HomeMy WebLinkAboutRESOLUTION 08-0300RESOLUTIONNO.8-03BEINGARESOLUTIONESTABLISHINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIMEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEJANUARY1,2004.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911”EmergencyTelephoneService,datedNovember14,1990.betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents($45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents($45)permonthisnecessaryandappropriatetoadequatelyhindemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonJanuary1,2004,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents(S.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-11-101,etseq.,C.R.S.3.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,etseq.,C.R.S. 00 00Uponmotidulymade,secondedandcarried,theforegoingResolutionwasadoptedthis/o—dayof______________,2003.pTOWNOFESTESPARK,COLORADOByU6ATTEST:gMayorTownClerk 00
