0ORDINANCENO.2-93ANORDINANCEAMENDINGSECTIONSOFTITLE13OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,WITHREGARDTOWATERCONNECTIONCHARGESWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendaportionofTitle13oftheMunicipalCode.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Sections13.32.010,13.32.012,13.32.015,13.32.018,13.32.020and13.32.040areherebyamendedandaddedtoreadasfollows:13.32.010Definitions.ForpurposesofthisChapter13.32,thefollowingwordsandphrasesaredefinedasfollows:A.“Consumer”meansthepersonorentitywhoownstherealpropertytowhichwaterserviceistobefurnishedandwhoexecutestheapplicationforaconnectiontothesystem.B.““Dwelling”meansadetachedbuildingdesignedtor,oroccupiedby,oneormorefamilies.C.“DwellingUnit”meansaportionofabuildingintendedaslivingquartersforasinglefamily,havingasinglesetofkitchenfacilities(astove,pluseitherorboth,arefrigeratorandsink)notsharedwithanyotherunit;orquartersforuptofivepersonsinadormitory,congregatedwelling,orsimilargroupdwelling.D.“AccessoryDwellingUnit”meansadwellingunitcreatedwithinorasanextensiontoanezistingsingle-familydwelling,comprisingnotmorethanone—thirdofthehabitablefloorareaoftheentiredwelling,andhavingseparateegresseitherdirectlytotheoutsideorthroughasharedhall.E.“SingleFamilyDwelling”meantadwellingcontainingasingledwellingunit,orasingledwellingunitplusanaccessorydwellingunit.F.“Multi—FamilyDwellingUnit”meansadwellingcontainingtwoormoredwellingunits.G.“CommercialAccommodationsUnit”meansaguestunitprovidingtransientaccommodationstothegeneralpublicforcompensationwhichdoesnotincludekitchenfacilities. Cn CaH.“BedandBreakfast”meansadwellinginwhichtheownerortenantletsroomsand/orprovidestableboard.Bedandbreakfastaccommodationsshallbetreatedforthepurposeofthischapterasanon—accommodationcommercialconnection.I.“LargeLotConnection”meansanyundividedparceltobefurnishedwaterbytheTown’swatersystemwhichcontains10acresormore.Section13.32.012ConnectionCharge.TheconsumershallpaytheTownforeachnewconnectiontotheTown’swatersystemaconnectionchargeasfollows:A.SingleFamilyDwelling.1993$3,520.001994$3,700.001995$3,840.00B.Multi—FamilyDwelling—PerDwellingUnit.1993$2,460.001994$2,590.001995$2,690.00C.CnmsnercjalAccommodations—PerUnit.1993$2,110.001994$2,220.001995$2,300.00D.Non—AccommodationCommercialConnection—thelesserofthefollowing:1.MinimumCharge.1993$2,110.001994$2,220.001995$2,300.00—2— 00Section13.32.015PreviouslyPurchasedWaterTaps.IntheeventaconsumerhaspreviouslypurchasedawatertapandpaidafeetotheTown,theconsumershallbeentitledtoaconnectionbasedupontheprovisionsofthisSection.A.SingleFamilyDwelling.Nocharge.B.Multi-FamilyDwelling-PerDwellingUnit.Thelesserofthenumberofnewfixturevaluesoverthefixturevaluespurchasedpreviouslytimes$47.50or$1,400.00.C.CommercialAccommodations—PerUnit.Thelesserofthenumberofnewfixturevaluesoverthefixturevaluespreviouslypurchasedtimes$47.50or$1,200.00.D.Non—AccommodationCommercialConnection.Thenumberofnewfixturesvaluesoverthefixturevaluespurchasedpreviouslytimes$47.50.F.LargeLotConnection.Nocharge.Section13.32.018AdditionalServicesorFixtures.A.Shouldtheconsumerdesireadditionalserviceorfixtures,ortoapplythewaterforapurposenotstatedatthetimeoftheoriginalapplication,permissionmustbeobtainedtherefor.Whenadditionalfixturesareaddedandpermissionthereforhasnotbeenobtained,theconsumershallbechargeddoublethecurrentchargeforeachfixturevalueaddedwithoutpermission.Allofsuchchargesaretobeaddedontoandcollectedwiththewaterbill.B.Shouldtheconsumerdesireadditionalserviceorfixturesafterpaymentofaconnectionchargeorinstallationoftheoriginalservice,theconsumershallpayfortheadditionalservicethesameamountsassetforthinSection13.32.015above.13.32.020Installation.Allnecessarypipe,fittings,meters,valves,shut—off,trenching,back—fillingandinstallationofthephysicaltaptotheTown’swatersystemmustbeattheexpenseoftheconsumerandunderthesupervisionoftheWaterSuperintendent.Allwaterserviceconnectionsandallwaterserviceextensions,bothwithinandwithouttheTownlimits,aresubjecttospecialfeesasadoptedbytheBoardofTrustees.TappingmustbeaccomplishedbytheTownandastandardcorporationclockandexpansionjoint,furnishedbytheTownmustbeused.NowaterserviceshallbefurnishedtotheconsumeruntilallconnectionchargesandinstallationfeeshavebeenpaidtotheTown.Inadditiontotheforegoingcharges,theconsumershallpaytotheTownanychargesthattheTownhasagreedtocollectforpropertytobeservedbythewatermaintowhichtheconsumer’sservicelineistobeconnected,includinganycontractlineassessmentasfullysetforthinSection13.24.230ofthiscode.Saidfeesshallbepaidpriortoreceiptofanywaterservice.—4— C0Section13.32.040Discontinuance,TerminationandAbandonmentofService.Anyconsumerwhodesirestodiscontinuetheuseofwatershallfilewrittennoticewiththefinanceofficerandpayallcurrentandbackchargesforwaterused.Anyconsumerwhofailstopaytheapplicableminimumratesetforthinthischapterforaperiodofoneyearorwhoseserviceisterminatedaselsewhereprovidedinthischapterandwhoseservicehasnotbeenrestoredwithinoneyearfromsuchterminationshallloseanyrighttohaveanywaterservice,includingtheforfeitureoftheconnectioncharge.AnyreconnectiontotheTown’swatersystemafterdisconnectionofservice,pursuanttothissection,shallrequireanewapplicationforserviceincludingpaymentofallconnectionchargesassetforthinthischapter.Section2.Section13.32.110F.isherebyamendedtoreadasfollows:Section13.32.110FMinimumRate.Aminimumrateofone—halfthemeteredminimumbillshallbechargedforeachpropertyforwhichaconnectionfeehasbeenpaidfromthedateofpaymentoftheconnectionfeetothedateonwhichthepropertyisconnectedtotheTown’swatersystem,andthereafterattheratessetforthinthischapter.TheconsumershallnotifytheTownofthedateofthefirstuseofwaterfromtheTown’swatersystem.Intheeventserviceisterminated,theminimumrateshallnotapply.Atsuchtimeastheterminatedserviceisrestored,theconnectionchargeassetforthinthischapter13.32shallbepaid.Section3.Section13.32.130F.isherebyamendedtoreadasfollows:Section13.32.130F.MinimumRate.Aminimumrateofone—halfthemeteredminimumbillshallbechargedforeachpropertyforwhichaconnectionfeehasbeenpaidfromthedateofpaymentoftheconnectionfeetothedateonwhichthepropertyisconnectedtotheTown’swatersystem,andthereafterattheratessetforthinthischapter.TheconsumershallnotifytheTownofthedateoffirstuseofwaterfromtheTown’swatersystem.Intheeventserviceisterminated,theminimumrateshallnotapply.Atsuchtimeastheterminatedserviceisrestored,theconnectionchargeassetforthinthisChapter13.32shallbepaid.Section5.Section13.32.140isherebydeleted.Section6.Section13.24.200isherebyamendedtoreadasfollows:—5— 0.aSection13.24.200Meters-Size.MetersizesshallbedeterminedbytheWaterDepartmentbaseduponthenumberofdwellingunits,fixtures,equipmentordevices.Ifatanytimetheadditionofdwellingunits,fixtures,equipmentordevicesisfoundtorequirealargermeter,themetershallbechangedandtheconsumershallpaythedifferenceincostentailedonanewmeterbasis.Section7.Section13.24.230isherebyamendedtoreadasfollows:Section13.24.230ContractLineExtensionPolicy.A.TheTownhasconstructedcertainwatermainstoprovidewaterservicetoundevelopedportionsoftheTown’swaterservicearea.AlistingofthesewatermainextensionsandtheareastheyserveareonfileintheWaterDepartment.Allconnectionstothesemainsfromthedesignedareasshallbesubjecttoacontractlineassessmentasfollows:TAPSIZECONTRACTLINEASSESSMENT3/4”$1,100.001”2,000004,400.002”7,800.004”31,290006”70,411.00SaidfeesshallhepayableaspartoftheconnectionchargeasmorefullysetforthinChapter13.32ofthiscode.B.TheWaterDepartmentreservestherighttochargetheentirecontractlineassessmentforanynewsubdivisionatthetimeoftheissuanceofthefirstbuildingpermitinsaidsubdivision.Section8.Thisordinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.—6—
