o0RESOLUTION27-13OFTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKEXTENDINGTHESTATEOFLOCALEMERGENCYDECLAREDBYTHETOWNADMINISTRATORWHEREAS,beginningonSeptember12,2013,theTownsuffered,andisstillthreatenedwith,seriousinjuryanddamageconstitutingadisasterofextremeperiltothesafetyofpersonsandproperty,consistingofflashfloodsandriverflooding(the“Flood”);andWHEREAS,onSeptember12,2013,inordertoundertakeemergencymeasurestoprotectthelife,health,safetyandpropertyofthecitizensoftheTownandpersonsconductingbusinesstherein,andinordertoattempttominimizethelossofhumanlifeandthepreservationofproperty,theTownAdministratorproclaimeda“localemergency”inaccordancewithSection24-33.5-709C.R.S.,andWHEREAS,theresultsoftheFloodcontinuetorequireemergencyactionandremediationastheTown’sactivitiesmovefromresponsetoassessmentoftheimpactsoftheFloodandrecoveryefforts,includingdebrismanagementandrepairstoinfrastructure;andWHEREAS,Section24-33.5-709C.R.S.statesthatalocalemergencyproclaimedbytheTownAdministratorshallnotbecontinuedorrenewedforaperiodinexcessofsevendayswithouttheconsentoftheTownBoard;andWHEREAS,conditionscontinuetoexistwhich,fortheprotectionofthehealth,safetyandwelfareofthecitizensoftheTownofEstesPark,warrantthecontinuationofthepreviouslyproclaimedlocalemergency;andWHEREAS,theTownAdministratorisrequestingthattheTownBoardcontinuetheproclamationoflocalemergencyasestablishedbytheTownAdministratoronSeptember12,2013untilsuchtimeastheTownAdministratordeterminestheconditionsjustifyingthislocalemergencynolongerexistorfurtheractionoftheBoardofTrustees.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARKasfollows:Section1.TheBoardofTrusteesherebyfindsthatconditionscontinuetoexistwhich,inthebestinterestsofthehealth,safetyandwelfareofthecitizensoftheTown,warrantthecontinuationofthepreviouslyproclaimedlocalemergencyuntilsuchtimeastheconditionswarrantingthislocalemergencynolongerexist.Section2.TheBoardofTrusteesherebyauthorizes,approves,andconsentstothecontinuationofthestateoflocalemergencyuntilsuchtimeastheTownAdministratordeterminesinwritingthattheconditionsjustifyingthislocalemergencyno 0CllongerexistandsuchwrittendeterminationisfiledwiththeOfficeoftheTownClerkoruntilfurtheractionoftheBoardofTrustees.PassedandadoptedataspecialmeetingofEstesParkthisl8dayofSeptember,2013.ATTEST:ClerkTrusteesoftheTownofMayort,.Th.OO,.,.,-;--LXc-,-
