HomeMy WebLinkAboutORDINANCE 18-800• ORDINANCE NO.1$-so AN ORDINANCE AMENDING CHAPTER 13.08 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO LIGHT AND POWER RULES AND REGULATIONS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 13.08.040 B of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 13.08.040 B.Discontinuance by Town:The department may discontinue service under any of the following conditions, subject,however,to the requirements and procedures set forth and adopted in subparagraph 4 and Chapter 13.10 of the Municipal Code: 1.If user’s wiring or equipment is considered unsafe,service may be discontinued after due notice and will not be reconnected until the unsafe condition has been corrected.Notwithstanding the foregoing,the department may discontinue service without notice to the user if a hazardous condition is discovered on a user’s premises,or, if the unsafe condition or manner of utilizing service could be considered dangerous to the life,health or safety of any person,thus,making an immediate discontinuance of service to the premises imperative. 2.Consumer shall not connect any energy—consuming appliance or device on the department’s side of a meter nor tamper or otherwise interfere with the proper operation or registration of department’s meter or permit others to perform such connection,interference or tampering and for violation of this regulation,service shall be disconnected without notice and will not be reconnected until consumer shall have paid an estimated service bill for the period during which such violation existed and shall have irstalled standard service entrance wiring in accordance with the prevailing requirements of the town ordinance relating to electrical installations,inspections,licensing,permit and regulations. 3.Service may be discontinued for non—payment of past due service accounts,for non—payment of any required deposit,or if service to the user’s equipment is detrimental, in the opinion of the department,to service to other users served by the department. 4.Any discontinuance of service pursuant to subparagraph 3 above shall be in accordance with and pursuant to the Discontinuance Regulations set forth in Chapter 13.10 of the Municipal Code.Tariff sheets filed by the Town with the Public Utilities Commission pertaining to termination of electric service shall also be applicable to customers receiving service inside municipal boundaries,except that any hearing requested by a customer receiving service inside municipal boundaries of the Town shall be held before the superintendent of the department,or his designated representa tive,and the superintendent or his representative is empowered to decide whether or not the proposed discontinuance is in conformity with the provisions of this Section and the Discontinuance Regulations,and said person is empowered to 0 decide the matter in dispute. 5.In the event of disconnection by the town for any of the foregoing causes,and after evidence is submitted that the cause for disconnection has been corrected,electric service may not be restored until payment of a combined disconnection and reconnection fee of fifteen dollars, unless said reconnection shall be requested and performed during non—business hours of the department,in which event the combined disconnection and reconnection fee shall be thirty dollars.The non—business hours of the department are defined as between the hours of 5:00 P.M.and 8:00 A.M., Monday through Friday;weekends and any federal holiday or holiday observed by the town. Section 2.That Section 13.08.050 B of the Municipal Code of the Town of Estes Park,Colorado is amended by adding thereto the following: Users who have previously received service from the department shall be required to make a new or additional deposit only if previous payment records include recent or substantial delinquencies. Section 3.The Board of Trustees hereby authorizes the Town Administrator and other officials of the Town to file with the Public Utilities Commission of the State of Colorado such documents and to take such action as may be necessary to obtain the approval of said Public Utilities Commission as may be required under applicable law for changes in rules and regulations for electric service. Section 4.Except as herein specifically amended, Title 13 and all ordinances or parts of ordinances of the Municipal Code of the Town of Estes Park relative to the Light and Power Department shall be and hereby are designated to remain in full force and effect and are hereby ratified, confirmed and approved. Section 5.The Board of Trustees of the Town of Estes Park,Colorado,herewith finds,determines and designates that this Ordinance is necessary for their immediate preserva tion of the public peace,health and safety,in order to provide for uniform regulations and to conform to recently adopted rules of the Public Utilties Commission;and whereas, in the opinion of the Board of Trustees,an emergency exists, —2— this Ordinance shall take effect and be in force immediately after its passage,adoption and signature of the Mayor.
