidesthatentrydevelopmentshouldnotintrudeintothesurroundingopenspace.Theproposedoutdooramusementislocatedonpropertyalreadysurroundedbydevelopment.Thedevelopmentitselfwillnotintrudeintoanysurroundingopenspaceandthededicationofthepropertyalongtherivercorridorwillpreservethewestentrytothedowntownarea.D.Theplandictatesthatdevelopmentshallbesensitivetoandprotectsurroundingareas.Theevidenceindicatesthatthedevelopmentwillnothavesignificantnegativevisual,auditoryandaestheticimpactsuponthesurroundingarea,includingtherivercorridor.E.TheplandirectsEPURAtoencourageandpromoteyear—roundtypedevelopmentinandneardowntownEstesPark.Thisportionoftheplandoesnotrequirethatalldevelopmentwithinthedowntownareaortheentryareasbeyear—round.F.TheplanemphasisthattheEstesParkareahasanimageproblemwithmanytouristamusementsandinefficientutilizationofdevelopableland.ThereissubstantialevidencethatindicatesthesurroundingpropertyhasalreadydevelopedwithamusementsandothercertainattractionsandthisdevelopmentwillnotfurthernegativelyimpacttheEstesParkimage.Basedupontheabovefindingsoffact,theBoardofTrusteesherebyfindsthat:1.TheproposedoutdooramusementonLots5Aand9ProspectVillageSubdivision,TownofEstesPark,LarimerCounty,Colorado,isincompliancewiththeapplicableprovisionsoftheplan,subjecttothefollowingconditions:A.ThehouselocatedwestofFunCityshallberemovedbytheApplicantonorbeforeJuly1,1993.ADOPTEDTHIS15thdayofMarch,1993.TOWNOFESTESPARKBy:/ci-t—Ltfl4—ttt4’-.2-MayorATTEST:TownClerk
