HomeMy WebLinkAboutORDINANCE 19-77S 0 ORDINANCE NO.19—77 AN ORDINANCE REPEALING AND RE-ENACTING CHAPTER 10.12 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,RELATING TO VEHICLE REMOVAL FROM CERTAIN LOADING ZONES AND STORAGE CHARGES THEREFOR. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Chapter 10.12 of the Municipal Code of the Town of Estes Park, Colorado,is hereby repealed and re-enacted as follows: Section 1.10.12.010 Removal from certain loading zones.Whenever any police officer of the Town of Estes Park finds a vehicle parked or standing within any of the following described loading zones between the hours of 7:00 a.m.and 12:00 Noon,such officer is hereby authorized to cause the vehicle to be removed,and neither the officer nor anyone operating under his direction shall be liable for any damage to such vehicle occasioned by such removal. Section 2.10.12.020 Loading zones.Such officers shall have the authority to so remove any such vehicles from the following loading zones within the Town: (1)On the North side of Elkhorn Avenue between a point which is 278 feet East of the Bighorn Drive intersection with Elkhorn Avenue to a point which is 322 feet East of said intersection. (2)On the South side of Elkhorn Avenue between a point which is 201 feet East of the Moraine Avenue intersection with E]khornAvenue to a point which is 261 feet East of said intersection. (3)On the North side of Elkhorn Avenue between a point which is 283 feet West of the Bighorn Drive intersection with Elkhorn Avenue to a point which is 343 feet West of said intersection. Section 3.10.12.030 Storage Procedure.Prior to causing any such vehicle from being removed,the officer shall make a reasonable effort to con tact the owner or operator of the vehicle by making inquiry within the surrounding business area as to the location of said owner or operator.Upon causing such a vehicle to be removed,the officer shall also cause the same to be placed in storage at a location as designated by the Board of Trustees of the Town of Estes Park. Section 4.10.12.040 Appraisal.As soon as practicable,either before or after removal of the vehicle,the officer causing the removal or an employee of the Town shall cause an appraisal to be made of the vehicle in order to determine the approximate reasonable market value thereof,and for this purpose any licensed Colorado motor vehicle dealer shall have author ity to make such appraisal.In addition,the Chief of Police of the Town of Estes Park may appoint any member of the Town Police Department to make such appraisals,and any appointments so made shall be reported by the Chief of Police to the Executive Director of the Colorado Department of Revenue and to the Colorado State Department of Highways. Section 5.10.12.050 Towing and storage charges.Whenever any vehicle is removed and placed in storage in accordance with this Chapter,all expenses incurred by the Town for storage and towing shall be paid to the Town before such vehicle is released from such impoundment.Cost of towing shall have a minimum charge of ten dollars and a maximum charge of twenty-five dollars,to be computed at the rate of one dollar per mile one way,plus an additional charge of up to ten dollars if any wheeled equipment,commonly referred to as a “dolly’,was required for towing,and storage shall be charged at the rate of up to one dollar twenty-five cents per day for un covered storage and up to two dollars per day for covered storage for a maximum of sixty days. Section 6.10.12.060 Notice and disposition.In the event the vehicle is not reclaimed by the owner or operator within the period specified by Colorado Revised Statutes 1973,42-4-1103,or as amended,the officer removing the same or the Chief of Police shall prepare and forward the re quited notices and dispose of the vehicle as set forth in the provisions of said 42-4-1103 C.R.S.,1973,as amended. Section 7.The Board of Trustees of the Town of Estes Park, Colorado,herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,for the regulation of the streets within the Town effects the public peace,health,and safety;and whereas,in the opinion of the Board of Trustees, an emergency exists,this ordinance shall take effect and be in force after its final passage,adoption and approval and signature of the mayor. —2- PASSED BY THE BOARD OF TRUSTEES AND SIGNED THIS 28th DAY OF June ,1977.
