HomeMy WebLinkAboutRESOLUTION 12-0400RESOLUTIONNO.12-04BEINGARESOLUTIONESTABLISHINGATELEPHONEEXCHANGEACCESSFACILITYCHARGEANDAWIRELESSCOMMUNICATIONSACCESSCHARGEFORTHELARIMEREMERGENCYTELEPHONEAUTHORITYEFFECTIVEJANUARY1,2005.WHEREAS,theLarimerEmergencyTelephoneAuthoritywascreatedpursuantto§29-11-101,etseq.,C.R.S.,byanIntergovernmentalAgreementConcerningtheImplementationofan“E911EmergencyTelephoneService,datedNovember14,1990,betweencertaingovernmentalentitieslocatedinLarimerCounty,Colorado;andWHEREAS,pursuanttotheaforesaidstatutoryauthorityandbyresolutionoftheTownofEstesParkonMay8,1990,andOrdinanceNo.4-98properlyadoptedbytheBoardofTrusteesonFebruary10,1998,theBoardofTrusteesisauthorizedtoraise,lower,orreestablishatelephoneexchangeaccessfacilitychargeandawirelesscommunicationsaccesschargetobeassessedtelephone(wirelineandwireless)serviceusersintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdeemsthatreestablishingthetelephoneexchangeaccessfacilitychargeattherateofforty-fivecents($.45)permonthandthewirelesscommunicationsaccesschargeattherateofforty-fivecents($.45)permonthisnecessaryandappropriatetoadequatelyfundemergencytelephoneservicesintheTownofEstesPark;NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,ASFOLLOWS:1.CommencingonJanuary1,2005,thetelephoneexchangeaccessfacilitychargeandthewirelesscommunicationsaccesschargeshalleachbereestablishedatforty-fivecents($.45)permonthperexchangeaccessfacilityorperwirelesscommunicationsaccess.2.TelephoneservicesuppliersprovidingtelephoneserviceintheTownofEstesParkareauthorizedtocollectthetelephoneexchangeaccessfacilitychargeinaccordancewith§29-11-101,etseq.,C.R.S. 00 003.WirelesstelephoneservicesuppliersprovidingwirelesstelephoneserviceintheTownofEstesParkareauthorizedtocollectthewirelesscommunicationsaccesschargeinaccordancewith§29-11-100.5,etseq.,C.R.S.Uponmotiqndulymade,scondedandcarried,theforegoingResolutionwasadoptedthis/$—dayofA,2004.TOWNOFESTESPARK,COLORADOBy%L,9aaAC2MayorATTEST:VTownClerk2 00
