HomeMy WebLinkAboutRESOLUTION 43-19RESOLUTION43-19APPROVINGTHEAMENDEDPLATOFLOTS5,7,AND9ANDTHESOUTHWESTERLY57FEETOFLOT6,ALLWITHINBLOCK6OFRECLAMATIONSUBDIVISION,TOWNOFESTESPARK,COLORADOWHEREAS,anapplicationforanAmendedPlat(BoundaryAdjustment)torearrangealotline,involvinglotswithinaplattedsubdivision,wasfiledbyStevenFerranteofParkFellowshipChurch(owner/applicant);andWHEREAS,theapplicantrequestsrearrangementofaninternallotlineforapropertydescribedasLots5,7,and9,andtheSouthwesterly57FeetofLot6,Block6ofReclamationSubdivision;andWHEREAS,theAmendedPlatreconfiguresthesubjectlotsintoLot7A(0.380±acre)andLot9A(0.293acre),anddoesnotcreateadditionallotsorbuildingsites;andWHEREAS,apublicmeetingwasheldbeforetheEstesValleyPlanningCommissiononOctober15,2019,attheconclusionofwhichthePlanningCommissionvotedtorecommendapprovaloftheAmendedPlatwiththefollowingfindings:1.ThisproposalcomplieswithapplicablesectionsoftheEVDC.2.Thisrequesthasbeensubmittedtoallapplicablereviewingagencystaffforconsiderationandcomment.Nosignificantissuesorconcernswereexpressedbyreviewingstaffrelativetocodecomplianceortheprovisionofpublicservices.3.NotingtheReclamationSubdivision,aswellasthesubjectproperty’sexistingusesandstructures,wereinplacedecadesbeforetheEstesValleyComprehensivePlanwasdraftedoradopted,stafffindsthesiteisnotinconsistentwiththerecommendationsoftheComprehensivePlan.4.Withthesitehavingbeendevelopedwiththechurch,residence,andaccessorystructuresmanyyearsago,itappearspreviousowners,aswellasplanningstaff,didnottakeinteriorplattedlotlinesintoconsideration,consideringthepropertyasoneparcelalthoughitisinfactLots5,7,and9,andtheSouthwesterly57FeetofLot6,Block6ofReclamationSubdivision.Staffnotesanyfuturenewstructure(s)willberequiredtocomplywithallzoningstandardsandanyapplicableEVDCrequirements.5.Withinsixty(60)daysoftheBoard’sapprovaloftheFinalPlatapplication,thedevelopershallsubmittheplattotheCommunityDevelopmentDepartmentforrecording.Iftheplatisnotsubmittedforrecordingwithinthissixty-daytimeperiod,theapprovalshallautomaticallylapseandbenullandvoid.;andWHEREAS,apublichearing,precededbyproperpublicnotice,washeldbytheBoardofTrusteesonNovember26,2019andatsaidhearingallthosewhodesiredtobeheardwereheardandtheirtestimonyrecorded;and WHEREAS,theBoardofTrusteeshasreviewedandtakenadministrativenoticeoftherecommendationofthePlanningCommissionandthetestimony,application,evidence,documentssubmittedatthehearing,andthecontentsoftheCommunityDevelopmentDirector’sfile;andWHEREAS,theBoardofTrusteesfindstheapplicantshavecompliedwiththeapplicablerequirementsoftheEstesValleyDevelopmentCode.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheAmendedPlatofLots5,7,and9,andtheSouthwesterly57FeetofLot6,allwithinBlock6ofReclamationSubdivision,isherebyapproved.DATEDthis)N!Sdayofè&Si&8G2,2019.ATTEST:TOWNOFESPARKMayor
