aCRESOLUTIONNO.II-08ARESOLUTIONMAKiNGCERTAINLEGISLATIVEFINDINGSANDAPPROVINGTHEURBANRENEWALPLANFORTHE21STCENTURYURBANRENEWALPROJECTWHEREAS,inJanuaryof2007,theEstesParkUrbanRenewalAuthority(theAuthority)commissionedaconditionssurveyandretainedTerranceWareAssociates(theConsultant)toconductstudiesandsun’eysofthearea(Area)describedthereintodetermineiftheAreacontainsfactorsincludedinthedefinitionofblightedareaintheColoradoUrbanRenewalLaw,Sections31-25-101,etseq,,CR5.,(theAct);andWHEREAS.theConsultantprepared,submitted,andpresentedtotheAuthorityandtheBoardofTrusteesoftheTownofEstesPark,Colorado(theTown)aconditionssurveyentitledAnAnalysisofExistinaConditionsRelatingtoBlightTownofEstesPark(theSurvey)datedAugust2007,whichSurveyisincorporatedhereinbythisreference,andwhichdescribesindetailtheconditionsintheArea;andWHEREAS,theAuthorityhasprepared,approved,andsubmittedforreviewbytheBoardofTrusteestheUrbanRenewalPlanforthe2P1CenturyUrbanRenewalArea(thePlan),acopyofwhichisattachedheretoandincorporatedherein;andWHEREAS,theaforesaidPlanisamatterofpublicrecordinthecustodyoftheTownClerkandisavailableforpublicinspectionduringbusinesshoursoftheTown;andWHEREAS.noticeofthepublichearingonthePlanwaspublishedasrequiredbySection31-25-107(3).C.R.S.,atleastthirtydayspriortothepublichearing;andWHEREAS,writtennoticewasmailedordeliveredtoeachpropertyowner,business,andresidentoftheareaincludedinthePlaninfonningthemofthepublichearingatleastthirtydayspriortothepublichearing;andWHEREAS,theEstcsValleyPlanningCommissionhassubmittedwrittenrecommendationstotheBoardofTrusteesthatportionsofthePlancomplywiththe1996EstesValleyComprehensivePlan(theComprehensivePlan).whichisthegeneralplanforthedevelopmentoftheTownasawhole,andalsostatedthatthetaxincrementfinancingprovisionsandproposedprojectsofthePlandonotcomplywiththeComprehensivePlan;andWHEREAS,theAuthorityandtheTownhaveenteredintoaCooperationAgreementdatedSeptemberI,1998(theCooperationAgreement)andanIntergovernmentalAgreementdatedAugust16,1990includingfourAmendmentstotheIntergovernmentalAgreementdatedOctoberII,1994,March25,1997,March26,2003andOctober15,2003(collectively,theIntergovernmentalAgreement)whichprovideforthetransferofpropertyandsalestaxincrement C0revenuesfromtheAuthoritytotheTownandconceptreviewapprovalbytheTownofcertainagreementsrelatedtocarryingouttheUrbanRenewalProject;andWHEREAS,onMarch25,2008,theBoardofTrusteesconductedapublichearingandreviewedsaidPlanpursuanttotheproceduralandnoticerequirementsoftheAct,andtheBoardofTrusteeshavingconsideredtheevidencepresentedinsupportofandinoppositiontothePlan,theSurvey,theComprehensivePlan,andstaffrecommendationsandsohavingconsideredthelegislativerecordandgivenappropriateweighttotheevidence,includingevidencethatthetaxincrementfinancingprovisionsandproposedprojectsofthePlandocomplywiththeComprehensivePlan,makesthefindingssetforthbelow.NOW,THEREFORE.BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK.COLORADO.THAT:SectionI.TheUrbanRenewalAreadescribedinthePlanisfoundanddeclaredtobeablightedareaasdefinedintheAct.ThisisalegislativefindingbytheBoardofTrusteesbasedupontheSurveyandotherevidencepresentedtotheBoardofTrustees.Section2.TheboundariesoftheUrbanRenewalAreahavebeendrawnasnarrowlyastheBoardofTrusteesdeterniinesfeasibletoaccomplishtheplanninganddevelopmentobjectivesofthePlan.Section3.ThePlanhasbeensubmittedtotheBoardofCountyCommissionersofLarimerCounty,Colorado,(theCounty)togetherwiththeinfonnationrequiredbySection31-25-107(3.5)oftheAct.Section4.ParkSchoolDistrictNo.R-3hasbeenpermittedtoparticipateinanadvisorycapacitywithrespecttotheinclusioninthePlanofthetaxallocationprovisionsauthorizedbySection31-25-107(9)oftheAct.Section5.ItisnotexpectedorintendedthattheAuthoritywillrelocateanyindividualsandfamiliesinconnectionwiththePlan,buttotheextentthatanysuchrelocationmayberequired,afeasiblemethodexistsfortherelocationofindividualsandfamiliesindecent,safe,andsanitarydwellingaccommodationswithintheirmeansandwithoutunduehardshiptosuchindividualsandfamilies.Section6.ItisnotexpectedorintendedthattheAuthoritywillrelocateanybusinessconcernsinconnectionwiththePlan,buttotheextentthatanysuchrelocationmayberequired,afeasiblemethodexistsfortherelocationofsuchbusinessconcernsintheUrbanRenewalAreaorinotherareasthatarenotgenerallylessdesirablewithrespecttopublicutilitiesandpublicandcommercialfacilities.Section7.TheBoardofTrusteeshastakenreasonableeffortstoprovidewrittennoticeofthepublichearingprescribedbySection31-25-107(3)oftheActtoallpropertyowners,residentsandownersofbusinessconcernsintheproposedUrbanRenewalAreaattheirlast 00knownaddressesatleastthirtydayspriortothepublichearingonthePlan.Section8.Section31-25-107(4)(d)oftheActdoesnotapplybecausenomorethan120dayshavepassedsincethecommencementoftheonlypublichearingonthePlan.Section9.Section31-25-I07(4)(e)oftheActdoesnotapplybecausetheBoardofTrusteesdidnotfailtopreviouslyapprovethisPlan.Section10.ThePlanconformswiththeComprehensivePlan,whichisthegeneralplanforthedevelopmentoftheTownofEstesParkasawhole.SectionII.ThePlanwillaffordmaximumopportunity,consistentwiththesoundneedsoftheTownofEstesParkasawhole,fortherehabilitationorredevelopmentoftheUrbanRenewalAreadescribedinthePlanbyprivateenterprise.Section12.AlloftheUrbanRenewalAreaiswithinthecorporatelimitsoftheTownandisanareathathasbeenbuilt-upformanyyears.Itconsistsoftheprincipalgovernmental,commercial,andretailareasoftheTown.ConstructionofpublicimprovementsandprovisionofservicesintheUrbanRenewalAreawillbetheprimaryresponsibilityoftheTown,theAuthority,privateenterprise,andprovidersofpublicservicesotherthantheCounty.TheAuthorityandtheTownhavereachedagreementwiththeCountypursuanttoSection31-25-107(11)oftheActwherebytheAuthoritywillremittotheCounty10%oftheannualpropertytaxincrementrevenuecollectedbytheAuthorityfromtheCountylevyintheUrbanRenewalAreaasallocatedtotheAuthoritypursuanttoSection31-25-107(9)oftheAct.TheAuthorityisauthorizedanddirectedtoenterintoanagreementwiththeCountyconfirmingthisunderstanding.Section13.TheUrbanRenewalAreadescribedinthePlanisabuiltupareaanddoesnotconsistofopenlandwithinthemeaningofSections31-25-107(5)and107(6)oftheAct.Theprincipalpublicpurposefortheurbanrenewalplanistofacilitateredevelopmentinordertopreventthespreadofphysicallyblightedareas.Section14.TheAuthorityshallobtaintheapprovaloftheBoardofTrusteespriortopledginganySalesTaxIncrementFinancingrevenueforthepaymentoftheprincipalof,theintereston.oranypremiumsdueinconnectionwithbonds,loans,advancesandindebtednessincurredbytheAuthoritytofinanceactivitiesandundertakingsunderthePlan.Section15.PriortoDecember31,2008.theAuthorityandtheTownshallnegotiateandenterintoanappropriateAgreementtoreplacethecurrentCooperationAgreementandIntergovernmentalAgreementbetweenthepartieswhichshalladdressthefinancingoftheadministrationoftheAuthority,thereviewandapprovalolfutureactivitiesandundertakingspursuanttothePlan,anduseofSalesTaxIncrementFinancingforfinancingsuchactivitiesandundertakings.
