HomeMy WebLinkAboutORDINANCE 10-93cç)ORDINANCE10-93ANORDINANCEAMENDINGSECTION9.18.040OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADOASITPERTAINSTOBICYCLESWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoamendSection9.18.040oftheMunicipalCodeoftheTownofEstesPark.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.Section9.18.040isherebyaddedtoreadasfollows:9.18.040RestrictionsonBicycles.ItisunlawfulforanypersontooperateabicycleuponanyportionofRiversidePlazaandtheportionoftheRiverwalkfromBarlowPlazatoitsintersectionwithEastRiversideDrive.Abicyclemaybeoperatedonanyotherpublicstreet,alley,parkinglot,riverwalkordesignatedbikepath.Section2.TheadoptionofthisOrdinanceisherebydeclaredanemergencyinordertoimmediatelycontroltheuseofbicyclesonpublicproperty,andWHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexists,thisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,THIS27thDAYOFJuly,1993.TOWNOFESTESPARK,COLORADOBy:_____MayorATTEST:T—IC&QTownClerk(Deputy)IherebycertifythattheaboveordinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe27thdayofJuly1993,andpublishedinanewspaperofgeneralpublicationintheTownofEstesPark,Colorado,onthe30thdayofJuly,1993.L-fl-<L1cL_j’TownClerk(Deputy) 0CD C,aORDINANCENO.9-93ANORDINANCEVACATINGAUTILITYEASEMENTLOCATEDONLOT2,SEPAHPURSUBDIVISIONINTHETOWNOFESTESPARK,COLORADOWHEREAS,theownersofLot2,SepahpurSubdivisionintheTownofEstesPark,Coloradohaverequestedthatautilityeasementlocatedonsaidpropertybevacated;andWHEREAS,allcurrentandpotentialusersofsaidutilityeasementhaveprovidedtheTownofEstesParkwithwrittenstatementsindicatingthattheyagreeandapproveofthevacationofthisutilityeasementonsaidproperty;andWHEREAS,theBoardofTrusteesoftheTownofEstesPark,Colorado,hasdeterminedthatitisinthebestinterestoftheTowntovacatetheutilityeasementlocatedonsaidproperty.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:TheBoardofTrusteesoftheTownofEstesPark,Colorado,herebyvacatesthefollowingutilityeasement:Thatcertainten(10)footutilityeasementbeingfive(5)footeithersideofthecenterlinedescribedasbearingN75°39’34”Wadistanceof148.36’locatedonLot2,SepahpurSubdivision,aportionofLot13,GrandEstatesSubdivision,locatedintheSEkofSection19,TSN,R72Wofthe6thP.M.,,TownofEstesPark,CountyofLarimer,StateofColorado.Section2:TheadoptionofthisOrdinanceisherebydeclaredtobeanemergencyinorderfortheimmediatevacationoftheutilityeasement,and;WHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignaturebytheMayor.
