ORDINANCE NO.6-84
AN ORDINANCE AMENDING CHAPTER 12 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,THE SAME PERTAINING TO STREETS
AND SIDEWALKS
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
ESTES PARK,COLORADO:
Section 1.That Section 12.20.020 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as
follows:
12.20.020 Construction—-Conformance to permit specifica
tions.All sidewalks and curbs shall be constructed on a grade,
line and location established by the town engineer and specified
in the permit,shall be constructed of inorganic materials,suchasconcrete,brick and concrete block,or any combination thereof,
which material shall be secured in place.All curbs shall beconstructedonlyofconcrete.No sidewalk shall have a surfaceirregularitygreaterthanone-fourth inch in ten feet.The
surface of any sidewalk shall have a degree of roughness at least
equal to that of a broomed concrete surface.
Section 2.That Section 12.24.020 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as follows:
12.24.020 Encroachments allowed by permit.Encroachments
shall be allowed by permit in any sidewalk within the town.
Section 3.That Section 12.24.030 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as follows:
12.24.030 Application for a permit.A.Any person desiring
to encroach in a portion of a sidewalk within the town shall
make written application to the town.Said application shall be
filed with the Town Clerk and shall contain the following informa
tion:
1.The applicant’s name,address and telephone number;
2.The street,alley,or sidewalk affected and the amount
thereof;
3.The type of encroachment including detailed description
of length,width and height of the encroachment;
4.If the encroachment is attached to any building,the names
and addresses of the owners of the property to which the encroach
ment is to be attached.
B.The application shall be filed by the applicant and all owners
of property to which an encroachment is attached or upon which an
encroachment is located.The applicant and owners shall also
agree in writing to be bound by all of the provisions of this
chapter and any rules and regulations of the town pertaining to
encroachments.
C.The application shall be presented to the Board of Trustees
for approval.The Board of Trustees may approve said encroach
ment if the Board finds that the granting of the encroachment
will not be materially detrimental to the public welfare or
injurious to other property in the neighborhood or unduly inter
fere with pedestrian traffic on the sidewalk.

D.The Board may deny the application,or grant the application
with or without conditions.The Board,in its discretion,
may attach such conditions as the Board feels is necessary
to preserve the public welfare.Following approval by the
Board,the Town Clerk shall issue a permit to the applicant
and owner specifying the nature of the encroachment and any
conditions attached by the Board of Trustees to the granting
of the permit.
Section 4.That Section 12.24.040 of the Municipal Code
of the Town of Estes Park,Colorado,is amended to read as
follows:
12.24.040 Maintenance.All encroachments shall be
maintained to prevent deterioration due to weather,use,or
any other factor affecting the physical condition of the
encroachment.
Section 5.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates
that this Ordinance is necessary for their immediate preserva
tion of the public peace,health and safety,in order to provide
for uniform sidewalk regulations;and whereas,in the opinion
of the Board of Trustees an emergency exists,this Ordinance
shall take effect and be in force immediately after its
passage,adoption and signature of the Mayor.
