ORDINANCE NO.3-75
AN ORDINANCE REGULATING ELECTRIC CONDUC
TORS AND EQUIPMENT AND INSTALLATION THERE
OF;ADOPTING BY REFERENCE THE NATIONAL
ELECTRICAL CODE,1975 EDITION;AMENDING
SECTION 14.20.010 OF THE MUNICIPAL CODE
OF THE TOWN OF ESTES PARK,COLORADO,AND
PROVIDING PENALTIES FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.Adoption.---The National Electrical Code,
1975 Edition (NFPA No.70-1975),adopted and issued by the
National Fire Protection Association,470 Atlantic Avenue,
Boston,MA 02210,at least three copies of which have been
certified as true copies by the mayor and town clerk,Estes
Park,Colorado,and which are now on file in the office of
the town clerk,is hereby enacted,adopted by reference,in
corporated herein and made a part of the Municipal Code of the
town of Estes Park,Colorado,as hereinafter provided.The
said National Electrical Code is a code which regulates elec
tric conductors and equipment and the installation thereof
within the town of Estes Park,Colorado.Its purpose is the
practical safeguarding of persons and property from hazards
arising from the use of electricity within the town.
Section 2.That Section 14.20.010 of the Municipal
Code of the town of Estes Park,Colorado,is hereby amended
to read as follows:
14.20.010 National Electrical Code--Adopted.The
“National Electrical Code,”1975 Edition,(NFPA No.70-1975),
adopted by the National Fire Protection Association,470 At
lantic Avenue,Boston,MA 02210,at its annual meeting held
May 20-24,1974,in Miami Beach,Florida,of which three copies
are now filed in the office of the town clerk,and may be in
spected during regular business hours,is enacted and adopted
by reference as a secondary code and incorporated herein as

if set out at length.The subject matter of the National
Electrical Code relates to the regulation of electric con
ductors and equipment installed within or on public and
private buildings and other structures,including mobile
homes and recreational vehicles;and other premises such as
yards,carnival,parking and other lots,and industrial
substations,also the conductors that connect the installa
tion to a supply of electricity and other outside conduc
tors on the premises.The purpose of this Code is the prac
tical safeguarding of persons and property from hazards
arising from the use of electricty.
Section 3.Penalties.---The following penalties
set forth in the Municpal Code of Estes Park,Colorado,and
hereafter set forth in full,shall apply to and be a part of
this ordinance:
(a)14.20.015 National Electrical Code--Violation.
a)It is unlawful for any person to violate any of the pro
visions stated or adopted in the National Electrical Code.
fb)Every person convicted of a violation of
any provision stated or adopted in the National Electrical
Code shall be punished as set forth in Section 1.20.020.
(b)1.20.020 Fines and penalties.Any person who
shall be convicted of a violation of this code shall be fined
not less than one dollar nor more than three hundred dollars,
or imprisoned for a term not exceeding ninety days,for each
offense,or by both such fine and imprisonment.Where any
violation is a continuing offense,each day that the viola
tion continues shall be considered and held to be a separate
and distinct offense.
Section 4.Validity.---If any part or parts of this
ordinance are for any reason held to be invalid,such deci
sion shall not affect the validity of the remaining portions
of this ordinance.The board of trustees hereby declares

that it would have passed this ordinance and each part or
parts thereof,irrespective of the fact that any one part
or parts be declared invalid.
Section 5.Repeal.———Existing ordinances or parts
of ordinances covering the same matters as embraced in this
ordinance are hereby repealed and all ordinances or parts
of ordinances inconsistent with the provisions of this or
dinance are hereby repealed,except that this repeal shall
not affect or prevent the prosecution or punishment of any
person for any act done or committed in violation of any or
dinance hereby repealed prior to the taking effect of this
ordinance.
Section 6.Interpretation.---This ordinance shall
be so interpreted and construed as to effectuate its general
purpose to provide minimum standards and procedures to safe
guard life or limb,health,property and public welfare by
regulating and controlling electric conductors and equipment
and the installation thereof.Article and section headings
of the Ordinance and adopted National Electrical Code shall
not be deemed to govern,limit,modify or in any manner af
fect the scope,meaning or extent of the provisions of any
article or section thereof.
Section 7.Publication.---The town clerk shall cer
tify to the passage of this ordinance,cause notice of its
contents and passage to be published,and make not less
than three copies of the adopted Code available for inspec
tion by the public during regular business hours.
Section 8.Effective Date.---The board of trustees
of the town of Estes Park,Colorado,herewith finds,deter
mines and designates that this ordinance is necessary for
the immediate preservation of the public peace,health and
safety,for the regulation of electric conductors and equip
ment and the installation thereof affects the public peace,

health and safety;and whereas,in the opinion of the board
of trustees an emergency exists,this ordinance shall take
effect and be in force five (5)days after its final passage,
adoption and publication.
PASSED BY THE BOARD OF TRUSTEES AFTER PUBLIC HEARING
AND SIGNED THIS 14TH DAY OF JANUARY,1975.
