Home My WebLink AboutRESOLUTION 33-14oRESOLUTIONNO.33-14WHEREAS,Article27ofTitle29oftheColoradoRevisedStatutesrequiresthatbeforetheTownmayengageoroffertoengageinprovidingcabletelevision,telecommunicationserviceoradvancedservices,anelectionshallbecalledonwhetherornottheTownshallprovidecabletelevision,telecommunicationserviceoradvancedservices;andWHEREAS,theBoardofTrusteeshasdetermined,throughtheadoptionofthisResolution,tocallaspecialmunicipalelectiononFebruary3,2015,forthepurposeofsubmittingtotheelectorsoftheTownaballotquestiononwhetherornottheTownshallhavetherighttoprovideallservicesrestrictedsince2005byArticle27ofTitle29oftheColoradoRevisedStatutesdescribedas“advancedservices,”“telecommunicationsservices”and“cabletelevisionservices”;andWHEREAS,Section31-10-108C.R.S.requiresthespecialmunicipalelectiontobeheldonanyTuesday;andWHEREAS,itisthedecisionoftheBoardofTrustees,bytheadoptionofthisResolution,toholdthespecialmunicipalelectiononFebruary3,2015,pursuanttotheapplicableprovisionsofTitles10&11ofArticle31oftheColoradoRevisedStatutes;andWHEREAS,Section31-10-401,C.R.S.,allowstheBoardofTrusteestodelegatetotheTownClerktheauthorityandresponsibilitytoappointtheJudgesofElection;andWHEREAS,Section31-11-111(2)C.R.S.allowstheBoardofTrusteestofixaballottitleforthisballotquestion. 00NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThataspecialmunicipalelectionshallbeheldonTuesday,February3,2015.2.ThatthespecialmunicipalelectionshallbeamailballotelectionpursuanttotheapplicableprovisionsoftheColoradoStatutes.3.ThattheGlobalElectronicVotingSystem“ACCUVOTE”shallbeusedinthespecialmunicipalelection.4.ThattheTownClerkbeandisherebyauthorizedanddirectedtoperformallactsandfunctionsnecessaryfortheuseofsuchvotingequipmentasrequiredbythelawsoftheStateofColoradopertainingthereto.5.ThatpursuanttoSection31-10-401,C.R.S.,theBoardofTrusteesdelegatestotheTownClerktheauthorityandresponsibilitytoappointtheJudgesofElection.6.ThattheJudgesofElectionshallreceivefortheirservicesthesumof$10/houruptoamaximumof$150.00/day,and$20.00/ea.forJudgesTrainingSchool.7.ThattheTownClerkshall,attheexpenseoftheTown,arrangeforsuchmaterialsandsuppliesforsuchelectionasmaybenecessary.8.ThefollowingballotquestionshallbeplacedontheballotforthespecialmunicipalelectiononFebruary3,2015:Withoutincreasingtaxes,shalltheTownofEstesParkreestablishtheTown’srighttoprovideallservicesrestrictedsince2005byTitle29,Article27oftheColoradoRevisedStatutes,describedas“advancedservices,”“telecommunicationsservices”and“cabletelevisionservices,”includinganynewandimprovedhighbandwidthservicesbasedonfuturetechnologies,utilizingcommunityownedinfrastructureincluding,butnotlimitedto,theexistingfiberopticnetwork,eitherdirectlyorindirectlywithpublicorprivatesectorpartners,topotentialsubscribersthatmayincludetelecommunicationsserviceproviders,residentialorcommercialuserswithintheTownandtheserviceareaoftheTown’slightandpowerenterprise? 0C)DATEDthIs36dayof_____________________2014.TOWNOFESTESPARKMayorATTEST:Clerk
