08-9300ORDINANCENO.8-93ANORDINANCEAMENDINGCHAPTER5.30OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADOREGARDINGLIQUORLICENSEFEESANDPROCEDURESWHEREAS,theBoardofTrusteesoftheTownofEstesParkhavedeterminedthatitisnecessarytoamendChapter5.30oftheMunicipalCodeoftheTownofEstesPark.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section2.Chapter5.30shallreadasfollows:5.30.010Liquorandbeerapplicationfees:EachapplicationtotheTownfora3.2%beer,malt,spirituousorvinousliquorlicenseshallbeaccompaniedbyafeeasfollows:A.Foranewlicense,fourhundredfiftydollars($450.00);B.Foratransferoflocationorownership,twohundredfiftydollars($250.00);C.Forarenewalofanexistinglicense,twenty—fivedollars($25.00);D.Forachangeofregisteredmanagerforahotelandrestaurantlicense,seventy—fivedollars($75.00).5.30.020Renewals:A.Allrenewalapplicationsformalt,vinousandspirituousliquorlicensesandforfermentedmaltbeveragelicensesshallbesubmittedtotheTownClerkontheprescribedtorms,togetherwiththeapplicablelicensefeesnolaterthantorty—five(45)dayspriortothedateonwhichthelicenseexpires.TheTownClerkmaywaivetheforty—five(45)dayrequirement,butinnoeventshallanyapplicationforrenewalbeacceptedbytheTownClerkafterthedateofexpirationofthelicense.NorenewalapplicationshallbeacceptedbytheTownClerkwhichisnotcompleteineverydetail.B.Uponreceivingthecompletedrenewalapplication,theTownClerkshallreviewtheapplicationandanyotherpertinentinformationtodeterminewhether“goodcause”ispresentforrenewal.Whether“goodcause”ispresentisafactspecificinquirydependingonthecircumstancesofthecase,andshallbebasedonevidencethatcontinuationofthelicensewould 00becontrarytothepublicinterest,aswellastheconductofthelicensee.IftheTownClerk’sreviewindicatesnofactsorcircumstancessupporting“goodcause”fornonrenewal,theTownClerkshallissuearenewallicense.C.IfthereisinformationbeforetheTownClerktendingtoconstitute“goodcause”fornotrenewingaparticularlicenseforanadditionalyear,theTownClerkshallcausetobeissuedanoticeofhearing.Theservice,andpostingofnoticeshallbeasprovidedintheapplicablesectionsoftheColoradoLiquorandBeerCodes.Atthehearing,theTownBoardshallmakeadeterminationwhetherornotthelicenseshallberenewed.Section5.30.030NewLicensesandTransferofOwnership:A.AllapplicationsfornewlicensesandtransferofownershipshallbesubmittedtotheTownClerkontheprescribedforms,togetherwiththeapplicablelicensefees.NonewlicenseortransferofownershipapplicationshallbeacceptedbytheTownClerkwhichisnotcompleteineverydetail.B.Uponreceivingthecompletedapplication,theTownClerkshallsettheapplicationforpublichearing,publishandpostthepremisesasprovidedintheapplicablesectionsoftheColoradoLiquorandBeerCodes.Section5.30.040ModificationofPremises:A.AllapplicationsformodificationofpremisesshallbesubmittedtotheTownClerkontheprescribedforms.NomodificationforpremiseapplicationshallbeacceptedbytheTownClerkwhichisnotcompleteineverydetail.Uponreceivingthecompletedapplication,theTownClerkshallreviewtheapplicationandanyotherinformationtodeterminewhetherornotthepremises,aschanged,alteredormodified,willmeetallthepertinentrequirementsoftheColoradoLiquororBeerCodeandtheregulationspromulgatedthereunder.IftheTownClerk’sreviewindicatesthatthepremises,aschanged,alteredormodified,willmeetsaidpertinentrequirements,theTownClerkshallapprovetheapplicationformodificationofpremises.B.IftheTownClerkdeniestheapplication,theTownClerkshallgivenoticeinwritingandstatethegroundsuponwhichtheapplicationwasdenied.TheapplicantshallbeentitledtoahearingbeforetheTownBoardonthedenialiftheapplicantrequeststhesamewithinfifteen(15)daysafterthedateofthenoticeofdenial.—2— 0•05.30.050SpecialEventsPermit:A.Allapplicationsforspecialeventspermits,pursuanttoArticle48ofTitle12,C.R.S.,shallbefiledwiththeTownClerkontheprescribedformstogetherwiththeapplicablepermitfees.NospecialeventsapplicationshallheacceptedbytheTownClerkwhichisnotcompleteineverydetail.B.Uponreceivingthecompletedspecialeventsapplication,theTownClerkshallreviewtheapplicationandanyotherdocumentationanddeterminewhetherornottheapplicationmeetsalloftherequirementsofArticle48ofTitle12,C.R.S.,andtheregulationspromulgatedthereunder.TheTownClerkshallalsocausethepremisestobepostedasprovidedinsaidstatute.IftheTownClerkfindsthatallapplicablerequirementsofthestatestatuteandregulationspromulgatedtheretoaremet,andnoprotesthasbeenfiled,theTownClerkshallissuethespecialeventspermit.C.IfthereisinformationbeforetheTownClerkand/oranyprotestfiledbyaffectedpersons,theTownClerkshallcausetobeissuedanoticeofhearingonthespecialeventsapplication.TheTownClerkshalldoallrequiredpostingandnotification.Atsaidhearing,theTownBoardshalldeterminewhetherornottoissueordenythepermit.Section6.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOF,TRUSTEESOFTHETOWNOFESTESPARK,COLORADO____DAYOFJ&,1993..1TOWNOFESTESPARKBy:____NaS’orATTEST:TownClerk—3—
