AN ORDINANCE NENDING CHAPTER 5 OF THE
MUNICIPAL CODE OF TNE TOWN OF E$TES PARK,
COLORADO,BY ADDING SECTION 5.10 PERTAINING
TO POLICEN’S PENSIONS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF TNE TOWN
OF ESTES PARK,COLORADO:
Section 1.That Chapter 5 of the Municipal Code of
the Town of Estes Park,Colorado is amended by adding thereto
the following:
5.10 Policemen’s Pension Fund.
5,10-i Fund Established.
5.10-2 Operation of Fund.
5.10-3 Limit of Contribution by Town.
5.10-li Police Officers’Contribution.
5.10-5 Deduction from Police Salaries.
5.10-6 Refund of Contribution.
5.10-1 Fund Established.The Policemen’s Pension
Fund of the Town is that fund established by Article L9 of
Chapter 139,C.R.S.,1963.
5.10-2 Operation of Fund.The Policemen’s Pension
Fund of the Town shall be operated in accordance with the
laws and statutes of the State of Colorado as provided in
chapter l39—L9—l to l39—L9—2L,C.R.S.‘63,and as the same
may later be amended.
5.10-3 Limit of Contribution by Town.The Board hereby
finds and determines that the Town should use the power granted
to it under chapter l39-L9-20,C.R.S.‘63,and does hereby
elect to pay from the general funds of the Town,into the
Policemen’s Pension Fund created hereby such sum monthly as
shall not exceed one per cent (1%)of the monthly salaries of
the total Police Department of the Town.
.lO-i±Police Officers’Contribution.The members
of the Police Department shall from their respective monthly
salaries contribute into the Policemen’s Pension fund of the
Town,identical percentages monthly of their respective
monthly salaries so that the contribution of the Police
Department as a whole shall match the contribution of the Town.
.io-5 Deduction from Police Salaries.The Town
Treasurer be and is hereby euthorized to deduct the appropriste
amounts as are provided in section .lO—L from the respective
monthly salaries of the members of the Town’s Police Department
and deposit the same in the Policemen’s Pension Fund of the
Town.
.lO-6 Refund of Contributions.(a)Should any paid
member of the Police Department who has contributed to the
Fund Leave the services of the Town prior to becoming eligible
to receive a pension payable from funds of the Policemen’s
Pension Fund,for any reason other than his death,disability
or retirement,all funds that shall have been paid into such
fund by such person shall be refunded to such member on demand.
In no event shall such refund include accumuleted interest on
the members contributions or any portion of the Town’s contri
bution to the Fund.
(b)Refund of a policeman’s payment as hereinabove
provided may be made in installments,according to such rules
and regulations as the Board of Trustees shall from time to
time adopt.
Section 2.The Board of Trustees herewith finds,
determines and designates that this ordinance is necessary for
the immediate preservation of the public peace,health and
safety for provision for a police force effects the public peace,

health and safety,and whereas in the opinion of the Board
of Trustees an emergency exists,this ordinsnce shall take
effect and be in force five (5)days after its final passage,
adoption and publication.
