AN ORDINANCE AMENDING CHAPTER 13.28
OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,THE SAME PERTAINING
TO WATER METERS
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
Section 1.That Section 13.28.010 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as
follows:
13.28.010 Definitions.As used herein,the following words
and phrases are defined as follows:
A.“Consumer”means the person in whose name a water
account is carried in the town’s records.
3.“Commercial”means any use of water for other than
single-family dwelling purposes.“Dwelling”,“dwelling unit”,
“family”,“apartment”mean as defined in the Uniform Building
Code.
C.“Condominium unit”means an individual airspace unit
of a multi—unit property designed for ownership in separate estates
together with the interest in the common elements appurtenant to
such unit.
Section 2.That Section 13.28.030 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as follows:
13.28.030 Required for commercial consumers.
A.All commercial water consumer services shall be metered.
Said metering shall include a water meter,a meter pit,or other
meter locations within the structure,yokes,and a remote reader.
B.All individual dwelling units in two family dwellings,
multi—family dwellings,apartments,and condominiums,shall be
individually metered.All such individual metering shall be
approved by the water superintendent.All costs related to such
water metering shall be charged to the consumer and paid for by
the consumer as provided in Chapter 13.32 for the payment of water
rent.In the event such charges are not paid when due,the provi
sions and procedures of Chapter 13.32 pertaining to delinquent
water rent will be applied to such delinquent charges.
C.All required individual meters shall be installed within
one year from the effective date of this ordinance.
D.If the water superintendent determines that the physical
characteristics of any structure existing on the effective date of
this ordinance makes individual metering impractical,said structure
shall be metered as specified by the water superintendent.If any
owner or consumer determines that such decision by the water
superintendent is in error,said person shall have the right to
appeal such decision to the Board of Trustees.
Section 3.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates that
this Ordinance is necessary for their immediate preservation of

the public peace,health and safety,in order to provide for
uniform water metering regulations;and whereas,in the opinion
of the Board of Trustees,an emergency exists,this Ordinance
shall take effect and be in force immediately after its passage,
adoption and signature of the Mayor.
I hereby certify that the above ordinance was introduced
and read at a regular meeting of the Board of Trustees on the
14th day of October ,1980,and published in a
newspaper of general circulation in the Town of Estes Park,
Colorado,on the 17hday of fltnhv ,1980,all as
required by the Statutes of the State of Colorado.
