Home My WebLink AboutRESOLUTION 29-13oCRESOLUTION29-13OFTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKTERMINATINGTHESTATEOFLOCALEMERGENCYDECLAREDBYTHETOWNADMINISTRATORANDPROVIDINGTHEAUTHORITYTOTHETOWNADMINISTRATORTOENTERINTOCERTAININTERGOVERNMENTALANDIORMUTUALAIDAGREEMENTSFORCONTINUEDRECOVERYFROMTHEFLOODWHEREAS,onSeptember12,2013,inordertoundertakeemergencymeasurestoprotectthelife,health,safetyandpropertyofthecitizensoftheTownandpersonsconductingbusinesstherein,andinordertoattempttominimizethelossofhumanlifeandthepreservationofproperty,theTownAdministratorproclaimeda“localemergency”inaccordancewithapplicableColoradoStatutes,andWHEREAS,pursuanttoResolution27-13,theBoardofTrusteesoftheTowncontinuedthelocaldisasteremergencyuntilsuchtimeasconditionswarrantingthislocalemergencynolongerexist;andWHEREAS,theneedforemergencyactionandremediationoftheTown’sactivitieshasmovedfromemergencyactionstorecoveryandremediationoftheTown’sfacilities;andWHEREAS,certainemergencyresponseandremediationactionsoftheTownarecontinuing,particularlywithregardtodebrisremoval,protectionandrestorationoftheTown’sWaterandLightandPowerfacilities,andemergencyremediationandrecoveryofTownroadsforaccesstoTownandsurroundingproperties;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisnolongernecessarytocontinuethecurrentlocaldisasteremergency;andWHEREAS,itisnecessary,inordertocontinuetoaddressemergencyresponseandremediation,particularlywithregardtodebrisremoval,protectionandrestorationoftheTown’sWaterandLightandPowerfacilities,andemergencyremediationandrecoveryofTownroadsandaccesstoTownandsurroundingproperties,theBoardofTrusteeshasdeterminedthattheTownAdministratorshallbeauthorizedtoexecutecertaindocumentsincluding,butnotlimitedto,intergovernmentaland/ormutualaidagreementsinordertoprovidenecessaryequipment,personnel,servicesandresourcestocontinuetoprovidenecessaryemergencymeasurestoprotectthelife,health,safetyandpropertyofthecitizensoftheTownandTownfacilities.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows: ThelocalemergencyproclaimedbyTownAdministratorLancaster2013,andcontinuedbyResolution27-13,isherebyterminated2013.Section2.Inordertoprovideforthecontinuationofemergencyresponseandremediationfordebrisremoval,protectionandrestorationoftheTown’sWaterandLightandPowerfacilities,andemergencyremediationandrecoveryofTownroadsforaccesstoTownandsurroundingproperties,theBoardofTrusteesoftheTownofEstesParkherebyauthorizestheTownAdministratortoexecuteintergovernmentaland/ormutualaidagreements,andanyotherdocumentsforthepurposeoftheacquisitionandprovisionofresourcesnecessarytocontinuetopreservelifeandpropertywithintheTownofEstesPark,theserviceareasoftheTown’sWaterandLightandPowersystems,andprovideforservicesandresources,includingmaterials,foraccessandrepairofTownroadsandanyotherresourcesnecessarytoprotectTownfacilities.Section3.TheactionoftheBoardofTrusteesonSeptember12,2013tosuspendtheprocurementpolicyisherebycontinueduntilfurtheractionoftheBoardofTrustees.PassedandadoptedattheregularmeetingoftheBoardofTrusteesoftheTownofEstesParkthis94’dayofOctober,2013.ATTEST:CrwnClerk0Section1.onSeptember12,effectiveOctober9,a
