Home My WebLink AboutRESOLUTION 39-19RESOLUTION39-19ARESOLUTIONAPPROVINGTHESIXTHAMENDMENTTOTHEINTERGOVERNMENTALAGREEMENTBETWEENLARIMERCOUNTYANDTHETOWNWHEREAS,CountyandTownenteredintoanIntergovernmentalAgreementeffectiveFebruary1,2000,(“ISA”)addressingtheirrightsandresponsibilitieswithrespecttolanduse,zoninganddevelopmentwithintheEstesValley,anareacomprisedoftheTownandadefinedareaofunincorporatedLarimerCountyadjacenttotheTown;andWHEREAS,theISAhasbeensubsequentlyamendedfivetimes;andWHEREAS,theISAissettoexpireFebruary1,2020;andWHEREAS,TheTownandCountyhaveenteredintoanewISAaddressingtheirrightsandresponsibilitieswithrespecttolanduse,zoninganddevelopmentwithintheEstesValleytobeeffectiveonApril1,2020;andWHEREAS,theTownandCountyseektoamendthecurrentISApursuanttothisSixthAmendmenttoextendthetermoftheagreementbytwomonthstoallowtimeforTownandCountytomakeanorderlytransitiontonewservicedeliverymodelsnecessarytoperformtheirrespectiveresponsibilitiesdefinedbythetermsofthenewISA.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheBoardofTrusteesapproves,andauthorizestheMayortosign,theintergovernmentalagreementreferencedinthetitleofthisresolution,insubstantiallytheformnowbeforetheBoard.DATEDthislLj’dayofRo’aa-ss,2019.ATTEST:TOWNESPARKMayorClerk
