HomeMy WebLinkAboutRESOLUTION 35-0100RESOLUTIONNO.35-01BEINGARESOLUTIONESTABLISHINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIIvIEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEJANUARY1,2002.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911’EmergencyTelephoneService,datedNovember14,1990.betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents($.45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents($.45)permonthisnecessaryandappropriatetoadequatelyfundemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonJanuary1,2002,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents(S.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-11-101,etseq.,C.R.S.3.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,etseq.,C.R.S. 00 00Uponmotiondulymade,secondedandcarried,theforegoingResolutionwasadoptedthis/fdayof_____ ___ _ ___ ___ _,2001.TOWNOFESTESPARK,COLORADOBy_______MayorATTEST:TownClerk 00
