Director Chilcott stated she would also discuss minor modification code language and how those applications have been handled in the past. Attorney White cautioned the Commission that they are an advisory body and they would not be the decision-making body if this dispute continued. Director Chilcott added it would benefit staff to know what the Planning Commission would view as a minor modification. Johanna Darden/Town resident was hopeful that the current staff and Planning Commission could sift through issues such as these and make improvements to the code for the benefit of all involved. She supported Mr. Greslin and Mr. Schultz. 2. CONSENT AGENDA A. Approval of minutes, October 18, 2011 Planning Commission Meeting. It was moved and seconded (Norris/Hull) to approve the consent agenda as amended, and the motion passed unanimously with one absent. Betty Hull was in attendance at the October meeting. 3 A^T0 THE ESTES VALLEY DEVELOPMENT CODE REGARDING ALTERATIONS OF EXISTING NONCONFORMING ACCESSORY STRUCTURES p'rector Chi'cott reviewed the staff report. Last month draft language was presented and feedback was provided by the Commission. The proposed code changes in Section 6 4 Change of Nonconforming Use would read «A nonconforming accessory dwelling unit may ^qfJ%redt pr0ilatVohA,alteratl0n does not enlar9e or move the accessory dwelling unit Alteration).” This proposal would allow property owners to Chitntt ctjt H T fbut"ot exPand the exterior, footprint, or height of unit. Director Chilcott stated that this would not allow a property owner to expand an ADU into an e’ n0fr m°Ve ADU’ The ProPosed code Change also included correcting ctlPl1 reference- Commissioner Fraundorf questioned whether the draft code language would ensure that the physical space of the ADU could not be enlarged. Public Comment None. Staff and Commission discussion There was general consensus to support the code revision. Director Chilcott reported the Timbers Townhomes preliminary and final townhome maps would be heard by the Town Board on November 22, 2011. f. Director Chilcott report the ADU problem statement was discussed briefly at the Town Board meeting, and would be discussed in more detail at the meeting on November 22,2011. g. Director Chilcott announced the local amendments regarding automatic fire sprinkler systems were approved by Town Board on November 8, 2011. Commissioner Norris expressed his appreciation to staff in addressing the Mary’s Meadow issue with Mr. Greslin and Mr. Schultz.
