Home My WebLink AboutRESOLUTION 39-13o0RESOLUTION39-13OFTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKTERMINATINGTHETOWNADMINISTRATOR’SAUTHORITYTOENTERINTOCERTAININTERGOVERNMENTALANDIORMUTUALAIDAGREEMENTSFORRECOVERYFROMTHEFLOODWHEREAS,onSeptember12,2013,inordertoundertakeemergencymeasurestoprotectthelife,health,safetyandpropertyofthecitizensoftheTownandpersonsconductingbusinesstherein,andinordertoattempttominimizethelossofhumanlifeandthepreservationofproperty,theTownAdministratorproclaimedalocalemergency”inaccordancewithapplicableColoradoStatutes,andWHEREAS,onOctober8,2013,theTownBoardapprovedResolution29-13terminatingthelocalemergencyeffectiveOctober9,2013;andWHEREAS,Resolution29-13providedtheTownAdministratorwithcertainemergencypowers,includingtheexecutionofcertaindocumentsincluding,butnotlimitedto,intergovernmentaland/ormutualaidagreementsinordertoprovidenecessaryequipment,personnel,servicesandresourcestocontinuetoprovidenecessaryemergencymeasurestoprotectthelife,health,safetyandpropertyofthecitizensoftheTownandTownfacilities;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisnolongernecessaryfortheTownAdministratortohavetheauthoritytoexecuteintergovernmentaland/ormutualaidagreements,andanyotherdocumentsrelatingtorecoveryfromtheFloodof2013asauthorizedinResolution29-13.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:Section1.TheauthorityoftheTownAdministratortoexecuteintergovernmentaland/ormutualaidagreements,andanyotherdocumentsforthepurposeoftheacquisitionandprovisionofresourcesnecessarytocontinuetopreservelifeandpropertywithintheTownofEstesPark,theserviceareasoftheTown’sWaterandLightandPowersystems,andprovideforservicesandresources,includingmaterials,foraccessandrepairofTownroadsandanyotherresourcesnecessarytoprotectTownfacilitiesasauthorizedinResolution29-13isterminated. 00PassedandadoptedattheregularmeetingoftheBoardofTrusteesoftheTownofEstesParkthisdayofDecember,2013.Mayorf)-$ai-nATTEST:t.NpOTamClerk
