AN ODINAiTCE ESTABLISHING FIRE LILITS AND CONCERNING FIRES AND TilE PREVENTION THEREOF WITHIN SUCH LIMITS AND ‘vVITHIN THE TOWN OF ESTES PARK. BE IT QFLDAINED y THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK: Section 1.All that portion of the Town of Estes Park emb’aced within thescribeã.limits shall hereafter be known as,and shall hereafter be,the Fire Limits of said Town of Estes Park,viz: Block,1,2,3,4,5,6,7,8,9,and U,Lot 27 .f 1ock 3.0, and that piec’e of 1nd known as the ?rk—c N\ /- (LL A-4 Section 2.It shall be the duty of the owner of every building within the said Fire Limits and of his agent having the same in charge to constntct upon his or her prem ises and to maintain a secl2re vault,room,bin or receptacle of brick,stone,,cement or of equally fire proof construction and material,in ich to keep ashes,and it shall be the duty of every such owner and agent and of every tenant and.occupant of every building with the said.Fire Limits to deposit all ashes in such receptacle,and to remove the same from such -1- L ---1 receptacle when it shall be filled,which said ashes shall be transported to a point beyond the town limits of Estes Park, and the person removing them shall see to it that no live coals or fire remain in such ashes after they have been re moved;and no ashes shall be kept or deposited in any part of the Fire Limits in anything other than such receptacle; the opening at the top of such receptacle shall be kept se curely covered with an incombustible cover,and such recepta cle shall be so constructed that ashes cannot escape therefrom. Section 5.No persons shall deposit or permit any one in his or her employ to deposit any ashes in any pther place than such receptacle,and when such receptacle is filled the ownex’or user shall empty or cause the same to be emptied, and shall transport such ashes to a point beyond the corporate limits of said town,and the persons so transporting such ashes shall extinguish any live coals or fire in them immediately after he shall have deposited them. Section 4.No person shall set up or use a stove,in said Fire Limits,the top or any side of which stove shall be within two feet of any part of the wood.work of the wall or partition of any building,without protecting such wood work with a metallic covering so as to prevent effectually the same F from taking Lire from such stove. Section 5.Stovepipes,when used in said Fire Limits, shall not be less than si1x inches from any wood or other corn bustible material,unless there be a ventilator between said pipe and.wood or other combustible material,which said.yen tilator shall be substantially made of sheet iron or some other suitable metal,and which said.ventilator shall have at least /one inch of ventilating space between the double circles of metal.With such ventilators no sucb pipe shall be nearer than J j —2— • .L r 3”. -I4 ALJJL Li Section 6.Every stove and furnace in any building, in said Fire Limits,shall be placed and kept on a platform of brick,sheet iron,or other incombustible substance,extending six inches at least in every direction beyond that part of the lower plate that fronts the door of the stove or furnace. Section 7.The owner or occupants of every house,or other building,in said Fire limits,shall cause the flues or chimneys therof to be swept or burnt out as often as may be necessary to keep the same clean,but such burning out shall not be done without precautions taken sufficient to prevent danger therefrom. Section 8.All trimmers and trimmer heads shall be at least one inch clear of any part of any chimney or &iy ±lue. No chimney shall hereafter be built,in said Fire Limits,‘with a wall of less thickness than four inches o±brick or stone completely imbedded in lime mortar,cement or both.Holes for stovepipes shall have a sheet iron thimble inserted in the chimney,imbedded in mortar or other material equally well adapted,and,when not in use,a tin or sheet iron stopper with a flange at least half an inch thick outside the brick. Section 9.No person shall,in said Fire Limits, boil any pitch,tar,resin,turpentine,varnish,or other inflammable substance,unless the same be done in an open place thirty feet distant at least from any building or other property that might be injured thereby,or in a fire-proof building. - — — ___ .-‘ r;___ rtC) S.., two inches of any wood vork or other combustible material. Provided that in no case shall a stovepipe be made or allow ed to project through the roof of a building for the purpose of a chimney. Ft I -3- Section 10.No person shall burn any shavings or other combustible matter in any street,alley,highway,or other public place,or near any building or other property that might be injured thereby.No person shall burn shavings or other combustible matter within any building,so that burning sparks,burning cinders,flames,or fire in any foim, shall espape from any chimney or flue,or ipe connected with any building to such an extent as to endanger any other pro perty in said town. Section 11.Unless securely kept within a tin,or glass lantern,or other material eqtially well adapted for the purpose,no lighted candle or other light shall be used by any person,in this town,in any livery stable,barn,or any other place,containing hay straw,oil,gasoline,or other combus tible matter. Section 12.No person shall,in this town,carry, or cause to be carried,in any street or other highway,any burning coal or brand,unless the same be shut up in a covered vessel. Section l.The Marshal shall have power by written notice to require all persons to correct,remove or abate any state of things done,caused,suffered or permitted,by them in violation of any of the provisions of this ordinnce,when such state of things shall be susceptible o±being corrected, removed,or abated.very period of twenty-four hours’con tinuance of such a state of things,after such notice given, shall be deemed a separate offense and misdemeanor on the part of the person so notiiied. Section 14.Any person who shall violate any of the provisions of this ordinance,shall be deemed guilty of a mis demeanor,and,upon conviction thereof,be fined not less than five nor more than three hundred dollars. -4- _ Section 1.The Iarsha1 may,at all reasonable times, enter into and exsmine all dwelling houses,or other buildings, lots,yards and enclosures in order to discover if they are in a dangerous state auoh as is roibited by any of the •‘rovisions of this ordinance,and to cause such as may be unsafe to be put in a safe and secure condition so as to conform to the provisions of this ordinance. Section 16.This ordin’nce is necessary to the pre— sertion of the public peace1 health and safety,and shall be in force and effect immediately avon its passage and publication. Section 17.The reasons why it is thus necessary for the immediate preservation of the publio peace,health and safety,is that ft is for the purrose of tiking precaution against damage by fire and for the prevention and spread of fire.
