Informal discussion among Trustees concerning agenda items or other Town matters may occur before this meeting at approximately 5:00 p.m. AGENDA TOWN BOARD STUDY SESSION 1       2 PUBLIC WORKS Report To: Honorable Mayor Jirsa Board of Trustees Through: Town Administrator Machalek From: Greg Muhonen, PE, Public Works Director Project Technical Advisory Committee (TAC) Date: September 10, 2019 RE: Quarterly Update on Downtown Estes Loop Project (DEL) Objective: Update the Town Board on the progress and activities that have taken place on the Downtown Estes Loop Project (DEL) since the June 2019 Town Board Study Session. Present Situation: • Right of Way: Offers for all seven of the full acquisitions have been made to property owners. Purchase of four parcels is complete. The Transportation Commission approved CDOT’s request for authorization to condemn the three remaining parcels. Agreements for Possession & Use are in place for these 3 parcels, and the property owners have been paid the appraised value for their parcels. The district court will determine if additional compensation is warranted. • CDOT consultant relocation agents continue to meet with the tenants and owners who will be relocated to discuss the process and cost eligibility of each relocation. • CFLHD has allocated an additional $2M in FLAP funds to cover estimated cost escalation for rights of way and easements. Final costs remain to be determined. • See attached summary of CDOT acquisition and relocation activities for the Donut Haus. • Hydraulics: The Project team continues work with CFLHD, CDOT, Town of Estes Park and other regulatory agencies to refine the hydraulic analysis in coordination with the CWCB’s Colorado Hazards Mitigation Program. • Schedule: The project schedule anticipates completion of the construction documents in 2019. Right of way acquisitions are expected to extend into 2020. Project construction is expected to begin in the summer of 2021, while advance utility relocations and building demolition is expected to start in October 2019. 3 • Scope Expansion: As directed by the Town Board at the May 14 meeting, we hired AECOM to prepare an application for a federal BUILD grant that would fund increased project scope to include the Riverside and Rockwell Bridges and channel widening downstream to US36. The grant application was submitted July 19. A response from the US Department of Transportation is expected by November 12, 2019 Proposal: The TAC proposes to continue the design and right-of-way acquisition efforts in preparation of bidding the construction work in early 2021. Two winter construction seasons are anticipated if the BUILD grant is awarded and the Phase 2 work is built. Advantages: The project benefits are numerous and include relief to the Town’s downtown traffic congestion problems, improved downtown mobility for bicyclists, reduction in downtown flood risk from the Big Thompson River, and closure to property owner uncertainty surrounding the DEL. Disadvantages: Resistance can be anticipated from some community member who do not support the DEL. Action Recommended: n/a Finance/Resource Impact: The Town remains obligated to pay a local match in the amount of $4.2 million for the Phase 1 project, and has offered an additional $1.5 million as an incentive local cost share of a requested $25 million BUILD grant. The revised total project cost is $44 million for both phases. To date, $3,425,626.46 has been spent by the Town on this project. Additional project costs have been incurred by CDOT and Central Federal Land Level of Public Interest The known level of public interest in this item is high. Ongoing conversation with RC, RC displeased as firm upfront commitments could not be provided as relocation is a reimbursement program of actual, reasonable and necessary costs determined eligible under the regulations. 12/14/2018 – Move Bids from 2 moving companies conducted. 12/21/2018 – RC withdraws interest in moving forward with a team development of the EP site. 2/8/2019 – Meeting with EP, CDOT and DH. Presented available properties in Estes Park. DH interested in the Antique Cottage later determined to be under contract. Shared results of move bids. 2/8/2019 - 3/8/2019 - Ongoing site search 3/8/2019 – Meeting with EP, CDOT and DH. More sites presented. DH interested in Soda Splash site. 3/8/2019 - 4/19/2019 - DH works with realtor and collects info on Soda Splash site. 4/19/2019 – DH meeting with builder to obtain cost information. 5/3/2019 – DH meeting with survey/engineer to obtain site development costs and to initiate professional services to determine feasibility of site. An explanation of the process was discussed with the owners. 10/30/17 Owner appraisal is received. 3/27/18 CDOT offer is made in the CDOT appraised amount. 4/11/18 Mitch attempted to contact the owners to discuss the offer. The indication was they could not respond until after the season was over. 9/11/18 Mitch contacted the owners to discuss the offer. 9/27/18 The owner’s attorney, Monica Plake, indicated the owners could not consider the offer without knowing what the relocation benefit would be. Relocation agent, Wes Loetz, was asked to contact them. 12/12/18 CDOT would not accept the owners appraised amount, but an offer of settlement is made. 1/8/19 Property owners reject the offer. 1/30/19 Property owners are asked if they have a counteroffer they would submit to CDOT. They indicated an amount to settle. 2/8/19 Meeting in Estes at the Town Hall. Owners, Town, CDOT and agents were in attendance. Discussion with Mitch and Wes on the acquisition and relocation. CDOT would not settle at the amount the owners proposed. Wes indicated his efforts to find a replacement site and continues to search. He had a lead he wanted the owners to see. They agreed. 3/8/19 Meeting with owners at the Town Hall. Explanation of the Notice of the Transportation Commission meeting to authorize condemnation. Discussion of the Soda Splash site as a relocation site. The owners indicate do not want to go into debt to relocate. 7/10/19 Mitch is authorized and makes a Last Written Offer. 7/23/19 Mitch receives a Possession and Use Agreement from the owners for the
