Co00RESOLUTIONNO.30-01WHEREAS,Section9.02.050UnlawfulConductonPublicPropertyoftheMunicipalCodecontainsaprovisionthatallowstheagencyhavingthepowerofcontrol,management,orsupervisionofpublicpropertytoadoptsuchrulesandregulationsasreasonablynecessaryfortheadministration,protection,andmaintenanceofsuchproperty;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoadoptRulesandRegulationsforConfluence,Bond,TregentandPeacockParkslocatedwithintheTownofEstesPark;andWHEREAS,itisdeterminedbytheBoardthatthefollowingRulesandRegulationsarenecessaryfortheadministration,protectionandmatterssetforthinparagraph(a)(1),(2),(3),MunicipalCode.ofTrusteesoftheTownofEstesParktheminimumrulesandregulationsmaintenanceofparkpropertyfortheand(4)ofSection9.02.050oftheNOW,THEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado:1.TheTownofEstesParkRulesandRegulationsforConfluence,Bond,Peacock,andTregentPark,asmorefullysetforthonExhibitAattachedheretoandincorporatedhereinbyreference,areherebyadopted.2.TheappropriateofficialsoftheTownofEstesPark,including,butnotlimitedto,theEstesParkPoliceDepartment,areherebyauthorizedtoenforcetheadoptedRulesandRegulationsincludingthepostingofanynecessarysignageand/orgivingsuchnoticetoanypersonviolatingtheaboveRulesandRegulationsasprovidedinSection9.02.050(b)oftheMunicipalCode.,-ThAdoptedthis%Vdayofc%d.2001TOWNOFESTESPARKTownClerk 0000 0000Exhibit“A”PARKUSAGERULESANDREGULATIONS1.Exclusiveusageofanyparkpropertyisprohibited.Exclusiveusageisdefinedasanypersonorgroupofpersonswhouseanyparkpropertytotheexclusionofallotherpersonsforaperiodlongerthan30minuteswithoutaspecialeventspermit.2.Obstructionofanywalkwayisprohibited.3.Thefollowingactivitiesareprohibited:A.Thethrowing,kicking,tossing,jugglingofanyobjects,including,butnotlimitedto,balls,frisbees,hackeysacks,andotherlikeobjects.B.Playingofanymusicalinstrumentwithoutaspecialeventspermit.C.Usebyanypersonofanyrollerblades,rollerskates,bicycles,scooters,oranyotherlikedeviceonparkproperty.4.Anyformoflitteringisprohibited.5.Disregardinganylawfullypostedsignisprohibited.6.Blockinganyentrywaytoanybusinesslocatedadjacenttoparkpropertyisprohibited.Apersonorgroupofpersonsmaynotblock,harass,orotherwisepreventanypersonorgroupofpersonsfromusingorpatronizinganybusinessadjacenttoparkproperty.7.AnyinfractionoftheserulesoranyotherTownofEstesParkordinanceorStatelawwillresultintheissuanceofaMunicipalCourtorStateCourtcitation. 0000
