HomeMy WebLinkAboutORDINANCE 230ORDINANCE NO.230 AN ORDINANCE AMENDING SECTION 18.2 OF THE MUNICIPAL CODE OF THE TCMN OF EST P(kRK,COLORADO.THE SAME.RElATING TO CATTLE AND HORSES AND FEFNITS THFIEFOR. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTFS PARK,COLORADO: Section 1.That Section 18.2 of the Municipal Code of the Town of Estee Park,Colorado be and the same is hereby amended to read: §18.2—Cattle and Horses. l8.2—l——Cattle Horses Prohibitç.It shall be unlawful for any person to herd,keep,maintain or harbor any cattle,horses or other livestock within the corporate limits of the Town except as provided in this code. §18.2—2——Permit Required.No person shall keep or maintain a horse within the corporate limits of the Town unless such person has a valid permit so to do. Application for a permit to keep a horse shail be made in writing to the Town Clerk and shall contain and adequate description of the real property upon which horses are to be kept and maintained.Following application, the Town Building Inspector shail cause the premises to be inspected,and if all the requirements of this code are complied with,he shall authorize issuance of the permit.The Town Clerk shall issue all permits upon the payment of a fee of $5.00.A permit shall continue to the end of the calendar year unless revoked as herein provided. §18.2—3——Permit Conditions.The Town Building Inspector shall authorize issuance of a permit to keep and maintain horses on certain described premises within the Town upon his determination that the following conditions or requirements are complied with: (a)Permits may be issued only to owners and lessees of livery stables and to resident owners or lessees of real property located within R—l Residence Districts or R—2 Multiple Family Residence Districts. (b)A maximum of two horses may be kept or maintained on the first acre of land described in each permit and an additional horse may be kept or maintained for each additional acre of land described in each permit; provided,however,that this limitation shall not apply to livery stables. Any real property included in a permit issued hereunder shall not be included in another permit. f c)Any shed,shelter,or corral in which horses are kept or maintained shall not be closer than 25 feet to any building occupied as a residence or used for human habitation and 50 feet from any street or property line.All property where horses are to be kept or maintained shail be fenced by a lawful fence as defined by the Statutes of the State of Colorado,which fence shall be constructed at least 50 feet from the outside boundary line of the property described in the application for a permit hereunder. (d)The construction of feeding facilities and the construction, drainage,floorinp,ventilation and fly screening of all sheds,or other shelters shall be governed by any regulations adopted by the Town Board of Trustees. §l8.2—c——Exceptions.The area requirements or proximity of enclosures to residences,property lines and streets as provided in this chapter shall not be applicable to the display of horses by entrants in any show or fair authorized by the Town during such show or fair. §18.2—5——Revocation or Denial. (a)The Town Building Inspector may recommend the revocation of any permit upon the grounds that the permfttee is violating or has violated any of the provisions in this chapter.Such recommendation shall be filed with the Town Clerk,who shall cause a written notice to be mailed to the permittee notifying him that a hearing on the Building Inspectors recommendations will be held at the Board of Trustees meeting to be held not less than 10 days from the date of mailing such notice.Such notice shall specify the time and place of said hearing.If,upon such hearing, the Board of Trustees finds that the perndttee has violated any of the provisions of this chapter,the Board of Trustees may forthwith revoke his permit and the permittee shall be allowed 4 hours within which to remove all horses and 10 days to remove any offensive or prohibited material. fb)Upon the denial of a permit under the provision of this chapter, the Town Clerk shall cause written notice of such denial to be mailed to the applicant,notifying said applicant thereof.An applicant desiring to appeal such denial shall within 10 days of receipt of the notice of denial, file with the Town Clerk a written request for a hearing before the Board of Trustees.Upon receipt of a request for hearing,the Town Clerk shall give notice of the hearing to applicant in the manner provided in paragraph (a)of this section for hearings upon revocation.The Board of Trustees shall following such hearing,either direct that the permit be issued or denied. §18.2—6-—Sanitary Regulations and Inspections.The premises upon which horses are kept shall be maintained in a sanitary condition and shall comply with all sanitary regulations adopted by the Town Health Department. Said premises shall at all reasonable hours be subject to inspection by representatives of the Town Health Officer.It shall be unlawful for any person to refuse to permit such inspection. Section 2.The Board of Trustees herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety for the keeping of horses affects the public health and such keeping must be controlled,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
